			<content:encoded><![CDATA[<p><img src="http://torrentfreak.com/images/peermedia.jpg" align="right" alt="pirate bay" />At the beginning of April 2009, ARTISTdirect, the owner of infamous anti-piracy spoofing company MediaDefender, <a href="http://torrentfreak.com/mediadefender-buys-mediasentry-090403/">announced</a> that it had acquired SafeNet’s anti-piracy tracking company, MediaSentry. The acquisition cost them $936,000, comprised of $136,000 in cash and an $800,000 one year note.</p>
<p>Now, following an announcement by ARTISTdirect CEO Dimitri Villard, it seems that the sullied names of both MediaDefender and Media Sentry will be consigned to the archives as the company rebrands the pair under a new name: Peer Media Technologies.</p>
<p>Despite the <a href="http://torrentfreak.com/mediadefender-emails-leaked-070915/">hacking chaos</a> that all but <a href="http://torrentfreak.com/mediadefender-founders-leave-sinking-ship-090326/">destroyed</a> Media Defender&#8217;s business, coupled with the controversy when Media Sentry&#8217;s investigative tactics were deemed illegal in several US states (and was promptly dropped by the RIAA), ARTISTdirect is still touting the pair as a force to be reckoned with &#8211; albeit with a new coat of paint and a new name.</p>
<p>&#8220;The combination of MediaDefender, the leader in Internet Piracy Prevention (IPP) with Media Sentry, the leader in business and marketing intelligence derived from P2P channels, creates a true powerhouse in the field of intellectual property protection,&#8221; says a notice on Peer Media&#8217;s shiny new <a href="http://www.peermediatech.com/index.html">website</a>.</p>
<p>CEO Dimitri Villard also announced that he had hired ex Macrovision and Blackwave director Terri Denver as head of worldwide sales at Peer Media.</p>
<p>According to ARTISTdirect, the rebranding and consolidation of MediaDefender and Media Sentry under the Peer Media banner will benefit the customer base &#8220;by offering higher quality products than either company did previously.&#8221; </p>
<p>Services being offered by Peer Media include spoofing and decoys on file-sharing networks, sending cease and desist notices to ISPs to forward to their customers and sending the same to file-hosting sites carrying copyright content. Other services include monitoring networks for leaked movies and music, and assessing demand for media by monitoring what file-sharers do on the Internet.</p>

			<content:encoded><![CDATA[<p>We <a href="http://torrentfreak.com/new-anti-piracy-lawyers-chase-uk-file-sharers-090508/">recently reported</a> that ACS:Law appear to have taken up where notorious UK lawyers Davenport Lyons left off, sending threatening letters to alleged BitTorrent and eDonkey copyright infringers demanding payment of hundreds of pounds or face legal action.</p>
<p>Sadly, ACS:Law don&#8217;t appear to be practicing what they preach, despite taking the moral high-ground with the hundreds of recipients of their letters.</p>
<p>In an article published on their site entitled &#8220;20th Century Fox hit by illegal downloads&#8221; (Google cache copy <a href="http://74.125.77.132/search?q=cache:www.acs-law.org.uk/index.php%3Foption%3Dcom_content%26view%3Darticle%26id%3D54:movie-studio-illegal-downloads-%26catid%3D1:latest-news+%2220th+Century+Fox+hit+by+illegal+downloads">here, since the page has been removed after we published this</a>). ACS:Law appear to have taken the easy option and instead of writing their own article, chose to cut and paste paragraph after paragraph of other people&#8217;s work, passing it off as their own, without so much as a link to any source or a mention of an author&#8217;s or publication name.</p>

<p>Even though there are clearly no references to any sources, links back to the original articles or mention of the author&#8217;s name in the ACS:Law article, TorrentFreak contacted all three publications to double check that permission had not been granted. Of the trio, Duncan Riley editor of Inquisitr.com was most vocal, telling TorrentFreak;</p>
<p>&#8220;No, we have not given permission for the content to be used. What perhaps is the height of hypocrisy, besides the wholesale theft of the text word for word, is that the paragraph they have taken is from a post that argues that piracy helped Wolverine, and then they&#8217;ve added anti-piracy statements to the end.&#8221;</p>
<p>We must admit we are very confused. On the one hand ACS:Law speak constantly about how their clients suffer at the hands of copyright infringement, yet the company itself appears to have a different approach when it comes to its own dealings.</p>
<p>Just recently, a support site set up to help recipients of ACS:Law letters cope with their predicament was ordered to stop its activities by ACS:Law (under threat of legal action) after they objected to the link between the site&#8217;s domain name (<a href="http://www.beingscammed.com/">beingscammed.com</a>) and their firm. The owner of the site was forced to publish an apology on the site&#8217;s homepage. As expected, <a href="http://www.beingthreatened.yolasite.com/">another site</a> has taken its place. </p>
<p>ACS:Law have forced others to publish an apology on their site too after comments were made that the law firm objected to. In the interests of fairness, it seems fitting that that Mr Andrew Crossley, as main partner of ACS:Law, publishes his own apology on <em>his</em> site&#8217;s homepage for making use of other people&#8217;s copyright works and exploiting them for commercial gain.</p>
<p>Andrew Crossley was already fined by the UK&#8217;s Solicitors Regulatory Authority (SRA) for engaging in &#8220;conduct unbefitting a solicitor&#8221; (<a href="http://www.sra.org.uk/documents/consumers/SDT/Crossley%209346.05_0206.pdf">pdf</a>) back in 2006. We believe that a law firm claiming to uphold copyright law on behalf of its clients but infringing copyright in the process warrants the same label, but we&#8217;ll let the Conduct Investigation Unit at the SRA decide.</p>
<p>And to those that think these infringements by ACS:Law are small ones to be brushed off or discounted, then in an ideal world, yes, you would be absolutely correct. No one should care about small infringements of copyright. No-one should have to write articles about petty copyright infringement, but these are the depths to which this arena has sunk.</p>
<p>But consider which games these threats and lawsuits are all about. Two Worlds from Reality Pump is available on Amazon for £12, Topware&#8217;s Dream Pinball 3D is available for under £10, Call of Juarez by Techland much less than that. At <em>absolute best</em> ACS:Law has evidence that copyright was infringed via an IP address for a mere second on a few kilobytes of these titles. For these equally small infringements, ACS:Law demand around £600 from the public to satisfy them and their clients, backed up by the threat of ruination in court.</p>
<p><em>That&#8217;s</em> how low we&#8217;ve sunk. It must stop, all of it.</p>

			<content:encoded><![CDATA[<p>Founded in 2001, FTD is The Netherlands largest Usenet community with around 450,000 members. FTD and its associated software allows its members to report the location of material they find on Usenet, which could include the usual movies, music and TV shows. This caused it to be a target for notorious anti-piracy outfit BREIN.</p>
<p>Not wanting to be bullied for what it considers to be a completely legal operation, FTD took the unusual step of taking BREIN to court, after Tim Kuik, the head of the outfit, said that FTD and its operators were committing a crime. FTD&#8217;s owners and lawyers vigorously deny this claim, the details of which can be found in our <a href="http://torrentfreak.com/usenet-community-takes-anti-piracy-group-to-court-090515/">earlier report</a>.</p>
<p>So what led up to this legal showdown? TorrentFreak spoke with FTD&#8217;s specialist IT lawyer, Arnoud Engelfriet, of <a href="http://ictrecht.nl/">Ictrecht law firm</a>.</p>
<p>&#8220;In January of this year, BREIN announced they were &#8216;going after Usenet&#8217; and<br />
specifically singled out FTD as their first target,&#8221;  Arnoud told TorrentFreak.</p>
<p>Naturally this position was of concern to FTD, but instead of burying their heads in the sand they actually contacted BREIN with a view to discovering where their differences lay and sorting them out amicably.</p>
<p>&#8220;Shortly after that, FTD engaged in negotiations with BREIN to find out what their objections were and how we could overcome them,&#8221; Arnoud told us. The discussions led FTD to pro-actively modify how they operate to ensure that there could be no doubt as to their legality.</p>
<p>&#8220;We even voluntarily made some changes to the FTD platform to ensure there could be no doubt we were in the clear,&#8221; Arnoud explained. But their attempts to engage and negotiate with BREIN came to nothing.</p>
<p>&#8220;After we made the changes, we got complete radio silence from BREIN. No confirmation, no rejection, nothing,&#8221; Arnoud explained. &#8220;Only after several days we found out what BREIN thought &#8211; but only by reading the online news. That was a huge disappointment.&#8221;</p>
<p>Indeed, ignoring the outstretched hand and making their intentions against FTD public, BREIN chief Tim Kuik spoke with Dutch publication Volkskrant and the resulting article titled &#8220;You do not pay for it, it’s unlawful” labeled FTD&#8217;s operations criminal. “Although they [FTD] are not carrying illegal content on their servers, what FTD does is simply criminal,” said Kuik.</p>
<p>Usually at this point a site being bullied by BREIN would either dig in its heels and wait for the lawsuit and injunction against them, or capitulate in fear of being destroyed.</p>
<p>&#8220;We could have waited for preliminary injunction proceedings, which is BREIN&#8217;s weapon of choice,&#8221; Arnoud told us. But that would have taken too much time, and since preliminary injunctions leave little room for a thorough investigation of all relevant facts, the risk was that FTD could be forced to close down for all the wrong reasons. </p>
<p>So FTD did something quite unusual in these cases &#8211; it went on the offensive against BREIN instead.</p>
<p>&#8220;At that stage, we felt that doing nothing would leave the sword of Damocles over our heads,&#8221; Arnoud told TorrentFreak. &#8220;BREIN is very fond of making continuous ominous statements in the press, and that could create a FUD environment for FTD. Therefore we decided to go to court and ask for an official declaration that downloading is legal, that it&#8217;s also legal to inform people about materials to download and to offer a platform to let people inform each other,&#8221; he added.</p>
<p>FTD also wants a public statement from BREIN correcting its assertion that its operations are criminal, and a declaration from the court that FTD&#8217;s operations are fully legal.</p>
<p>&#8220;We fully expect to win our case. BREIN is big on statements but often short on facts and legal arguments to back them up,&#8221; Arnoud told TorrentFreak.</p>

