On the one hand there are the <a href="http://torrentfreak.com/?s=lily+allen">Lily Allens</a> who believe that tough anti-piracy legislation will increase their profits, while others including <a href="http://torrentfreak.com/raiohead-to-testify-against-the-riaa-090404/">Radiohead</a> and <a href="http://torrentfreak.com/moby-the-riaa-needs-to-be-disbanded-090620/">Moby</a> think that the RIAA and other lobbyists should stay away from their fans.</p>
<p>The latter group has not been very successful in convincing the big labels to change their anti-piracy strategies, but when MC Hammer says STOP they will have to listen.</p>
<p>In a <a href="http://www.theage.com.au/business/mc-hammer-rapt-over-future-of-digital-media-20091116-iid7.html">recent interview</a> Hammer commented on the industry&#8217;s struggle with piracy and the future of music in the digital age. In Hammer&#8217;s view, the RIAA&#8217;s legal battles against file-sharers have only alienated buying customers. &#8221;The approach that the music industry took to fight piracy was the wrong strategy,&#8221; he said.</p>
<p>Aside from going after individuals, the entertainment industries have also targeted ISPs, for enabling their customers to pirate. The most prominent case at the moment is that of <a href="http://torrentfreak.com/afact-v-iinet-safe-harbor-protection-intact-says-iinet-091113/">AFACT against iiNet</a>, where the anti-piracy group wants the Aussie ISP to disconnect repeat infringers.</p>
<p>Using a murder and gun analogy to appeal to his fellow rappers, Hammer argues that AFACT is going after the wrong party by targeting the ISP.</p>
<p>&#8221;When there is a murder done with the gun, do they go back to the guy who sold the gun at the store and arrest him? No they don&#8217;t. They arrest the person who did it. So in this particular case, somebody is stealing content using the freeway. You can&#8217;t go back and sue the construction men,&#8221; Hammer said.</p>
<p>In addition to calling for a stop to the legal battles, Hammer thinks the music labels should focus more on digital content instead of trying to sell plastic to a generation of people that have never even owned a standalone CD player.</p>
<p>&#8216;Digital files are no doubt not just the future, but the present. I think that it&#8217;s [the CD format] on its last legs, it&#8217;s on an artificial respirator,&#8221; Hammer commented.</p>
<p>&#8220;I don&#8217;t know what would turn them on about having to go through that terrible exercise of trying to open the packaging &#8211; it&#8217;s unbelievable when you&#8217;re trying to open a CD, right? You need a box cutter … it&#8217;s a tough deal to get it open. And once you get it open … you go and upload it to your computer,&#8221; Hammer added.</p>
<p>Hammer has a fair point there. Digital sales are breaking records year after year in terms of revenue generated, while the decline in physical CD sales is more likely to be a sign of the times rather than a side-effect of music piracy. </p>

			<content:encoded><![CDATA[<p>Back in September 2008 <a href="http://torrentfreak.com/linking-to-p2p-downloads-confirmed-legal-in-spain-080919/">we reported</a> on the case of Sharemula, a site which offered eDonkey links to movies, music, software and games. Like many file-sharing sites, Sharemula found itself the subject of legal action but eventually the Provincial Court of Madrid ruled that the entertainment industry had no case against the site since it has broken no laws. The court ruled that neither the site nor administrators had operated illegally by offering links to copyright works, since they had not done so for profit or commercial gain.</p>
<p>Yesterday, Spanish Criminal Court No.1 made its <a href="http://latecnopolis.com/2009/04/un-juez-condena-a-prision-a-un-joven-por-lucrarse-con-una-web-de-descargas/">decision</a> in the case of file-sharing site <a href="http://www.infopsp.com">infopsp.com</a>. According to the complainants &#8211; Spanish Association of Publishers and Distributors Entertainment Software (<a href="http://www.adese.es/web/main.asp">ADESE</a>) and the Spanish Videographic Union (<a href="http://www.uve.es/">UVE</a>) &#8211; the site, which had around 17,300 members, operated illegally.</p>
<p>The site didn&#8217;t host any illicit content itself but instead offered links to video games, movies and music hosted on 3rd party sites. Under Spanish law, so far so good. However, in order to stay legal in Spain, the site needed to demonstrate it was not profiting from copyright infringement &#8211; this is where it all fell apart.</p>
<p>The court heard that the site carried advertising from Impresiones Web, Google Adsense, Canalmail and Correodirect and also gained revenue via premium SMS. According to the court, this turned the site from a legal entity into one profiting from copyright infringement &#8211; a criminal offense. </p>
<p>The judge handed 22 year-old site administrator Adrián Gómez Llorente a total fine of 4,900 euros ($6,500) which includes compensation for the complainants. Llorente was also sentenced to 6 months jail but it&#8217;s unlikely he will serve this since he doesn&#8217;t have an existing criminal record. It is believed that this is the first conviction of its type in Spain. Neither party intend to appeal.</p>
<p>ADESE President Alberto Gonzalez Lorca said of the decision, &#8220;This ruling is a very important precedent for the videogame industry which is at the forefront of creating jobs and wealth even in a financial crisis, but is helpless against a problem as serious as piracy.&#8221;</p>
<p>The big question now is how a court would view donations given to torrent sites. We&#8217;ve already seen the police in the UK call voluntary donations &#8220;subscriptions&#8221; in the OiNK case. Time will tell how a Spanish court will view them.</p>

			<content:encoded><![CDATA[<p><img src="http://torrentfreak.com//images/law.gif" align="right" alt="TodoTorrente" />In July 2007 we <a href="http://torrentfreak.com/bittorrent-sites-shut-down-admins-arrested/">reported</a> on the case of TodoTorrente.com, one of Spain&#8217;s largest BitTorrent sites. After a year long investigation by Spain&#8217;s Anti-Piracy Federation, an announcement was made by the Directorate of Police and Civil Guard &#8211; the site had been raided and closed by judicial order while the administrators arrested.</p>
