Avatar came out <a href="http://torrentfreak.com/avatar-dvd-screener-leaks-to-bittorrent-100204/">as a DVD screener</a> this week and is the most downloaded movie on BitTorrent again. The Hurt Locker, the other big winner at the Oscar nominations, reappeared in the charts in fourth place.</p>

			<content:encoded><![CDATA[<p><a href="http://torrentfreak.com/images/ink1.jpg"><img src="http://torrentfreak.com/images/ink1.jpg" alt="" title="ink" width="210" height="168" align="right" /></a>Written and directed by Jamin Winans, Ink is an indie movie about a mercenary who appears in the dreams of a comatose 8 year old girl. As with most movies, one part of the story was particularly predictable. It was quickly ripped and ended up on BitTorrent.</p>
<p>Just over a week after becoming available online in early November 2009, Ink pushed into TorrentFreak&#8217;s chart of top 10 most pirated movies with an incredible <a href="http://torrentfreak.com/top-10-most-pirated-movies-on-bittorrent-091109/">400,000 downloads</a>.</p>
<p>Unlike the majority of Hollywood movie bosses, the creators of Ink &#8211; Jamin and Kiowa Winans &#8211; decided to embrace their new-found pirate fans after the extra publicity pushed the movie to 16th place on IMDb’s movie meter and boosted DVD and Blu-ray sales. Kiowa <a href="http://torrentfreak.com/indie-movie-explodes-on-bittorrent-makers-bless-piracy-091110/">wrote to</a> TorrentFreak and said that the movie ending up on BitTorrent was &#8220;absolutely&#8221; the best thing that could&#8217;ve happened to it.</p>
<p>Now, Lars Sobiraj from German news outlet Gulli has interviewed Kiowa to see how things have progressed a couple of months on from the initial excitement.</p>
<p>As previously reported, Ink has been downloaded hundreds of thousands of times, so just how many of those translated into real-world sales? Kiowa says that is really hard to put an exact figure on that &#8211; they haven&#8217;t sold a DVD or Blu-ray for every download but sales have unquestionably gone up.</p>
<p>Money also came in from other routes too. As the movie gained popularity on BitTorrent, many Ink downloaders suggested that there should be a &#8216;donate&#8217; button on the movie&#8217;s website so that fans could give money freely.</p>
<p>&#8220;We put that [donation link] up at the urging of some of the downloaders with the message &#8216;if you have watched Ink online for free and would like to contribute what you can, click here&#8217;,&#8221; Kiowa explains.</p>
<p>&#8220;Guess what country has been the most generous? Germany! Germans have been twice as generous as Americans so&#8230; thank you Germany.  We have also shipped a lot of Deluxe Bundle fan packs to Germany so Ink seems to be a big hit there.&#8221; </p>
<p>Gulli asked Kiowa if she felt the movie had fallen victim to piracy, a notion she strongly denies.</p>
<p>&#8220;I think to say victim is to characterize piracy as an all-together awful thing.  The piracy of Ink is unquestionably responsible for its popularity around the world.  Sure our trailers have been out for over a year and have had plenty of views outside the US, but we think that 70% of the illegal downloads are coming from outside of the US and we do get a good number of international buyers at our online store every day,&#8221; she explained.</p>
<p>Before Ink was pirated, the movie&#8217;s IMDb rating was a lowly 12,991. As reported in our earlier article, it reached 16 and even moved up to the 14th position at one stage. Incredibly it has stayed as one of the top 200 movies in the world for the last two months, a feat that would have been impossible without the extra exposure.</p>
<p>Looking forward to future distribution models, Kiowa feels that everything will change during the next 10 years as people demand instant and simple access to media and their TVs and computers merge together into one device.</p>
<p>&#8220;That said, I&#8217;m not sure what the revenue model will be for films,&#8221; she notes.  &#8220;Hollywood producers are quickly finding out that the instant films start circulating on DVD they will wind up on torrent sites.&#8221;</p>
<p>Kiowa broadly puts BitTorrent users into two camps &#8211; those who want media in an instant and those who want it for free. Noting that there are those who fall into both categories, she acknowledges the challenges that lie ahead in figuring out a way to make this situation bring revenue to the filmmakers.</p>
<p>&#8220;I think a reasonably-priced instant download the moment the movie becomes available would largely cure the piracy issue so we will see how it all shakes out over the next several years,&#8221; she adds.</p>
<p>As most observers are aware, many music and movie companies consider torrent sites as entities to be crushed and in recent years have set about a strategy to achieve that. Gulli asked Kiowa if she believes that is the correct strategy to deal with the problem.</p>
<p>While one could argue that non-physical digital formats such as MP3 are part of the reason that piracy has flourished in recent years, Kiowa feels that the invention of the iPod has helped to reduce piracy, largely through the existence of competition from one service &#8211; iTunes. The movie industry needs to catch up.</p>
<p>&#8220;Until the equivalent of the iPod is invented for film or long-format video files I think that piracy is going to be a huge battle ground, one in which I doubt Hollywood will win,&#8221; Kiowa predicts.</p>
<p>&#8220;There is always a smarter programmer out there that can move faster than bureaucracy.  The film industry really needs to set its sights on overhauling its distribution system.  Right now there are horrible things like region-coded DVDs that tie up a film&#8217;s rights in various countries and this is what has made the film business plenty of money over the years.&#8221; </p>
<p>The industry needs to move its thinking to encompass global distribution, says Kiowa, not concentrate on pushing movies out to dozens of separate territories.</p>
<p>&#8220;We are going to keep all the rights to Ink and not give them away country-by-country so that when that iPod-for-movies emerges Ink can be the first film that debuts to the whole world,&#8221; she says, adding:  &#8220;That is the hope anyway.&#8221;</p>
<p>Looking to the future, partner Jamin is currently working on scripts for two new films, one a sci-fi psychological thriller called &#8216;The Frame&#8217; and another a sci-fi fantasy called &#8216;Myth of Man&#8217;. </p>
<p>&#8220;For the time being we&#8217;re just really happy that Ink is rolling along and gaining fans around the world.  How ever people come to the film, we&#8217;re just happy that they are watching it, Kiowa concludes.</p>
<p>&#8220;As Jamin likes to say, the battle of independent films is not piracy, it&#8217;s obscurity.  Hey &#8211; at least we&#8217;re winning that one!&#8221;</p>