			<content:encoded><![CDATA[<p>Founded in 2000, MediaDefender made a name for itself by polluting file-sharing networks and BitTorrent sites with fake files. Their methods were especially <a href="http://torrentfreak.com/mediadefender-decoy-effectiveness-on-bittorrent-sites-070922/">effective</a> on sites that had little or no moderation and the company&#8217;s success didn&#8217;t go unnoticed.</p>
<p>In mid 2005, MediaDefender founders Randy Saaf and Octavio Herrera were paid $43 million for their anti-piracy company when it was acquired by ARTISTdirect. This seemed to be a good deal, particularly since the big movie studios were paying millions for MediaDefender&#8217;s services &#8211; but that situation didn&#8217;t last.</p>
<p>In August 2007 disaster struck when a database of MediaDefender&#8217;s internal <a href="http://torrentfreak.com/mediadefender-emails-leaked-070915/">emails leaked</a> to the public. Every juicy detail of their anti-piracy campaigns were out in the open, including the tools they used. The hacker said that he initially didn&#8217;t plan to make the info public, but when he found out what MediaDefender were up to he was determined to &#8220;destroy them&#8221; &#8211; and so he did.</p>
<p>The emails were published on the web at <a href="www.MediaDefender-Defenders.com">MediaDefender-Defenders.com</a> but now the site just diverts to The Pirate Bay. Despite the damage control efforts of MediaDefender, however, the emails are still available for download on some BitTorrent sites. This must have helped give the large movie studios the impression that MediaDefender is not the most capable company to entrust with the protection of their blockbuster titles.</p>

<p>A few months after the leak it became known that the data breach was proving exceptionally expensive, with MediaDefender’s parent company losing almost $1,000,000 because of the hack. As a result, their stock price <a href="http://torrentfreak.com/mediadefender-walks-the-plank-to-bankruptcy-080801/">plunged</a> and is now valued at a measly two cents per share and the company&#8217;s activities have noticeably decreased. BitTorrent site administrators told TorrentFreak that MediaDefender are not as active as they used to be. </p>
<p>Many times we have predicted the downfall of MediaDefender but on paper the company is still alive. Its founders are no longer on board though. According to <a href="http://biz.yahoo.com/e/090220/artd.ob8-k.html">a SEC filing</a> last month, MediaDefender has terminated the employment of Randy Saaf and Octavio Herrara.</p>
<p>Why the two left is not clear, but it&#8217;s the end of an era for sure. It wouldn&#8217;t surprise us if the company ceases to exist in the near future. Meanwhile, the two anti-piracy partners were elected to the Board of Directors of Jibro, Inc. a relatively unknown mobile entertainment company where they will continue to work together. </p>

<p>Established in 2000 by director <a href="http://www.imdb.com/name/nm2686952/">Rick L. Winters</a>, Annodam Productions is an independent film company. A forward looking outfit, Annodam will premiere its latest movie &#8216;<a href="http://www.imdb.com/title/tt1326196/">Blank</a>&#8216;, worldwide today.</p>
<p>&#8216;Blank&#8217; is the story of a Johnny, a young boy who witnesses the violent death of his parents and older sister. Roll on some 20 years later and Johnny becomes involved in crime with his adoptive father &#8211; who is also a crime boss. While watching a game of poker Johnny discovers who murdered his family and sets about planning his revenge. Johnny unwittingly becomes involved with a pair of serial killers and the whole movie climaxes with a bizarre and shocking end.</p>
<p>While the plot may seems standard Hollywood fare, the way this movie has been financed and is set to be distributed is not &#8211; Director Rick L.Winters explains, &#8220;The thing that makes this film unique is that it is a co-op based concept where the entire cast and crew worked on a deferred percentage of the film&#8217;s gross.  In other words, the cast and crew own a percentage of the film&#8217;s gross, so the profits are not going to Hollywood executives but instead into the pockets of the filmmakers themselves.&#8221;</p>
<p>After receiving several distribution offers for &#8216;Blank&#8217;, Rick turned them all down.</p>
<p>&#8220;I have seen firsthand the greed that lurks in the Hollywood corporate circles,&#8221; he said while explaining that after he released his first film, the cast and crew couldn&#8217;t understand why a distribution company was making all the money. So instead, Rick decided to let the audience distribute &#8216;Blank&#8217; for him &#8211; via BitTorrent.</p>
<p> &#8220;This time around the fate of the cast and crew getting paid is in the hands of the audience who watch the film.  No Hollywood bank accounts being filled to turn out more crappy remakes,&#8221; he said, while adding that the future of film is &#8220;in the home market, through peer to peer distribution.&#8221;</p>
<p>Today, &#8216;Blank&#8217; is released on DVD for $14.99, via online streaming and of course, for free on BitTorrent. &#8220;No one should have to pay for a film they did not like,&#8221; says Rick. &#8220;No one should be denied the right to enjoy the art of film.&#8221;</p>
<p>The idea is that if people like the movie after they have seen it, they should go to the &#8216;Blank&#8217; <a href="www.blank-movie.com">website</a> and make a donation. People are asked to donate what they feel the movie is worth, and in return will be invited to follow the production of the next movie, which they will have helped finance through their donation.</p>
<p>Rick told TorrentFreak, &#8220;I am excited with the aspects of peer to peer distribution and the possibilities. Giving everyone the opportunity to see my film for free in hope of receiving donations is a little nerve wrecking &#8211; wondering if I will receive enough donations to make my next film. The concept is still scary for independent filmmakers who don&#8217;t have the big budgets like the big studios and most of the time drain their personal accounts and run up credit just to get their film made, in hopes of recouping the cost of making the film.&#8221;</p>
<p>Several large BitTorrent sites including Mininova will be offering &#8216;Blank&#8217;, but undoubtedly it will spread to many others too. Rick L. Winters is also writing a book which will document the whole process so that others can use the same methods to distribute their own movies.</p>
<p>&#8220;I can only hope for the success of this endeavor to show the world that the revolution of peer to peer distribution can no longer be ignored and the time is now,&#8221; Rick told TorrentFreak. &#8220;I decided to try the concept of a coop base film in hopes of encouraging other independent filmmakers to come together and create and share the art of film for EVERYONE to enjoy.&#8221;</p>