<p>According to Spanish police, the site caused the entertainment industries 535,000 euros in losses and made 30,000 euros in profits. Unfortunately the authorities didn&#8217;t have the benefit of foresight, which would&#8217;ve given them an understanding of how Spanish law would deal with a site that links to copyright infringing material.</p>
<p>In September 2008, a Spanish court <a href="http://torrentfreak.com/linking-to-p2p-downloads-confirmed-legal-in-spain-080919/">ruled</a> that providing links to copyrighted material is not a crime. The Provincial Court of Madrid ruled that Sharemula.com, a site offering eDonkey links to movies, music, software and games, did not break the law. Furthermore, the court’s decision was final and could not be appealed.</p>
<p>If the ruling in the Sharemula case holds up, this means that TodoTorrente was not breaking the law either. Lawyer David Bravo who was involved in the TodoTorrente case, has contacted TorrentFreak with an <a href="http://www.filmica.com/david_bravo/archivos/008586.html">update</a> on the TodoTorrente situation. David notes that the coverage of the TodoTorrente raids and arrests had a great impact in the Spanish media, and further afield.</p>
<p>Of particular interest was a gloating editorial which <a href="http://www.portalatino.com/especiales/boletines/editorial/editorial15.htm">published</a> in Portal Latino, which claimed that TodoTorrente wasn&#8217;t &#8220;kids playing on a network&#8221; but an &#8220;illegal business&#8221;, and celebrated the closure. David explains that the media uproar this caused left little room for the arrested admins to be considered innocent until proven guilty.</p>
<p>However, after an application was made to Magistrate&#8217;s Court No.3 in Orihuela, it has now issued an interim order of dismissal of the case against TodoTorrente. The court decided that the site or admins didn&#8217;t commit any crime &#8220;since the investigation showed that the website was limited to providing links to downloads and didn&#8217;t offer downloads directly.&#8221; </p>
<p>Essentially, the court has decided that TodoTorrente operated in a similar manner to Sharemula. The decision is open to appeal, but there is no doubt that BitTorrent sites are getting closer to legality in Spain.</p>

			<content:encoded><![CDATA[<p><img src="http://torrentfreak.com/images/sharemula.jpg" align="right" alt="Sharemula" />Following a Federación Antipiratería (Anti-piracy Federation) investigation in 2006, 15 people were arrested in Spain in connection with the operation of <a href="http://www.sharemula.com">Sharemula.com</a>, an eDonkey (eD2k) indexing site. eD2k links are similar to URLs or .torrent files, in that they contain no copyright material themselves, but may point to such works.</p>
<p>Spain&#8217;s Brigade of Technological Investigations claimed that the site was illegal and should be closed. Just under a year ago the case was heard, but sadly for the entertainment industry, the court ruled that the case against Sharemula should be dismissed. It said that neither the site nor administrators had operated illegally by offering links to copyright works, since they had not done so for profit or commercial gain. </p>
<p>However, the entertainment industry &#8211; including but not limited to Columbia, Disney Company Iberia, Twentieth Century Fox, Warner, Universal, Paramount, Sony and MGM, did not accept the ruling and appealed the decision.</p>
<p>Yesterday, the Provincial Court of Madrid ruled that the entertainment industry has no case against Sharemula, and since it has broken no laws, the case should be dismissed. This dismissal is final and cannot be appealed.</p>
<p>The court rejected all allegations that were made by the entertainment industry and concluded that indexing eD2k links (or torrent files) can not be seen as copyright infringement (<a href="http://derecho-internet.org/proyectos/procedimientos-libres/browser/defensa-webs-enlaces/resoluciones/formato-pdf">pdf in Spanish</a>). Sharemula&#8217;s main purpose is to index links, and they are not responsible for where these links go according to the court decision. Whether or not Sharemula makes profit is irrelevant.</p>
<p>“The hearing confirms the position of the defense that linking to P2P networks does not constitute a criminal offense,” <a href="http://www.filmica.com/david_bravo/">wrote</a> David Bravo, a lawyer in the case, noting that Sharemula did not store any copyrighted material. The site simply links to files that are hosted elsewhere, on computers of P2P users.</p>
<p>It is on this same premise that The Pirate Bay claims to operate legally. With upcoming cases against <a href="http://torrentfreak.com/trial-against-the-pirate-bay-delayed-080828/">The Pirate Bay</a> and <a href="http://torrentfreak.com/mininova-faces-legal-action-filter-or-else-080519/">Mininova</a> in Europe, this decision is very welcome for p2p-site administrators.</p>

			<content:encoded><![CDATA[<p><img src="http://torrentfreak.com/images/swedish-left.jpg" align="right"  alt="swedish left party" />At the party&#8217;s congress this weekend, party members had to vote on <a href="http://www2.vansterpartiet.se/kongress2008/prop/show/motion.asp?PID=5661">a motion</a> that would legalize the uploading and downloading of copyrighted material for personal use, as long as it is not for commercial purposes. </p>
<p>&#8220;To many of us in the Left Party, file sharing is something positive in the same obvious way that public libraries are,&#8221; the motion read, going on to describe the general opinion on file sharing in Sweden. </p>
<p>In addition, the motion stated that the various measures taken for trying to stop file sharing, such as big brother-like surveillance, or arbitrary sentences against individuals, are unacceptable. </p>