			<content:encoded><![CDATA[<p>Waxy&#8217;s Andy Baio has been collecting detailed piracy stats for every Oscar-nominated movie since 2003. Much to the delight of the MPAA, his most <a href="http://waxy.org/2010/02/pirating_the_2010_oscars/">recent statistics</a> show that, compared to previous years, fewer Oscar nominees have leaked online. </p>
<p>The statistics for all <a href="http://oscar.go.com/nominations/nominees">2010 nominees</a>, except documentary and foreign films, show that 27 of the 34 films were available on BitTorrent in DVD quality last night. Nearly half of the films have leaked as a screener and 10 of those are estimated to be leaked by Academy members.</p>
<p>Although the majority of the Oscar nominees are available online, the movie industry has certainly scored a small victory. Last year all films leaked in one format or another. On another positive note for the MPAA, the median time for films to leak after their US-release date has nearly doubled to 21 days. In 2003 it took only one day for most films to leak onto the Internet.  </p>
<p>On the negative side, there were still 4 films that were available online before they they premiered in US movie theaters. In The Loop, The Hurt Locker, The White Ribbon and The Young Victoria all leaked in advance of their official premiere. </p>

<p>The graph below further shows that there are less retail DVD rips available compared to previous years, 44% versus 100% in 2008 and the years before. As Andy also mentions, this figure may go up a little before the official Oscar award ceremony broadcast.</p>

<p>Although this data suggests that the movie industry is becoming more effective in preventing screeners from leaking online, we have to emphasize that more than a third of the leaks originated from deviant Academy members who like to share the work of their colleagues. </p>
<p>The Oscar screener of Avatar was sent out relatively late, only a few weeks ago. It <a href="http://torrentfreak.com/avatar-dvd-screener-leaks-to-bittorrent-100204/">leaked onto the Internet</a> today and is not included in the graphs above.</p>