			<content:encoded><![CDATA[<p>With the assistance of ALIS (Israel&#8217;s answer to the MPAA), in late 2007 raids were conducted on the homes of the admins of three sites known as &#8216;xvoom&#8217;, &#8216;MYakuza&#8217; and &#8216;<a href="donkey.co.il">Donkey</a>&#8216; which carried Hebrew subtitles for US movies.</p>
<p>ALIS reached private agreements with the admins of &#8216;xvoom&#8217; and &#8216;MYakuza&#8217;, under which the sites would be closed and compensation paid.</p>
<p>&#8220;The feeling is very difficult. A website that I have put 2.5 years of work into was closed&#8221;, said the owner of &#8216;mYakuza&#8217;, who didn&#8217;t hire a legal team. &#8220;Links to illegal films were never available on the website but I preferred not to destroy my life and decided to shut it down completely. They have more lawyers and money. We came out lucky.&#8221;</p>
<p>Effi Teva, the admin of &#8216;Donkey&#8217; wasn&#8217;t included in the settlement and legal procedures against him have begun. </p>
<p>Last Wednesday, the district court in Haifa, Israel, ordered the permanent closure of the movie and TV subtitling sites donkey.co.il and sratim.co.il.</p>
<p>The court decided that the sites infringed copyrights by offering links to unauthorized subtitles and Judge Gideon Ginat ruled that the defendant, Effi Teva, should pay compensation of 160,000 shekels to ALIS and various filmmakers, which includes the lawyers&#8217; fee of 60,000 shekels.</p>
<p>Effi Teva didn&#8217;t give any testimony. The previous hearing in the case took place in 2007, but Teva didn&#8217;t show up then either, instead asking the plaintiff&#8217;s lawyer to request an extension.</p>
<p>Judge Ginat says that Teva requested postponements numerous times. &#8220;I want to make it clear&#8221;, said the judge, &#8220;that I said in the last meeting to those present that I won&#8217;t be able to keep postponing the dates of the hearing.&#8221;</p>
<p>Judge Ginat criticized the behavior of the defendant and his lawyer and said, &#8220;It goes without saying that the defendant and his proxy cannot dictate the hearing date in a last minute phone call.&#8221;</p>
<p>Lawyer Sarah Prazanti, who represents movie anti-piracy outfit ALIS said that the judge refused to accept the request to postponed the hearing, and gave the verdict. Effi Teva did not comment on the matter.</p>
<p>In France this week, Warner has been taking action of its own against subtitling sites. It <a href="http://www.ecrans.fr/Warner-menace-les-sites-francais,6513.html">says</a> that such sites &#8220;make intellectual property available to the public without authorization,&#8221; such as foreign translations of Warner productions. &#8220;This,&#8221; says Warner in threats to various subtitling sites, &#8220;will affect your liability and exposes you to possible civil lawsuits.&#8221;</p>
<p>One site under threat is &#8216;Frigorifix&#8217;, which appears to be taking the threat seriously. &#8220;Never, until now have we had threats from rights holders that are as real and immediate as the ones we received yesterday.&#8221; </p>
<p>&#8220;Our names and addresses are listed with our registrar and web host,&#8221; said a representative of the site, &#8220;and we can not afford to undergo a judicial process.&#8221;</p>
<p>It is believed that members of the site will continue to translate, but no subtitles will be available from the site itself.</p>
<p>Earlier this month we <a href="http://torrentfreak.com/hackers-hit-anti-pirates-to-avenge-sub-site-takedown-090205/">reported</a> on the problems faced by Brazilian sub-site Legendas.tv after anti-piracy action, but it quickly bounced back.</p>

			<content:encoded><![CDATA[<p>The file-sharing media went crazy recently when UK lawyers Davenport Lyons admitted it <a href="http://torrentfreak.com/magazine-forces-lawyers-to-drop-p2p-wireless-defense-case-081029/">wrongly identified</a> married pensioners who, they claim were illegally sharing a video game. The lawyers publicly apologized over the fallibility of their evidence, with highly respected consumer magazine Which? going on record to say that &#8220;hundreds&#8221; of people may have been incorrectly identified and threatened.</p>
<p>The latest development is one that file-sharing commentators have quietly been expecting. While some 40-60% of those threatened over video game sharing in the UK appear to pay up, there are other ways of increasing this amount substantially via social leverage. Unsurprisingly, Davenport Lyons are now going down this road which is likely maximize compliance rates.</p>
<p>According to recipients of fresh letters this weekend, the lawyers have now expanded into movie &#8216;protection&#8217; &#8211; a gay hardcore porn movie to be precise. Set on a farm in the former Czechoslovakia, Gestapo officers apparently hand out &#8216;forced&#8217; punishment in &#8216;<a href="http://www.imdb.com/title/tt1038945/">Army Fuckers</a>&#8216;, a 2006 movie originally released by Dutch porn outfit Dream Logistics BV, on the &#8216;<a href="http://www.eurocreme.com/contact/">Eurocreme</a>&#8216; label.</p>
<p>Strangely, however, Dream Logistics BV aren&#8217;t the rights holder anymore, or the ones that hired Davenport Lyons. It appears the new rights holder is German anti-piracy company DigiProtect, who managed to get this <a href="http://www.digiprotect.org/html/hc_london_300608.html">High Court order</a> for disclosure of alleged file-sharer&#8217;s identities, based on evidence provided by lesser-known anti-piracy tracking company DigiRights Solution, of Darmstadt, Germany. Indeed, DigiRights Solution GmbH appear to have no obvious Internet presence.</p>
<p>Davenport Lyons are demanding £500 compensation, plus the costs from the ISP for disclosing the alleged infringer&#8217;s personal details. Recipients of the letter are given 21 days to pay up and are threatened with huge court costs and damages if they don&#8217;t, which is no different to all the other threats made by Davenport on other media they &#8216;protect&#8217;. It is worth noting that of a claimed 25,000 threats of legal action, no more than half a dozen have gone to court and of those, none were contested, meaning that Davenport Lyons won <a href="http://torrentfreak.com/uk-game-piracy-the-propaganda-the-evidence-and-the-damages-080821/">default judgments</a> on them all. There is no evidence to suggest that anyone has ever contested a case with many people simply <a href="http://torrentfreak.com/bittorrent-users-refuse-to-pay-copyright-fines-080615/">refusing to pay</a> up.</p>
<p>Those accused and deciding to settle are asked to sign an undertaking that they will never infringe copyright on any media owned by DigiProtect in the future, which might be easier than you think &#8211; considering the number of titles they own the rights to. As previously pointed out by <a href="http://www.p2p-blog.com/item-823.html">P2P-Blog</a>, DigiProtect seem to be acquiring the &#8216;P2P Rights&#8217; to many titles (including those of US porn company &#8216;Evil Angel&#8217;) and gathering their money via P2P tracking and subsequent legal threats.</p>
<p>However, most worrying is the <a href="http://www.zahnarzt-dr-mueller.com/Vertrag_Digi/Vertrag.pdf">leaked contract</a> between DigiProtect and Evil Angel, as it contains the following paragraph, which one would believe applies to these UK cases too:</p>
<blockquote><p>To achieve the purpose outlined in clause 1, LICENSOR grants DIGIPROTECT the exclusive right to <strong>make the movies listed in Appendix 1 worldwide available to the public via remote computer networks, so-called peer-2-peer and internet file sharing networks such as e-Donkey, Kazaa, Bitorrent, etc.</strong> for the duration of this agreement</p></blockquote>
<p>This destroys claims that these actions are for strict anti-piracy purposes, this is a clearly a money-making operation, designed from the ground-up.</p>
<p>Since most people will want to avoid lining the pockets of DigiProtect and friends, <a href="http://translate.google.com/translate?hl=en&#038;sl=de&#038;u=http://abmahnwahn.homeip.net/Gesamtliste%2520abgemahnte%2520Werke.pdf&#038;sa=X&#038;oi=translate&#038;resnum=1&#038;ct=result&#038;prev=/search%3Fq%3D%2522digiprotect%2522%2B%2522army%2Bfuckers%2522%26hl%3Den%26sa%3DG">here is a list of titles</a> that include those that appear to be now owned by DigiProtect and ripe for IP harvesting.</p>
<p>Although not DigiProtect titles, the eagle-eyed reader will notice the inclusion on this list of Dream Pinball 3D, Colin McRae Rally and Call of Juarez &#8211; all titles targeted by Davenport Lyons. According to the list, DigiProtect also owns the rights to Atari&#8217;s dire &#8216;Alone in the Dark 5&#8242;. </p>
<p>Of course, we live in a world that has become much more liberal in recent years, so the stigma attached to porn of all flavors has diminished significantly. However, the damage that will be done to a family will be considerable if someone is incorrectly accused of sharing porn that doesn&#8217;t &#8216;fit&#8217; the acceptance levels in that household.</p>
<p>There is a firestorm coming, there can be little doubt, and a simple apology from Davenport Lyons following an incorrect accusation won&#8217;t be enough.</p>