<p>The Pirate Bay, the main reason why piracy is such a hot topic in Sweden, was also mentioned in the motion. &#8220;The farce that is the ongoing legal procedures against The Pirate Bay also shows how legal security is in risk of being compromised by those trying to enforce the current ban on file sharing,&#8221; it read. </p>
<p>The motion concluded that legalizing piracy is the solution, and that the Left Party should take a stand for opening the possibilities to make copies for personal use.  </p>
<p>The congress was split on the issue, and debate was heated before the vote on Sunday, but when the vote was taken it fell in favour of the motion legalizing file sharing.  </p>
<p>&#8220;We obviously want to be the cultural workers&#8217; party in the future, but legislation which makes the majority of the adult population criminals must be changed,&#8221; Elise Norberg Pilhem of the party&#8217;s board said.  </p>
<p>Today, only a few hours after The Left Party&#8217;s new stance on file sharing, another initiative in the same direction was presented from across the aisle. The Swedish Center Party &#8211; the third largest party in Sweden, currently in government with four cabinet ministers, has called for an improvement in current copyright legislation.</p>
<p>Earlier this year the party had no success in convincing their colleagues in the government coalition to legalize non-commercial file sharing. Today, <a href="http://www.svd.se/kulturnoje/nyheter/artikel_1340551.svd">the party demands</a> a complete oversight of the copyright legislation, and the appointment of a commission to investigate how a new copyright law could be constructed.</p>
<p>We now see a younger generation questioning copyright more and more, and with that there will be demands for updated copyright legislation. We need a legislation that is accepted by as many as possible, says Annie Johansson, the Center Party&#8217;s spokesperson on copyright.</p>
<p>It looks like things are changing for the better in Sweden.</p>

			<content:encoded><![CDATA[<p><img src="http://torrentfreak.com//images/headweb.png" align="right" alt="headweb bittorrent" />At the moment Swedish customers will have to use the official <a href="http://www.headweb.com/">Headweb</a> download manager in order to download files, but support for regular BitTorrent clients might be added later. </p>
<p>The downloaded movies can be played with any media player, and are free of DRM. On top of that, the download manager comes with a built in DVD-burner so you can burn the movies onto a disk and play them with any standalone DVD-player.</p>
<p>One of the interesting things about the service is that it rewards people who share their purchases. That is, people get credits for sharing the downloaded files with other Headweb users.</p>
<p>Peter Alvarsson of Headweb told TorrentFreak: &#8220;We believe it&#8217;s fair to pay for our users&#8217; time and resources and we give credits back to those that upload to other users. The ratio is 1 credit per 10mb which makes it possible to get a free movie after some 50 GB upload. </p>
<p>&#8220;We&#8217;ve seen that some users are really good at predicting &#8220;hot&#8221; movies and earn a lot of credits by keeping their clients running after the download has finished,&#8221; Peter added. A win-win situation really, the sharing mechanism saves Headweb bandwidth and server resources, and the users get free downloads.</p>
<p>All movies offered by Headweb are DRM-free, which is great, and quite unique for a movie download service. Not surprisingly, they had a hard time convincing the movie studios to offer their content without access restrictions.</p>
<p>&#8220;It has taken us nearly 2 years to convince movie studios that DRM-free downloads are the future,&#8221; says Peter &#8220;We&#8217;re not there yet with everyone but we are getting closer. More studios now start to realize that DRM isn&#8217;t consumer friendly and that it has to go.&#8221; </p>
<p>Several surveys have shown that a lot of people are willing to pay to download movies as long a there is enough content available, and if the files are high quality and thus DRM-free. </p>
<p>Headweb&#8217;s users seem to confirm these findings. &#8220;We&#8217;ve received lot of feedback from people telling us that they would switch to support legal services completely, if only the services had the same selection,&#8221; Peter told TorrentFreak.</p>
<p>In the near future, Headweb will be working on more new features, groundbreaking innovations and more content. em toThey are confident that this will enable them to compete with The Pirate Bay.</p>

			<content:encoded><![CDATA[<p>Last week we reported on <a href="http://torrentfreak.com/music-industry-gets-an-injunction-against-rapidshare-080120/">rumors</a> that Rapidshare had, or was about to be, shut down, rumors that now look likely to resurface. The company, one of the world&#8217;s largest &#8216;one-click&#8217; file hosting services, has lost a copyright infringement case against German performing rights outfit, GEMA. Representing a claimed 60,000 members and more than 1 million rights owners worldwide, GEMA has taken an aggressive stance in pursuing legal action against Rapidshare, trying to force it to be accountable for the infringing actions of its users.</p>
<p>For its part, Rapidshare has always insisted that it cannot be held responsible for these actions, such as when users upload copyright works (in this case, music) to their servers for subsequent downloading by others.</p>
<p>On 23 January 2008, the district court in DÃ¼sseldorf (Landgericht) disagreed with this assertion after GEMA succeeded in convincing the court that Rapidshare should take responsibility for infringements carried out within its service.</p>
<p>GEMA are trying to imply that as a result of the decision, Rapidshare will be forced to take preventative action to stop GEMA works from even getting onto their servers, rather than a DMCA-style after-the-fact removal. GEMA says that if Rapidshare are forced to filter they will likely end up with a service that&#8217;s not worth operating, so they may decide to shut it down completely.</p>