<p>Faced with this nightmare scenario, drastic action is called for, as any delay could exacerbate the already horrendous losses listed above. It&#8217;s time to stop movie piracy in its tracks &#8211; right now &#8211; by letting loose the &#8220;Movie Screening Security Guards&#8221;, armed with the bluntest instruments known to man &#8211; and <a href="http://torrentfreak.com/metal-detectors-and-night-vision-goggles-now-used-to-catch-pirates/">night vision</a> goggles.</p>
<p><img src="http://torrentfreak.com//images/mssg2.jpg" align="left" alt="MSSG Night Vision" />MSSG is a four-man security team, here to serve and protect the integrity of the Hollywood movie industry. They say they&#8217;re here to hunt down strange people &#8211; the type that download stuff from the Internet and anyone carrying large bags &#8220;like a suicide bomber&#8221; into a movie theater.</p>
<p>Their training allows them to see things normal people can&#8217;t, so when they&#8217;re confronted with what appears to be a kid with a cellphone, they do the right thing &#8211; and immediately destroy it, rightly terrifying the child.</p>

A member of the Hexus forums discovered this remarkable promotional material, and <a href="http://forums.hexus.net/general-discussion/128981-john-lewis-using-downloaded-movie-rips-show-off-their-macs.html">writes</a>: </p>
<p>&#8220;So I was in my local John Lewis store a week or so back, and I was checking out their new little Apple mac area, which had lots of Macs on display, with some desks setup and other accessories. They also had some wall mounted iMacs. Imagine my surprise when getting closer to one of them to see &#8216;Pirates of the Caribbean: Dead Man&#8217;s Chest&#8217; &#8211; ripped by Axxo playing.&#8221;</p>

<p>Using a ripped DVD is bit odd because this is certainly not the best promotional material. Regular DVDs or free HD-content looks much better on an iMac monitor. </p>
<p>One thing is clear though, aXXo&#8217;s presence has now moved beyond the Internet, and for him it must be flattering to see that commercial outlets appreciate his work. Perhaps this might motivate him to return?</p>
<p>The last official aXXo torrent was uploaded November 11, after that it has been awfully quiet. There were rumors that he got caught, others said he had an accident. However, the official statement is that he decided to <a href="http://torrentfreak.com/axxo-temporarily-stops-releasing-dvdrips-071128/">take a break</a>.</p>
<p>John Lewis was not available for comment, the MPAA probably wont appreciate it that much, but they have our support.</p>

			<content:encoded><![CDATA[<p><strong>&#8220;WARNING: All songs on this promo CD are voice-over protected to avoid any piracy and illegal file uploading on the internet before the release date&#8221;</strong></p>
<p>This is the message printed on the cover of <em>protected</em> CDs. Most filesharers are probably familiar with the &#8220;for your consideration&#8221; messages displayed in DVDscreeners, but similar messages on CDs are less known. The voice overs do their job, because of their inferior quality none of these albums are uploaded to the Internet. However, they also make it harder for the reviewers to do <em>their</em> job if the music fades out every other minute, and it&#8217;s starting to annoy them. </p>
<p>For example, take the review of Steve Lukather&#8217;s latest album <a href="http://www.komodorock.com/reviews/cd-reviews/steve-lukather-%11-ever-changing-times-200801103308/">on Komodo Rock</a>, which was published earlier this week. Lukather is the guitarist from the well known band Toto, and his new album is set for release on February 22nd. The reviewer rated the album 2.2 out of 10, but not because it was a bad album. On the contrary: &#8220;What I&#8217;ve heard of this album is actually pretty damn good, very emotional, very mood driven, and had the potential to be a truly great album&#8221;, he writes.</p>
<p>So why the negative rating? The reviewer on Komodo Rock explains: &#8220;Well there&#8217;s no chocolate here, but what we have instead is a disembodied voice telling me what I already know, and destroying all the hard work Steve Lukather has put into this album. I&#8217;m all for protecting the rights of artists and labels, but this is not the way to do it, this is not a solution, this is a request to reviewers to ignore what their ears tell them and imagine what this album sounds like.&#8221;</p>
<p>We asked the reviewer about the prevalence of the voice-overs, and he told TorrentFreak: &#8220;The first track on the album is clear of all voice overs, so the first time this appears is at the 1:16 of track 2. It then repeats again at the 3 minute mark, and then one last time at 4:48. This track is 5:53 in length. This then continues throughout the album in this way, apart from track 8 which again is clear of all voice overs.&#8221;</p>
<p>The movie and the music industry are treating their own people as thieves now. Last week <a href="http://torrentfreak.com/oscars-veteran-resigns-over-dvd-screener-piracy-threat-080105/">we reported</a> about a 17 year Oscar screening veteran, who resigned because he had enough of being treated like a criminal. Similarly, the annoying voice-over anti-piracy messages are becoming a thorn in the side of music reviewers. Perhaps the entertainment industry should focus more on adapting to new technologies, and offering consumers some alternatives, instead of protecting their outdated business models.</p>

			<content:encoded><![CDATA[<h4>The Pirate&#8217;s Dilemma: The Problem With Information (and how to fix it)</h4>

<p>The same way light confuses scientists by existing as particles and waves at the same time, information increasingly seems to confuse us. Information is getting <a href="http://www.nytimes.com/2008/01/06/magazine/06wwln-lede-t.html">cheaper and more expensive at the same time</a>, and it appears that many of us, especially those of us who own or control a great deal of it, no longer understand how to observe or use it.</p>
<p>We live in a world where it is legal for a company to <a href="http://www.greenpeace.org/international/news/monsanto-pig-patent-111">patent pigs</a>, or any other living thing except for a full birth human being, but copying a CD you bought onto your hard drive is <a href="http://mashable.com/2007/10/03/riaa-sony-fair-use/">considered</a> an infringement of someone else&#8217;s rights. A place where an average law abiding citizen <a href="http://arstechnica.com/news.ars/post/20071119-overly-broad-copyright-law-has-made-us-a-nation-of-infringers.html?_">could</a> owe more than $12 million dollars in fines if they were sued every time they accidentally violated copyright law in a single day. A society where it&#8217;s ok for each of us to be hit with <a href="http://www.cbsnews.com/stories/2006/09/17/sunday/main2015684.shtml">5,000 advertising messages every 24 hours</a>, usually without our permission, but creating a piece of art and placing it in public yourself without permission can land you in prison. This isn&#8217;t just about the pros and cons of file sharing &#8211; this is about an entire species losing its sense of perspective, failing to understand the potential of one of its most precious (and yet most abundant) resources.</p>
<p>Many of us are confused about whether our ideas should count as information, or property. When we have a new idea, there are two opposing forces at work. At the same time as we are thinking &#8220;how can I get this out there?&#8221; we&#8217;re also asking ourselves &#8220;how can I benefit from/monetize this idea?&#8221; We want to spread ideas as information, but capitalize on them as intellectual property. This problem with information is something I call The Pirate&#8217;s Dilemma.</p>
<p>The first thing we need to understand is that the decision as to how we share &#8220;our&#8221; information isn&#8217;t always &#8220;ours&#8221; to make alone. If a drug company decides it won&#8217;t share malaria and anti-retroviral AIDS drugs with a developing nation for a price the suffering citizens of that country can afford, that country <a href="http://www.asiasociety.org/pressroom/oped_thai_gamble.html">may decide to ignore</a> patent protections and manufacture pirate copies of the drugs anyway in order to save lives. If an industry dependent on physical information, distribution bottlenecks and artificial scarcity decides to ignore more efficient ways of distributing the information it considers its property, pirates will step into the breach and highlight the fact that there is a better way for us to do things.</p>
<p>Some of America&#8217;s greatest innovators were thought of as pirates. When Thomas Edison invented the phonographic record player, musicians branded him a pirate out to steal their work and destroy the live music business, until a system was established so everyone could be paid royalties, which we today call the record industry. Edison, in turn, went on to invent filmmaking, and demanded a licensing fee from those making movies with his technology. This caused a band of filmmaking pirates, including a man named William, to flee New York for the then still wild West, where they thrived, unlicensed, until Edison&#8217;s patents expired. These pirates continue to operate there, albeit legally now, in the town they founded: Hollywood. William&#8217;s last name? Fox.</p>
<p>Piracy is the sharp end of innovation, innovation by any means necessary. Large oligopolies <a href="http://www.stopbigmedia.com/chart.php">control</a> most of our industries and governments. Six companies control most of what we see and hear. According to The World Bank&#8217;s 2007 <a href="http://news.mongabay.com/2007/0220-roundtable.html">figures</a>, roughly two-thirds the world&#8217;s 150 largest economies aren&#8217;t nations, but corporations. We all know the system doesn&#8217;t work quite the way it&#8217;s supposed to, yet continue to think of this inefficient system we have as &#8220;the free market&#8221;. Pirates upend inefficient systems , they take order and create short-term chaos, but often the long-term result of piracy on a large scale is a better system &#8211; a more efficient way of doing things. Pirates created many of our established orders out of chaos, and now that these industries are becoming inefficient in the face of new technologies, chaos is being created once again.</p>
<p>From CEOs to struggling artists, in everything from health care to entertainment to education, many of us are being challenged by the problem of others sharing and using our intellectual property without permission. This challenge requires a change of attitude, because sometimes piracy isn&#8217;t the problem, it&#8217;s the solution. You see, piracy is really a market signal &#8211; an early warning system, a warning that all too often goes ignored by established industries. Whether we consider ourselves pirates or professionals, we&#8217;re all competing in the same space.</p>
<p>When pirates enter our market spaces, we have two choices: We can throw lawsuits at them and hope they go away. Sometimes this is the best thing to do. But what if those pirates are adding value to society in some way? If these pirates are really doing something useful, people support them, and the strong arm of the law won&#8217;t work. The pirates will keep coming back and multiplying no matter how many people are sued. And the truth is, if lawsuits become a core component of your business model, then you no longer have a business model (unless you&#8217;re a lawyer).</p>
<p>Because in these cases, what pirates are actually doing is highlighting a better way for us to do things; they find gaps outside the market , and better ways for society to operate. In these situations the only way to fight piracy is legitimize and legalize new innovations by competing with pirates in the marketplace. Once the new market space is legitimized, more opportunities are created for everyone. This is how cable TV started, it&#8217;s why many drugs are now sold at prices people in the third world can afford, it&#8217;s how many other new opportunities are being created today. Pirates present us with a choice. We can either fight them in the courts, or match them play for play in the marketplace. To compete or not to compete, that is the question; that is <a href="http://thepiratesdilemma.com/">The Pirate&#8217;s Dilemma</a>.</p>