<p>The <a href="http://www.gema.de/presse/pressemitteilungen/pressemitteilung/?tx_ttnews%5Btt_news%5D=688&#038;tx_ttnews%5BbackPid%5D=73&#038;cHash=2c827de5c9">GEMA</a> press release has been published before the complete court decision, so it should be digested with at least a degree of scepticism, considering the huge amounts of spin employed by anti-piracy agencies and the music industries alike.</p>
<p>In a statement, Dr. Harald Heker, Chairman of the board at GEMA said: &#8220;This decision is a milestone in the fight against the illegal use of our repertoire&#8221;, which was almost a carbon-copy of a <a href="http://www.ghacks.net/2007/03/28/rapidshare-vs-gema/">statement</a> he made about the decision from a previous court case against Rapidshare. He went on to explain that measures have to be put in place for the protection of rights holders and claiming that file-hosts are not responsible for what their users do, is no longer an option. &#8220;With this decision of general principle,&#8221; he said, &#8220;the course of future action against comparable services has been smoothed.&#8221;</p>
<p>In their press release, GEMA speaks about the decision of the District Court of DÃ¼sseldorf but also mentions a decision from the District Court of Cologne.</p>
<p>TorrentFreak spoke to Christian <a href="www.wb-law.de">Solmecke</a> a lawyer at the Cologne Chambers of Lawyers Wilde &#038; Beuger, to see what is likely to have happened in these cases.</p>
<p>He told us: &#8220;The normal way is as follows: GEMA files a lawsuit against Rapidshare because of alleged copyright infringement on three or four songs. If GEMA wins, Rapidshare is then obliged not to host these particular songs.&#8221;</p>
<p>Lots of anti-piracy and industry bodies state that it&#8217;s possible for file-hosting services and even ISPs to monitor, police and filter copyright works from their servers and networks. This case is no different, except this time it&#8217;s the court that has demanded this type of action.</p>
<p>Christian explains: &#8220;From a legal point of view, it is interesting that the District Court of DÃ¼sseldorf decided that Rapidshare has to carry out a lot of preventive actions (if the GEMA press release is correct on this point, of course). This could mean that Rapidshare has to check all of its hosted material for copyright infringements &#8211; which is nearly impossible.&#8221;</p>
<p>The instruction for Rapidshare to take preventative action is new, and despite another similar court case reaching a different decision. Christian explains: &#8220;Only 30 kilometers away from DÃ¼sseldorf, we&#8217;ve already had a similar law suit in Cologne. In that case the Oberlandesgericht (Higher Regional Court and Court of Appeal) <a href="http://www.urheberrecht.org/news/3157/">decided</a> that Rapidshare is only obliged to delete specific songs stated by GEMA. They were not obliged to take preventative action.&#8221;</p>
<p>&#8220;The future will tell us which interpretation of the law is correct.&#8221; Christian told us. &#8220;Perhaps in one or two years we will get a decision on this question from the Federal Court of Justice.&#8221;</p>
<p>As the world struggles to update its laws to cope with the digital revolution, the courts &#8211; and lawyers &#8211; are being kept very busy indeed. So back to the original question: Is Rapidshare going to be closed down &#8211; or be left with no alternative but to shut itself down?</p>
<p>Well &#8211; maybe&#8230;&#8230;maybe not. </p>
<p>Christian finishes up: &#8220;I believe that Rapidshare will appeal against the decision of the Landgericht (District Court) of DÃ¼sseldorf. If they do so, we will have to wait and see what the Oberlandesgericht (Higher District Court) of DÃ¼sseldorf (as the Court of Appeal) says.&#8221;</p>
<p>In the meantime, while the legal wheels turn and turn, Rapidshare.com and Rapidshare.de continue to operate as usual.</p>

			<content:encoded><![CDATA[<p><img src="http://torrentfreak.com//images/shareaza_2_logo.png" align="right" alt="Shareaza" />The announcement on the <a href="http://sourceforge.net/projects/shareaza/">SourceForge</a> page of the Shareaza client was ominous:</p>
<p>&#8220;As of December 20th, &#8220;Shareaza.com&#8221; is mirroring &#8220;Shareazaweb.com&#8221; &#8211; A known scam site. While we are working to resolve the matter, any help to contain this would be appreciated.&#8221;</p>
<p>The site looks convincing enough, labelled as it is &#8220;The Official Home of Shareaza&#8221; with the new operators of the site having seen fit to steal some of the original Shareaza artwork (originally created by &#8216;RocketX and Kid&#8217;) to complete the look. So who has taken over the domain?</p>
<p>According to Skinvista, a developer from the &#8216;real&#8217; Shareaza, the situation is as follows:</p>
<p>&#8220;At this time the Shareaza.com destination is now controlled by iMesh/MusicLab LLC, an unauthorized Madison Avenue (New York) based company, with servers in Israel. MusicLab LLC previously acquired iMesh.com and Bearshare/Bearflix.com following lawsuits. It now appears the known scamsite Shareazaweb.com was a placeholder for the planned takeover of Shareaza, relating to another ongoing lawsuit.</p>
<p>It is urgent that people understand the software on these iMesh/MusicLab sites is suspicious, misrepresented, and illegal -breaking GPL and DMCA among other laws.&#8221;</p>
<p>As if this strange case needed any more twists in the plot, consider this. On October 26th 2007, the main Shareaza site went down due to unknown &#8220;personal matters&#8221;. </p>
<p>TorrentFreak asked &#8216;Wildcard&#8217; a &#8216;real&#8217; Shareaza developer what happened to the site. He explained: &#8220;That&#8217;s one of the mysteries. The main hosting server went offline, it had the Shareaza site, wiki and forums on it. The only information that made it this far, was that it was down due to personal problems with the owner of the server machines. what those personal problems were, medical or legal, we don&#8217;t know.&#8221;</p>
<p>Luckily the Sourceforge site was restored from an earlier backup.</p>
<p>However, the hijacked Shareaza.com domain now points to a server where it is hosted along with some other questionable sites, including bandoo.com, bearflix.com, bearshare.com, daemonsearch.com, imesh.com, imesh.net and musiclab-llc.com.</p>