<p>We&#8217;ve carried <a href="http://torrentfreak.com/shining-light-on-the-warez-darknet-a-scene-insider-speaks/">articles</a> in the <a href="http://torrentfreak.com/interview-with-a-warez-scene-releaser/">past</a> about the Scene. So legend goes, these people are ultra-secretive but of course there&#8217;s always a few who like to talk, despite being targeted by law enforcement in cases such as  <a href="http://en.wikipedia.org/wiki/Operation_Fastlink">Operation Fastlink</a> and <a href="http://en.wikipedia.org/wiki/Operation_Buccaneer">Operation Buccaneer</a>.</p>
<p>Last week, an administrator of a <a href="http://en.wikipedia.org/wiki/Topsite_%28warez%29">Topsite</a> (an important guy, near to the top of the so-called &#8216;<a href="http://theminiblog.co.uk/archives/2006/06/03/the-internet-piracy-pyramid/">Piracy Pyramid</a>&#8216;) linked to some very famous <a href="http://en.wikipedia.org/wiki/List_of_warez_groups">release groups</a>, broke cover in a very <a href="http://itavisen.no/sak/496550/M%F8te_med_norsk_topp-pirat/">rare interview</a> with Trond Bie of itavisen.no, seemingly giving away quite a few secrets such as the security techniques used by the Scene and the locations of some of their servers. He also explains why the Scene dislikes torrents and sites like The Pirate Bay, and reveals how some torrent sites manage to get Scene releases so quickly.</p>
<p>In the interview, the Site-Op mocks the efforts of Norwegian police in trying to shutdown the Norwegian Scene, joking that Norwegian law prevents them from being caught in the traditional ways. This attitude could&#8217;ve been the thing that attracted the eye of Espen Tondel, the aggressive MPAA/IFPI lawyer who also talked about <a href="http://torrentfreak.com/oink-down-norwegian-bittorrent-trackers-next-071024/">action</a> against torrent sites recently. RayJoha, a reader of TorrentFreak who did a lot of work on this article, contacted Tondel and asked him a few questions which you can read at the bottom of this article.</p>
<p><strong>The Interview</strong> <em>(translation from Norwegian, courtesy RayJoha)</em></p>
<p>The guy we talked to is one of the few administrators of a Topsite in Norway. He&#8217;s in his mid twenties, is a student of programming and has been a part of the Scene for many years. He first became a Topsite Site-Op in 2003 and has since been responsible for adding users, banning ruleset violators and programming automating IRC-scripts. </p>
<p>In addition to being a Site-Op he also has his own home-based server where he downloads movies, games and TV-shows to and from the Topsites. He has a very fast Internet connection which make it possible to download a DVD movie in minutes.</p>
<p><strong>Everybody keeps everybody informed</strong></p>
<p><em>In addition to categories such as games, software, music and movies we have a news category on the Topsites warning against raids. Lamers are also posted in this news category. It&#8217;s also possible to find out who leaks warez to trackers and the P2P community. Those who leak will be banned from the Scene. It is very easy for the police to find those people who are spreading torrents. </p>
<p>One of the reasons it is quite difficult to break the Scene is due to a very sophisticated security system. The system we use on Topsites and IRC is SSL. This comes on top of Blowfish-aggregation on IRC. You have to log in to one of the Topsites to get the Blowkey password. Without Blowkey everything will be encrypted. The Topsites encrypt everything with SSL.</p>
<p>It&#8217;s not unusual to have 30 TerraBytes of warez on a Topsite. Last summer German police raided a Topsite which had 40 members. The following was posted on Topsites news sections to warn the entire Scene, (from German):</em> </p>
<blockquote><p>New police action in Germany. This morning 40 members got a visit from the BKA, (Bundes Kriminal Amt). All user accounts etc&#8230;. Everybody that has visited the site is in great danger! </p>
<p>I miss you</p></blockquote>
<p><strong>Laws must change?</strong></p>
<p><em>Changing the laws will have no effect. The MP3 legislation&#8230; the only thing they do is make it difficult for ordinary downloaders/torrent users &#8211; those who download from a website, torrentsite, Limewire or with any other P2P software. It would be easier for the government if the police could create their own &#8216;entrapment servers&#8217;, but they could only hurt the Scene, not destroy it.   </em></p>
<p><strong>What&#8217;s the probability of getting caught?</strong></p>
<p><em>HaHa, there&#8217;s almost no chance of getting caught in Norway. The Norwegian police cannot do anything illegal to get somebody. By law, they cannot set up servers to entice users to join. All the users in the network know each other. Members of the Scene have joined only through someone vouching for them. I do it because it&#8217;s a learning experience and fun. I learn a lot about running servers, programming, (C, C ++, Java and scripting). I started with this before I realized I could have a career in programming. When you learn a few programming languages it&#8217;s quite easy to pick up new ones. </em></p>
<p>His interest in file sharing has been there for years, but it took some time before he became a Topsite Site-Op. He reveals that there are lot of Norwegian ISPs, especially those that deliver fiber connections, that have Topsite servers as customers. </p>
<p><em>The first time I became a Site-Op it was 2003. I started setting up servers on my own, but at that time we had no affiliation with the Scene. There are lots of sites on Lyse, Hafslund and Sandefjord and I also know that servers are found around university campuses. </em></p>
<p>The Site-Op tells us that he has no plans of quitting piracy, even when he gets a real job in the software business.</p>
<p><em>It&#8217;s real hard to catch pirates, i&#8217;ve learned. I get to understand how it works, making it possible to protect myself against it. Anything that comes to market is cracked even before we post it. There&#8217;s no point for the industry in spending millions on copy protection.</em></p>
<p><strong>The social side of the Scene</strong></p>
<p>Is there a social environment in the Scene or is it just IRC chatting all the time? </p>
<p><em>Nobody sees anybody. The IRC OPs knows who the others are, but normally we don&#8217;t know who they are in real life. We only use nick names. </em></p>
<p>The Site-Op feels it&#8217;s easy to replace persons that are arrested in raids with some exceptions. Game crackers [people who remove copy protection] can&#8217;t easily be replaced. There&#8217;s just a few people with their skills around.</p>
<p><em>It&#8217;s correct that you can&#8217;t easily replace a cracker, it&#8217;s a real genius game. Sometimes we might lose everyone, but they&#8217;re real hard to catch. Let&#8217;s say they manage to cripple the Game-Scene, but they still have to deal with movies and music, and thats something Mr. anybody can do. [Rip movies and music] </em></p>
<p><em>The FBI are allowed to set up fake servers, but they are not successful in their endeavors. If the Norwegian police are going to catch anyone they have to adopt the same strategy. You can&#8217;t take down Topsites without resorting to illegality: they&#8217;d have to distribute copyrighted material. Actually doing something illegal.</em> note: <em>strictly prohibited in Norway</em></p>
<p><strong>Site-Op&#8217;s responsibilities</strong></p>
<p><em>I don&#8217;t know any informants, but there is a strong possibility there are some. If the Scene discovers this the individual will be banned with the help of Topsite news and barred from access to any resource within the Scene.</em></p>
<p>As a Site-Op he has a series of tasks perform in order for the site to work properly.</p>
<p><em>A Site-Op adds users and makes sure the ruleset are obeyed. He&#8217;s programming and scripting.  Linux servers are almost always running glftpd.</em></p>
<p><strong>Pre-Information</strong></p>
<p>The Site-Op is one of a selected few who has pre-information. Pre-information is information about a specific warez that haven&#8217;t been shared with anyone yet. The different groups, (Razor1911, Fairlight etc), have their own folders on the Topsites with not yet released content. The competition is fierce when it comes to being the first to release a movie or a game. </p>
<p>When a &#8220;ware&#8221; is pre-released a so-called Race starts. A Race means that every Topsite tries to be the first to distribute. In this way the Scene is almost like an economy in itself. First to market doesn&#8217;t mean monetary survival but rather the gain of Respect. </p>
<p><em>There are unbelievably few people that has pre-information. Only Admins can browse all Pre-folders. One shouldn`t sneak a peak on a pre. It&#8217;s a rule not to browse on somebody else&#8217;s folder. </em></p>
<p><strong>The Site-Op&#8217;s connections with the &#8216;Big&#8217; people in the Scene</strong></p>
<p>A Site-Op communicates with the real &#8216;big-wigs&#8217; in the Scene &#8211; the ones that really puzzle the game and movie industries. The largest groups use their own IRC servers to communicate, while the Topsites often use Linknet with SSL.</p>
<p><em>We are in direct contact with Fairlight and the others. We talk to them on IRC. A great proportion of them are Linknet. The largest Topsites have their own servers giving them increased security.</em></p>
<p>Additionally, the Site-Op reveals that many Sceners post internal information on Wikipedia. </p>
<p>The scene harbours ill feelings towards the torrent community. According to the Scene they are stealing their warez and posting it on trackers. The Scene is of the opinion that it&#8217;s real easy to bust people that posts warez on torrent sites like The Pirate Bay. </p>
<p><em>What happens is that people leak from the Scene to torrent sites just before a release. That indicates that these lamers have access to early sites. And if you are the one of those that does this you are categorized as an Insecure user and therefore banned from the Scene. So, to be clear, this is the only connection we have to the torrent scene.</em></p>
<p><strong>Dislike of The Pirate Bay</strong></p>
<p><em>We, as Site-ops, have no fondness for The Pirate Bay. We do not want to talk to the press because it pressures the police to focus on us. As a software programmer I dislike file sharing, because of the small companies that suffers from it. Members of the Scene learn a lot and find it to be a fun experience. The top Sceners buy the music and the movies on DVD anyway.</em></p>
<p><em>As an example I have purchased, ( With money ), FlashFXP to support the developers. This is software I use a lot. If you follow this thinking the best thing to do is to get rid of all the file sharers, mainly because it`s so insecure. The police are able to just walk in and identify the sharers.</em> <strong>END</strong></p>