<p>Apparently, there are lawyers involved now but the loose-knit Shareaza team are advising that it may be prudent to move forward on the basis that the domain won&#8217;t be recovered. A source close to this case has told TorrentFreak that Jonathan Nilson, the owner of the Shareaza.com domain has been contacted and he has confirmed that he has sold the domain to the scammers. It looks like the domain is lost forever, a big impact following the loss of the main site in October.</p>
<p>&#8216;Wildcard&#8217; explained that the software on offer from the hijacked site although labeled &#8220;ShareazaV4.exe&#8221;, is not Shareaza at all but likely a clone of the new malware infested iMesh/Bearshare client and should not be downloaded under any circumstances. Once installed, the software wants to install a search bar and make contact with a central server. Unlike Shareaza &#8211; which is abslutely free and has a reputation for being non-profit and shunning involvement with money &#8211; the hijackers are touting a subscription based product.</p>
<p>Indeed, the operators of iMesh even tried to trick people into thinking that the reputable GRC site <a href="http://www.grc.com/oo/spyware.htm">endorsed</a> the iMesh client &#8211; an assertion which is completely untrue.</p>
<p>Anyone wishing to find the real Shareaza client should head over to the project&#8217;s SourceForge <a href="http://sourceforge.net/projects/shareaza/">page</a>.</p>

<p><strong>Update:</strong> A contact of Jonathan Nilson is reporting that Nilson can neither confirm nor deny that he sold the domain to the scammers.</p>

Bands can upload their music and can choose to either let their fans stream songs or download them, or both. The focus is currently on independent artists, but it will hopefully shift to include mainstream ones as well.</p>
<p>With CNET backing the site, it&#8217;s not hard to see it grow to become a popular destination for free music. After all, CNET&#8217;s Download.com does boast of being &#8220;the premiere source for free music&#8221; with 75,425 free mp3s available for download. If you combine MP3.com&#8217;s memorable brand name and Download.com&#8217;s catalogue, you can come up with quite a strong offering that could even compete with the likes of iTunes. Add a MySpace-style music community to that and you&#8217;re set.</p>
<p>After the lawsuits were over, <a href="http://www.mp3.com/">MP3.com</a> was acquired by Vivendi Universal in 2001. It was then sold to CNET in 2003 and has since been more of a music news and reviews website than a place to find free downloads.</p>
<p>MP3.com already lets you <a href="http://www.mp3.com/free_music/?action=plays&#038;flag=2">stream songs</a> from popular mainstream artists. The free downloads on the other hand are mostly from unknown artists. The only song remotely familiar to me on the <a href="http://www.mp3.com/free_music/?action=downloads&#038;flag=2">Free MP3s &#8211; Popular</a> page is a piece from the Da Vinci Code Game soundtrack.</p>
<p>The real question is, can any such free offering compete with P2P networks and BitTorrent sites? I think if a company can find a way to make money from advertising, but at the same time not make ads intrusive and offer free music downloads, it&#8217;s going to blow music piracy away so fast that the RIAA might have to fire its lawyers. Spiral Frog is going to <em>try</em> to do <a href="http://TorrentFreak.com/spiralfrog-to-offer-free-downloads/">something of the sort</a>, but is expected to fail miserably because:</p>
<ol>
<li>Its songs won&#8217;t play on the iPod, and even the Zune since they will be protected with Microsoft&#8217;s WMA DRM.</li>
<li>The site is going to require people to keep coming back and watching ads, lest their songs stop working.</li>
</ol>

<p>After The raid on the popular BitTorrent tracker &#8220;<a href="http://thepiratebay.org">The Piratebay</a>&#8220;, the Pirate Party has transformed into the largest party without parliament seats. In Sweden, you get seats in the parliament if you get four percent of the votes. The Pirate Party has arount the same member count as the Green Party, which is a party that supports the current government, and without them, the current government can&#8217;t maintain their majority This leads the Pirate Party to believe that if they get into the parliament they can fill such a vital role, and thereby make a big difference. Worth noting is that some unofficial gallups from various sources indicate that the Pirate Party is the <a href="http://TorrentFreak.com/young-swedes-love-filesharing/">most likely party for a Swedish first-time voter to choose on election day</a>.</p>

<p><strong>The Pirate Party Election Manifesto 2006</strong></p>
<p><em>Preface</em><br />
The election program of the Pirate Party consists of various nautical charts, describing what we want to do in each of the areas within the Pirate Party policies. These charts are divided in sections based on deadline and what is to be done on a Swedish and on a European level.</p>
<p>As an introduction to these charts, we describe our ideology and our main policies.</p>
<p><strong>Protected integrity in an open society</strong><br />
The development of technology has made sure Sweden and Europe stand before a fork in the road. The new technology offers fantastic possibilities to spread culture and knowledge all over the world with almost no costs. But it also makes way for the building of a society monitored at a level unheard of up until now.</p>
<p>In no time, the monitoring state has advanced its positions strongly in Sweden. This development threatens equality and safety before the law, and nothing indicates that it even adds to security. The Pirate Party believes this is the wrong way to go.</p>
<p>The right to privacy is a corner stone in an open and democratic society. Each and everyone has the right to respect for one&#8217;s own private and family life, one&#8217;s home and one&#8217;s correspondence. If the constitutional freedom of information is to be more than empty words on a paper, we much defend the right for protected private communication.</p>