<p><strong>Q</strong>: Is there anything in this interview that gives you tips on how to get these guys?</p>
<p><em>Let me put it this way &#8211; we have a considerable amount of information about these sites. We know how they work.</em></p>
<p><strong>Q</strong> :Do you think this article [the original interview] will make it easier to bring the Norwegian Scene to justice, considering that he reveals what kind of software and which ISPs they&#8217;re using?</p>
<p><em>From my point of view the Norwegian Scene will be brought to justice, we possess a lot of information.</em></p>
<p><strong>Q</strong>: Norway has always been at the forefront of technology development. Do you think Hollywood should target Norway first?</p>
<p><em>Norway is obviously a good place for tech development and we have necessary legislation hence Norway is a good place for pursuing these kind of activities. We have the full backing of the Motion Picture Association in doing that.</em></p>
<p>Did this guy give away too many secrets or is Tondel simply bluffing? Time will tell.</p>
<p><strong>Update:</strong> Some people are naturally questioning the authenticity of the guy claiming to be a Site-Op. The author of the original article, Trond Bie from Norway&#8217;s <a href="http://www.itavisen.no">ITavisen</a> has just confirmed that he conducted this interview at his home and all the time he was watching the Site-Op doing &#8216;administrative stuff&#8217; on the topsite which he says, couldn&#8217;t be mistaken for anything else.</p>

<p>The MPAA just filed a lawsuit alleging that a resident of Rome made illegal copies of, and also uploaded &#8211; three movies to the internet using an &#8220;online media distribution system&#8221;, probably BitTorrent.</p>
<p>According to the <a href="http://news.mywebpal.com/partners/680/public/news827274.html">report</a>, no address was given for Mr James Wilson &#8211; the man accused by the MPAA of &#8216;willful and intentional&#8217; copyright infringement. According to them, he made unauthorized copies of just three movies &#8211; &#8216;Hide and Seek&#8217;, &#8216;House of Wax&#8217; and &#8216;Robots&#8217; and uploaded them to the internet.</p>
<p>According to the lawsuit, the Plaintiffs (Warner Brothers and Twentieth Century Fox), &#8220;bring this action to stop defendant from copying and distributing to others over the Internet unauthorized copies of the Plaintiff&#8217;s copyright motion pictures&#8221;</p>
<p>Noting that there was no financial motivation to the infringement it continues: &#8220;Defendant&#8217;s infringements allow Defendant and others to unlawfully obtain and distribute for free unauthorized copyright works that the plaintiffs spend millions of dollars to create and/or distribute&#8221;</p>
<p>The MPAA knows a thing or two about drama, it&#8217;s their business after all, so when assessing the trouble Mr Wilson had caused them by sharing 3 movies, they told it straight: &#8220;Defendant&#8217;s conduct is causing, and unless enjoined and restrained by this Court will continue to cause, the Plaintiffs great and irreparable injury that cannot be compensated or measured in money&#8221;</p>
<p>Of course, that doesn&#8217;t stop the MPAA trying to measure the costs: aside from demanding that any copies of the movies are destroyed (3 DVDRs I guess) they want substantial damages and costs for bringing the legal action.</p>
<p>Incidentally, the movie &#8216;House of Wax&#8217; was also listed in the 2005 MPAA <a href="http://www.mpaa.org/press_releases/2005_05_25b.pdf">press release</a><em>(.pdf)</em> proclaiming the demise of EliteTorrents- so when the MPAA talks about &#8216;injury that cannot be compensated or measured in money&#8217; I wonder if they&#8217;re thinking of how the last 6 months have been for <a href="http://www.slyck.com/story1554_EliteTorrents_Interview">Scott McCausland</a>, sitting in prison.</p>

Due to a lack in copyright renewal they all entered the public domain, so now everyone can enjoy them for free. </p>
<p>The collection comprises of seventeen Superman cartoons originally released in movie theaters between 1941-1943. The cartoons are directed by Dave Fleischer himself, co-founder of the famous Fleischer Studios. The series of shorts started with &#8220;<a href="http://www.imdb.com/title/tt0034247/">Superman</a>&#8221; on September 26, 1941, which was nominated for an Academy Award. </p>
<p>This first short is about a mad scientist who threatens to destroy Metropolis and kidnaps Lois Lane. Superman comes to the rescue and triumphs over him. This first episode had a budget of $100,000, which is the highest budget ever for a theatrical short.</p>

<p>In the documentary &#8220;<a href="http://www.donetheimpossible.com/index.php">done the impossible</a>&#8221; the fans tell their part of this success story. They explain why and how they managed to get their <a href="http://www.imdb.com/title/tt0303461/">Firefly heroes</a> on the white screen in the popular movie <a href="http://www.imdb.com/title/tt0379786/">Serenity</a>.</p>
<p>The makers of the documentary offer a free, Creative Commons licensed .torrent download of their film. They state:</p>