<p>The arguments for every individual step towards a monitoring society may sound very convincing, but we only have to look at the recent history of Europe to see where that road leads. It is less than twenty years since the fall of the Berlin wall, and there are numerous other terrible examples. To claim that it&#8217;s only those with something to hide that has anything to fear is simply lacking knowledge of history, and lacking courage.</p>
<p>We have no problem with police monitoring and spying on suspected criminals. That is exactly what the police is suppose to be doing. But routinely monitoring ordinary citizens hoping for something suspicious to turn up is not only a gross violation of the privacy of honest people. It is also a waste of valuable police resources.</p>
<p>We have to pull the emergency break on the train running towards a society we don&#8217;t want. Terrorists can attack our open society, but only governments can disband it. The Pirate Party wants to ensure that this doesn&#8217;t happen.</p>
<p><strong>Private communication and file sharing</strong><br />
A driving force behind the current monitoring hysteria is the entertainment business, which wants to prevent people from file sharing copyrighted material. But to achieve this all private communication must be monitored. To know what ones and zeros make up a movie, the ones and zeros has to be analyzed. It is the same sort of ones and zeros that is sent, regardless of if it makes up a piece of music, or a letter to a doctor or a lawyer.</p>
<p>Therefore society ha to choose: do we want a possibility to trustingly communicate over the Internet to exist?</p>
<p>If your answer is yes, it means that also those that shares copyrighted material can use these possibilities.</p>
<p>If you answer is no, it means that you abolish the right of information, the right to mail secrecy and the right to a private life.</p>
<p>There are no other answers.</p>
<p>It is not possible to claim that society should allow mail secrecy for certain purposes, but not for others, since it is impossible to separate the different cases without breeching the secrecy. It is the same types of ones and zeros being used, and only by opening the message, it is possible to see what it contains.</p>
<p>The current copyright legislation can not be combined with freedom of information and protected private communication. Since the fundamental principles of the open, democratic society is more important than conserving old business models within the business of entertainment at all costs, copyright has to fold.</p>
<p>But this is not negative. A reformed copyright legislation, expressing a balance between different interests in society instead of being an order form from the large media companies, has its own benefits. It is a possibility for Sweden and Europe, not a threat.</p>
<p><strong>The spreading of culture and knowledge is a positive thing</strong><br />
Thanks to the Internet it is today possible for everyone with a computer to take part of a fantastic treasure of culture and knowledge.</p>
<p>Instead of being limited to a cultural canon decided from above, the youths of today has access to the music, theater and pictures of an entire world. This is something we should embrace, not something we should try to forbid. File sharing is good for society and its people.</p>
<p>All non-commercial acquiring, using, bettering and spread of culture should be actively encouraged. The Internet is filling the same function today as popular education did a hundred years ago. It is something positive and good for the development of society.</p>
<p>The copyright legislation must be changes so that it is made perfectly clear that it only regulate use and copying of works done for commercial purposes. To share copies, or in any other way spread or use someone else&#8217;s work, should never be forbidden as long as it is done on an idealistic basis without the purposes of commercial gain.</p>
<p>Unfortunately, the legislation has developed in quite the opposite direction. On July 1, 2005, a million ordinary Swedes were suddenly turned into criminals over night, simply because they download movies and music. This doesn&#8217;t only hurt our possibilities to take part of culture. In the long run it undermines the trust of our entire judicial apparatus. This development has to end.</p>
<p>In a similar fashion, patents are used to inhibit the spread and use of knowledge, which hurts society as a whole.</p>
<p>Medical patents make people in poor countries die for no reason. It twists the priorities in research and makes the costs for medications a problem in every health care budget.</p>
<p>Software patents inhibit technical development within the info tech area and presents a serious threat against small as well as mid-sized businesses and individual developers. They run the risk of putting the power over the Internet completely in the hands of a small number of multi national businesses.</p>
<p>We want to release knowledge, and have specific suggestion on how to avoid the negative consequences that the patent system means.</p>
<p>Sweden and Europe has everything to gain from choosing the path of openness.</p>
<p><strong>No other issues</strong><br />
The Pirate Party does not have any policies on issues that traditionally concerns the left-right scale, or any other issues outside of our program of policiies.</p>
<p>We particularly does not concern ourselves with the division of wealth. We are not after dividing money between different groups in society. None of our propositions costs any money for the state, and several of them may potentially save money in the budget. Because of this, we can place ourselves outside of the struggle concerning the budget, with good faith, and leave it to the old parties.</p>
<p>We are ready to support a social democratic as well as a non-socialist government, we claim that both GÃ¶ran Persson as well as Fredrik Reinfeldt are well capable of taking the role as the head of government in a satisfactory manner. We do not believe that the differences between them are that big, in reality, and every one of us are ready to live with any of them as our prime minister.</p>