			<content:encoded><![CDATA[<p>Two weeks ago the deal between PeerFactor and the uTorrent developer Ludvig Strigeus caused quite some <a href="http://TorrentFreak.com/%c2%b5torrent-developer-signs-deal-with-peerfactor/">controversy</a> in the p2p and BitTorrent scene. This is mainly because PeerFactor is known for their Peer-against-Peer and other anti-piracy work. However, they take another route now. focusing on improving legitimate filesharing techniques.</p>
<blockquote><p>Today p2pnet&#8217;s Alex H did an exclusive Q&#038;A with with uTorrent&#8217;s Ludvig Strigeus:</p></blockquote>
<p><strong>Alex H:</strong> Last time we spoke you guys had just released uTorrent 1.1.4. Now you&#8217;ve just released uTorrent 1.5. How far has uTorrent come with the 1.5 release? What&#8217;s new?</p>
<p><strong>Ludde:</strong> uTorrent 1.5 is a significant release that&#8217;s a big milesone for us. The new major changes in 1.5 are support for Protocol Encryption (i.e. Message stream encryption) and Peer Exchange (a feature that lets peers interchange peers with each other, and reduces the need for a working tracker, it makes BitTorrent more distributed). A lot of work has also been spent on optimizing the downloading speeds, uTorrent should now download much more efficiently than before.</p>
<p>In combination with this, a new algorithm for optimized disk accesses has been implemented. Previous versions would hit the disk much more often, while the new automatic disk cache tries to minimize this.</p>
<p>The time between releases, a whopping 2 months, is the longest time ever in uTorrent&#8217;s history. This shows that 1.5 is really a big change compared to 1.4 (The number of changes is well over a hundred), and we&#8217;ve worked to perfecting it down to the smallest detail.</p>
<p>Other notable things that have been added since 1.1.4 (when you last interviewed us) include:</p>
<blockquote><p>* RSS Reader: Allows uTorrent to automatically fetch releases (such as TV-shows) as soon as they are released. This helps uTorrent to become a better content-on-demand platform, since it will automatically help users download the content they need. A nice RSS tutorial can be found on the webpage for the users that are unsure about how RSS works.</p>
<p>* Unicode support: The same executable can be used both in Unicode mode (windows 2000 or later) or in ANSI compability mode (windows ME or earlier). This is a quite unique feature for native Win32 programs. Unicode is a relatively new universal way of representing characters inside the computer, which means that uTorrent is compatible with foreign torrents (such as those with chinese filenames), while still being able to run properly on old platforms. Support for old platforms like Windows 95 is an important goal for us, not because the user base is there, but it shows that we care about how the application performs for all users.</p>
<p>* Mainline-DHT: This was added in uTorrent 1.2. It means Distributed Hash Table, and is a nice technology that really minimizes the dependency on the tracker. DHT allows uTorrent to receive peers through a distributed network of peers, so the tracker is not needed.</p></blockquote>
<p>We&#8217;ve come a long way since 1.1.4, now uTorrent is really one of the serious contenders in the BitTorrent scene. We concentrate on adding mainstream features that are easy to use, and benefit the majority of the user base, and thus uTorrent is geared towards both normal users and &#8220;expert&#8221; users that know the inns and outs of their computer.</p>
<p><strong>Alex H:</strong> Who makes up the uTorrent team now?</p>
<p><strong>Ludde:</strong> The uTorrent team consists of:</p>
<p>    * Ludvig Strigeus (ludde) &#8211; Sole uTorrent Developer<br />
    * And some of the most notable members of the uTorrent community:<br />
    * Giancarlo MartÃ­nez (Firon) &#8211; Support technician and my right hand.<br />
    * Timothy Su (Ignorantcow) &#8211; Website designer<br />
    * Maciej Trebacz (mav) &#8211; In charge of translations<br />
    * Carsten Niebuhr (Directrix) &#8211; Working on the upcoming webinterface<br />
    * Ludovic Arnaud (Ashe) &#8211; Working with website efficiency/admin frontend</p>
<p>Then there are a bunch of other people hanging around in the IRC channels/Forums helping people and helping me.</p>
<p><strong>Alex H:</strong> uTorrent worked with Azureus to develop the Message Stream Encryption specs. What does it do and how does it do it?</p>
<p><strong>Ludde:</strong> It is basically an encrypted wrapper around the BitTorrent traffic. This makes it a lot harder for Internet Service Providers to block or throttle the BitTorrent traffic, as they can&#8217;t determine as easily if the traffic really is BitTorrent. Blocking is obviously of interest to them, since it has been estimated that at least 30% of all Internet traffic is BitTorrent.</p>
<p>All data packets are encrypted with a key generated at run time, so there is no way for a 3rd party to observe what kind of files that are being transmitted by just analysing the packet stream. However, characteristics of the BitTorrent protocol, such as packet sizes, or the fact that a client connects to a large number of peers, can still be used to infer that BitTorrent activity is going on, so the encryption is not a universal solution.</p>
<p><strong>Alex H:</strong> Can the PHE specifications work with other protocols, or is it a BitTorrent-only thing?</p>
<p><strong>Ludde:</strong> It was designed to be as general as possible, and to not be dependent on BitTorrent, so it can (in theory) be used to encrypt other protocols. Just like SSL can be used to encrypt other things than HTTP.</p>
<p><strong>Alex H:</strong> What was it like collaborating with rival developers? Was it just &#8220;Team uTorrent&#8221; and &#8220;Team Azureus&#8221;, or were there other individuals involved too?</p>
<p><strong>Ludde:</strong> We are not really &#8220;rival developers&#8221; even though we work on &#8220;competing&#8221; clients. I have a healthy relationship with the Azureus team and we&#8217;re cooperating openly. My goal is not to destroy Azureus. I want to provide a lightweight alternative to Azureus for the people that believe that Azureus&#8217;s requirements in terms of CPU/Memory are too high.</p>
<p><strong>Alex H:</strong> Last week Slyck.com published a story that revealed a deal between a company called PeerFactor and Ludvig Strigeus, uTorrent&#8217;s developer. How does uTorrent fit into this? Is Ludde working for the &#8220;dark side&#8221;? Have you sold out as some people are claiming?</p>
<p><strong>Ludde:</strong> I can&#8217;t believe how much this deal has been blown up. The whole hysteria started with the Slyck.com article saying that uTorrent is cooperating with RetSpan and working with Anti-P2P organizations. Later the article was updated because that statement was factually incorrect. Yet I believe a large number of users still have doubts about uTorrent&#8217;s legitimacy.</p>
<p>The deal as such is not even about uTorrent. I will provide the company (PeerFactor, a startup company started in late 2005), with a small DLL-file that can be used for one thing only &#8211; Downloading files from BitTorrent network. The deal is not between uTorrent and PeerFactor, and it does not affect uTorrent. I&#8217;m just using some of my expertise to help them develop an application that webmasters can use to publish big content on their websites. I don&#8217;t even give out any source code.</p>
<p>I can&#8217;t show you our agreement, but uTorrent is not even mentioned in our deal. There are no mentions of any Anti-P2P ideas, and PeerFactor owns NO rights to the BitTorrent code. The deal is just between me (Ludvig Strigeus) as a developer and PeerFactor. It&#8217;s not related to uTorrent at all. The license has no malicious intent towards P2P users, and it does not affect uTorrent in any way. The contract explicitly states that they can only use it for the designated purpose, and not for anything else such as monitoring P2P users.</p>
<p><strong>Alex H:</strong> Who was at the meeting with PeerFactor?</p>
<p><strong>Ludde:</strong> I have not even met anyone in person, I havn&#8217;t even talked to them on the phone! All our communication has been on e-mails and IRC. This is not a big contract. It&#8217;s just a small side project to try to get some payment for the effort involved in writing a BitTorrent protocol stack.</p>
<p><strong>Alex H:</strong> What does this .dll file do exactly?</p>
<p><strong>Ludde:</strong> The DLL file component that I have exports a few basic functionalities such as</p>
<p>* Start downloading a torrent<br />
* Stop it<br />
* Pause<br />
* Remove it<br />
* Determine how many % was downloaded.</p>
<p>It contains no functionality whatsoever for retreiving IP-addresses of peers.</p>
<p>The DLL file wasn&#8217;t written specifically for PeerFactor. It&#8217;s a generic download DLL with a small size/footprint that I have developed as a separate project. I just made some minor adjustments so it would meet PeerFactor&#8217;s requirements.</p>
<p><strong>Alex H:</strong> Do you know, or can you speculate on what PeerFactor plans to do with the .dll?</p>
<p><strong>Ludde:</strong> The goal is to use unused bandwidth of Internet users to distribute big files, like trial games, free trial music and trailers. It is not related to fake files.</p>
<p><strong>Alex H:</strong> How is the deal structured? Is it a straight sale or a lease? Is there some kind of royalty payment to Ludde?</p>
<p><strong>Ludde:</strong> It&#8217;s a 6-month lease. PeerFactor will evaluate if the DLL fits with their requirements. No source is involved, and all ownership to the code belongs to me. I have not been paid anything, but if the service turns out to work, I will get some form of payment. I don&#8217;t have an employment contract with PeerFactor. I do not work for them, and they do not have control over any decisions I make related to uTorrent.</p>
<p><strong>Alex H:</strong> PeerFactor has ties to French anti-P2P company RetSpan. Is there still a relationship there?</p>
<p><strong>Ludde:</strong> No, the person I&#8217;ve been in contact with has assured me that there is no relationship at all between PeerFactor and RetSpan. I trust him, and if it turns out that there is a connection, I will not work with them.</p>
<p><strong>Alex H:</strong> The uTorrent website was put on a block list a few days ago. How did it happen? Is there anything on the uTorrent website that is a security risk for users?</p>
<p><strong>Ludde:</strong> These blocklists are created by a bunch of over-paranoid people (Bluetack). The software PeerGuardian has temporarily handed over list creation to Bluetack, and Bluetack prefers to be better safe than sorry. Their decision was based on incorrect facts, and it will take some time before the block gets removed.</p>
<p><strong>Alex H:</strong> There is a certain level of mistrust directed at closed source applications like uTorrent. Why is the uTorrent source code not available? Will uTorrent ever be open source?</p>
<p><strong>Ludde:</strong> There are no plans to make uTorrent open source. If uTorrent becomes open source, it will result in hacked clients, or companies modifying the code and creating malware clients. If uTorrent is closed source, I can make sure that the quality of uTorrent stays high and that it doesn&#8217;t become a bloated client. Further, it makes sure that the source code is not used by dubious companies or for dubious purposes.</p>
<p><strong>Alex H:</strong> Is there anything in the uTorrent source code that would be considered a security risk to users, such as a &#8220;phone home&#8221; component or something that builds up a profile of the user?</p>
<p><strong>Ludde:</strong> Not at all, uTorrent has an optional feature (enabled by default) that sends a unique random ID number when checking for new updates. This is used solely for the purpose of computing how many users that are actively using uTorrent. Azureus does the same thing, so it&#8217;s nothing special really. A lot of internet-enabled programs do this without even telling the user. With uTorrent you have the option to turn it off if it&#8217;s of concern to you.</p>
<p><strong>Alex H:</strong> uTorrent is free, but donations are accepted. What other kinds of work have you done to make ends meet? Is there anyone you would refuse to work for?</p>
<p><strong>Ludde:</strong> Working with an Anti-P2P company is certainly not a good idea, considering my interests in making the best BitTorrent client. I would not do that. Apart from that, I don&#8217;t know. I will have to evaluate any possible offers and see if they match with what I think is fair and makes sense.</p>
<p><strong>Alex H:</strong> I asked a similar question to this in our previous interview: How do you see BitTorrent developing over say, the next three years?</p>
<p><strong>Ludde:</strong> This is a very hard question to answer. I definitely believe P2P is here to stay. I think ISPs will get a bigger role and start developing solutions to help P2P instead of working against it, for example cache mechanisms. I like the new law in France that legalizes P2P, and I hope that more countries will follow.</p>
<p>I think we&#8217;ll start seeing BitTorrent more in embedded devices, such as set-top boxes. More services will be developed around BitTorrent to distribute legal content, and subscription based services such as high quality movies-on-demand instead of renting DVDs in the rental store.</p>
<p><strong>Alex H:</strong> Thanks for your time, and good luck for the future.</p>