<p>The only thing that concerns us, is the protection of our open society and democracy, that the march towards a controlled society is cancelled, and that culture and knowledge are set free.</p>
<p>Our goal is to reach the parliament and being in a position where we can tip the scale. If we succeed in this we will talk to both GÃ¶ran Persson and Fredrik Reinfeldt alike. We will explain what we want, and point out that our policies in no way differs from either traditional social democratic policy or traditional liberal/non-socialist policy.</p>
<p>After that, we will support the person aspiring to form a government, who is ready to make the best deal with us on our policies. On any matter outside of our policy statement, we will support and vote for the current government, no matter what we believe individually on different matters.</p>
<p>Due to the fact that we do not have a view on everything on this earth, but concentrate completely on the issues where we have formed a policy, we can promise a result if we make it to the house of parliament in a scale-tipping position. That makes us unique in Swedish political history.</p>
<p>We are the only party that will never deal away our free and open society for the benifit of any other issue or interest.</p>
<p>More on the Pirate Party tipping the scale<br />
The Pirate Party does not take a stand in issues generally associated with the right or left, or any other issues that are not part of our declaration of principles. We are ready to support a socialdemocratic as well as a non-socialist government. The only thing that concerns us is that the march towards a controlled society is cancelled, and that culture and knowledge in society are set free,</p>
<p>On of the factions within Swedish politics has really anything to lose in reality by satisfying more or less all of our demands. Neither Persson nor Reinfeldt have any personal interest in keeping the absurdity that is current copyright legislation. The fact that things look like they do, is primarily due to lack of interest in the area, and that they have therefore allowed the &#8216;experts&#8217; (i.e. the lobbyists of the entertainment industry) have their way.</p>
<p>In a situation where they can gain position of forming a government by striking a deal with us in an issue that they, themselves, believe to be less important, there is every reason to believe that they will be eager to find a solution.</p>
<p>But in either case, there are three possible scenarios:</p>
<p><strong>1) </strong>One of the factions agree to our demands, and the other does not. Then we will choose the faction that agree with us. Whether this is the red faction of the blue faction is of no concern for us. As long as we see that they are doing their best to seriously run our issues, we will support the government in all other issues as well, without questioning.</p>
<p><strong>2) </strong>Both the factions agree to our demands. If there are differences of nuances making one faction looking slightly better than the other, we will choose this faction. If both are exactly as good, we will support the faction with the more votes. This way we won&#8217;t influence the balance between the factions in Swedish politics. As long as the government is running our issues, we will support them in all decicions, just as in the first scenario.</p>
<p><strong>3)</strong> Both the factions refuse to meet our demands. This is the more complicated case, but we can handle this one too. Initially we will support one faction, and make a government possible. Most likely this will be the ones with the less votes, so that the others, the &#8216;victors&#8217;, will feel that they have lost power they were entitled to. They can, however, not do much about it, since we will support the government without questioning in anything that does not involve our principles.</p>
<p>When the &#8220;victors&#8221; are safely placed in the penalty box of opposition, we start our businesslike, low-voiced conversations with them, until they realize that our proposals are not, in fact, that dangerous, and that they can only win from working with us. When they have seen our arguments in the glow of the miraging governmental position for a while, there are good reasons to believe they will agree with us. This is when we will call for a vote of non-confidence and change the government. After that, the Pirate Party with support the new government without questioning, in all issues, as long as the government runs our issues forcefully, just as in scenario 1 and 2.</p>
<p>This is our entire strategy. This way we can guarantee that our policies will have a break-through.</p>
<p><strong>Questions and answers about our scale-tipping strategy</strong><br />
<em>- How do we handle parliamentary votes that do not include any issues that the Pirate Party runs?</em></p>
<p>We will support the government in office, no matter what our personal opinions might be.</p>
<p><em>- Will the party try to make deals with other parties (&#8221;if you vote for us on issue &#8220;X&#8221; and &#8220;Y&#8221; we will help you with &#8220;Z&#8221;)?</em></p>
<p>No, we will talk to the party in office. As long as they do as we want in our issues, we will support them in all other matters. We do not wish to try shopping a la carte from different parties (if we do, we will only be shoved aside). If the government stops this manner of cooperation, we will change the government, but as long as we tolerate a government, we are completely loyal to them in all other issues, those not in our program.</p>
<p><em>- &#8230;or not vote?</em></p>
<p>If the government needs our support in the parliament it can count on it. We will not cancel our votes if this would affect the turnout against the government.</p>
<p><em>- &#8230;or let the individual MPs decide for themselves?</em></p>
<p>Under no circumstances. The day we start voting after personal preference, we have nothing more to offer the other parties in a negotiation. If this happens, we can no longer benefit from our position, and have no longer any means to influence the policies that is the closest to our hearts.</p>