<blockquote><p>Going to the movies is not what it used to be. Security at the studio-owned theatres is heavy, it&#8217;s not a trip to be taken lightly. But if you want to see the film everyone is talking about without waiting a year for the home release, you have little choice. When you enter the lobby the first thing you see are long ranks of tiny, thumbprint activated lockers. This is where you must leave all of your electronics, your personal server and peripherals, even your watch, and you had better not be wearing smart spectacles or contacts. As you enter the security zone you&#8217;re scanned for anything you may have forgotten. Cochlea and optical implants must be capable of responding with a coded RF identification signal to indicate their systems are secure and cannot record. People with older models, or models implanted abroad where such interrogation is illegal, are turned away. Perhaps they would like to see one of the older releases? Once through the scanner you must submit to a biometric ID test &#8211; this is where the known bloggers, hackers and spoilers are ejected. Finally there is the non-disclosure agreement to be signed &#8211; these days most moviegoers choose to sign via the MPAAs annual subscription, just trying to take some of the hassle out of visiting the cinema. Finally you get to see the film. In the auditorium the audience is constantly scanned by an AI looking for suspicious activity, so don&#8217;t rummage in your pockets for too long. It&#8217;s strange that all this effort to protect the movie industry has done so little to improve the movies.</p>
<p>You don&#8217;t really own your home computer, or even the data you keep on it. Oh, you paid for it, just like you paid for the fibre-optic Internet connection that it can&#8217;t function without, but now it squats under your TV using your electricity and does more work for the content industry than for you. The nightly security patches it downloads for itself don&#8217;t secure your computer against attackers, they secure the system and software against you. TV-on-demand seemed like a dream come true when you first opted in and upgraded all your hardware, but the slowly encroaching charges are becoming a disincentive to turn on at all. Sometimes the last episode of a series makes up 50% of the cost of the whole season.</p>
<p>The Internet is not what it used to be. It&#8217;s expanded, naturally, the technology giving everyone mobile PCs with vast ad-hoc networking capabilities, it&#8217;s faster, more efficient, and more available, but it&#8217;s also more restrictive. Since the ISPs were made responsible for the content they deliver their filtering has become neurotic. Anti-terror, piracy, plagiarism and libel filters search every request and response for signs of illegal activity, always erring on the side of caution. Wikipedia&#8217;s index has been decimated. Popular blogs like Boing Boing now have more lawyers involved than contributors (the one&#8217;s that have survived that is). Even if you managed to get something illegal through the filters your operating system&#8217;s regularly updated self-check mechanisms would eventually root it out, or report you to the authorities, usually both.</p>
<p>These days it seems like every time you turn on one of your gadgets you have to fight with its DRM to get it to do what you want. The home movie of your daughter opening her birthday presents is ruined by a patch of grey fog that shifts with every movement of the camera, tracking sluggishly to keep the TV screen in the background obscured. From the codes embedded in TV&#8217;s update pattern your camera had decided the show was not licensed for this form of reproduction and blocked it. You wish you had thought to turn it off at the time, but squinting into the camera&#8217;s tiny screen it hadn&#8217;t looked so bad.</p>
<p>Even once recorded, your own media is not safe. Everything is stored on your home PC, trapped in the solid-state drive&#8217;s proprietary filing system. Once there, the only reasonable way to transfer it is to another trusted drive from the same vendor &#8211; the DRM won&#8217;t recognise any other brand of mass storage device. In the meantime the PC constantly searches your files looking for illegal material. A recent security patch has destroyed the last video of your father. According to the email report you received that same morning the latest video and photographic scanning protocols had decided something seen in the footage resembled a new government building, the appearance of which is now classified. You know for sure that there is no such building in the footage, it was all filmed in the old man&#8217;s living room. But there&#8217;s no way for you to prove that with the offending shots turned to grey fog.</p>
<p>You just don&#8217;t see physical media anymore. Too easily duplicated, their security too easily cracked, they&#8217;ve been dropped in favour of heavily encrypted and vendor-locked streaming media. You don&#8217;t &#8216;own&#8217; copies of any music or movies these days, instead your monthly subscriptions grant you only the right to temporarily buffer a few seconds of the distributor&#8217;s authorised files while you watch or listen. Ultimately, that was the reason ad-hoc networking protocols and mobile PC technologies were pushed so hard, not because the customers wanted them but because the music and movie industries needed them to replace the vulnerable duplication method normally needed for such mobile media.</p></blockquote>