<p>- But in the third scenario (that is if none of the factions wants to offer anything at all, even though we are tipping the scale), why would we want to support the government? We should obviously be able to offer them to vote, from their perspective, in an unseemly manner? It seems a bit awkward to give them what they want first (by support) and then trying to negotiate.</p>
<p>The idea in the third scenario is that we help a government form, that we ourselves aren&#8217;t happy with, but who we choose to support indefinitely anyway. Principally only to tease the opposition, in other words. When the opposition has spent a few months being grumpy because they can&#8217;t form a government even though they think they won the election, they have two alternatives to choose from. They can either stay grumpy for the next four years, or they can start talking to us to find out if they can &#8220;talk sense in to us&#8221; and have our support.</p>
<p>The big prize is the government, both for the left and the right, and they have nothing to lose from having a dialogue with us. With that, we&#8217;ve managed to initialize a discussion with the opposition concerning these issues. Since our proposals does not, in any way, clash with the basic values of neither the left wing nor the right wing block, and since they are good proposals, objectively, for Sweden, there is no reason to believe that they would prefer to stay grumpy for the next four years instead of making a deal with us.</p>
<p>But until they have done so, we will consistently vote with their opponents (i.e. the government that we support even if we think they are no good). That way the opposition will have an even bigger reason to strike a deal with us, even more so than if we voted without a clear direction. The more votes the opposition loses concerning health care / education / taxes / disbanding of military units, the more eager they will become to have a change of government.</p>
<p>The government that is in power even though we think they&#8217;re no good will perhaps feel happy to be able to carry through whatever they want without giving us anything in return. But they will know that all it takes for them to lose office is one word from the opposition. So the joy they&#8217;re feeling will hardly be very deep or long lasting.</p>
<p>The point of helping a government to form even if none of the players gives us what we want is that we want to add to stablity and let things calm down a bit. One can&#8217;t postpone negotiations about the government more than a couple of weeks after the election. If we can&#8217;t have a government that we want because it promises to see our points and work for them, it&#8217;s still better to help a government we don&#8217;t like. The country needs a government.</p>
<p>Parliamentarism is such an ingenious system because the parliament can throw out the government in office whenever a majority of its members wish. The leader of the opposition will know this, no matter if his name is Persson or Reinfeldt. So why would he not talk to us to see if he can create a majority for a vote of no confidence? And why would he not meet our demands when he has had time to think about them, and realize that they do not oppose his own ideology or any core party issues in any way?</p>
<p><strong>If we make it to the parliament, but can not tip the scale</strong><br />
Even if we would not reach a position where we can tip the scale, we can still do a lot of good in the standing committees. Much of the malfunctioning legislation that is voted through is often voted through because the established parties do not understand the Internet and all the new technology. They have not thought through the consequences of building a controlled society to conserve the old instead of embracing the possibilities we have in our time.</p>
<p>They often blindly trust what lobbyists and civil servants at the departments tell them to think. They do not see these issues as important enough to put down time getting an informed opinion.</p>
<p>We can hopefully change this, simply by being part of the committees, pressing the fact that these are important issues. Neither social democrats nor moderates really want to make it illegal for small businesses to develop new software, after all, or put all Swedish youths in prison. The fact that they still make or argue for laws that has these consequences is mostly due to lack of knowledge. We can supply the standing committees with a well needed competence and a valuable perspective.<br />

- If we can&#8217;t tip the scale, will we try to negotiate about individual issues?</em></p>
<p>In this scenario, negotiations will hardly be our most important tool, simply because we wouldn&#8217;t have much of a negotiation position. If they can create a majority without us, they won&#8217;t need to negotiate with us at all.</p>
<p>But this does not mean that all would be lost. We could still add a lot, simply by being constructive in our committee work. Much of the worst legislation is due to the fact that the established parties lack knowledge and interest in our issues.</p>
<p><em>- &#8230;or will we simply cancel our votes?</em></p>
<p>In a situation where there is a parliamentary majority without us, it wouldn&#8217;t matter how we voted, and then it doesn&#8217;t make a difference. The simplest thing would be to simply not vote.</p>
<p><em>- &#8230;or do we present bills that are promptly turned down?</em></p>
<p>We might want to present bills as part of our work to clarify the choices our society has, but the purpose then would only be to raise these issues. We would probably have to spend more time discussing the pros and cons of the bills that are about to be clubbed.</p>
<p><em>- &#8230;or should we simply stay home with our kids?</em></p>
<p>Participating in the committees in a constructive manner aside, there will be much work to be done on the European level. Some of the decisions we want carried through can only be made in Brussels. Therefore we have all reason to do what we can to support our sister parties in other countries, and help them get started. So there might not be much time for vacation, even if we don&#8217;t get to support a government.</p>