			<content:encoded><![CDATA[<p><a href="http://torrentfreak.com/images/elitebits.jpg"><img src="http://torrentfreak.com/images/elitebits.jpg" alt="" title="elitebits" width="175" height="170" align="right" /></a>The administrator of the private EliteBits BitTorrent tracker has been explaining how he received some unwelcome visitors last week.</p>
<p>Known by his nickname &#8216;Laeborg&#8217;, the Denmark-based admin had a knock on his front door at 7:00am on Friday. There he was confronted by a man from the enforcement court, accompanied by three men from Johan Schlüter Advokatfirma, a law firm that works with Danish anti-piracy group, Antipiratgruppen.</p>
<p>After producing screenshots from EliteBits, information on the bank account used to collect site donations and a warrant, they explained that they had come to secure evidence to show Laeborg was involved in the illegal distribution of copyright works.</p>
<p>The man from the enforcement court contacted lawyer Benny Thomson to represent Laeborg, who was told not to use his phone on concerns he could use it to destroy evidence.</p>
<p>&#8220;The collection of evidence started when they asked me to turn on my computer which I did,&#8221; Laeborg explains. &#8220;They asked me to go to elitebits.org where they took screenshots of my profile and screenshots of the statusbar that says: &#8220;Welcome, Laeborg (Owner).&#8221;</p>
<p>They went on to take screenshots of all the staff profiles, the Top 10 downloaders, Top 50 uploaders and various other lists, including uploaded torrents.</p>
<p>A list of donors who contributed via bank transfer was discovered and screenshots of all their profiles were taken. Laeborg was informed that he had been traced via the bank account used to accept these donations from site members.</p>
<p>After taking screenshots of hashes and NFOs linked to a pair of torrent files, Laeborg was asked for the user database. He explained that he couldn&#8217;t provide it and they would need to speak to host Netdirekt.</p>
<p>Various &#8220;non-legal&#8221; CDs and DVDs were seized from Laeborg&#8217;s office for destruction, with an assurance that the contents wouldn&#8217;t be examined. The evidence was copied to a USB drive and the group left.</p>
<p>&#8220;My lawyer stayed and we talked the whole thing through,&#8221; Laeborg recalls. &#8220;I told him the basic concepts about the site. He says that they won&#8217;t have enough evidence to make me pay for the all the stuff shared, but it is possible that they will take down EliteBits.org.&#8221;</p>

			<content:encoded><![CDATA[<p><img src="http://torrentfreak.com//images/isohunt.png" align="right" alt="isohunt" />In September 2006, just months after the infamous Pirate Bay raid, the US movie studios turned their attention to isoHunt and other associated websites. Columbia, Disney, Tristar, Twentieth Century Fox, Universal and Warner Bros issued a complaint, stating that isoHunt owner Gary Fung operated file-sharing services and profited from copyright infringement.</p>
<p>On December 21st 2009, a US federal court in California ruled that isoHunt is indeed guilty of violating US copyright law by way of inducement, with the operators having engaged in “purposeful, culpable expression and conduct, aimed at promoting infringing uses of the websites.&#8221;</p>
<p>In noting the similarities between this case and earlier ones involving both the Napster and Grokster file-sharing services, Judge Stephen Wilson ruled that a full trial was not required and granted the plaintiffs request for summary judgment.</p>
<p>As <a href="http://www.michaelgeist.ca/content/view/4643/125/">noted</a> by Michael Geist, the court also concluded that inducement liability and the safe harbor provisions under the DMCA are incompatible. In this case it means since isoHunt was found to have induced infringement, it did not qualify for safe harbor.</p>
<p>In common with the <a href="http://torrentfreak.com/lessons-the-next-big-torrent-site-will-learn-from-mininova-091130/">Mininova court defeat</a> earlier this year, the court was critical of isoHunt (and associated sites) staff actions on the site and in their forums.</p>
<p>The court said the clearest instance of encouraging users to commit infringements was the &#8216;Box Office Movies&#8217; section of the site. These pages listed the top 20 highest-grossing movies in the US, for which users were invited to upload associated torrents.</p>
<p>&#8220;By implementing this feature,&#8221; said the court, &#8220;Defendants engaged in direct solicitation of infringing activity.&#8221;</p>
<p>Furthermore, when isoHunt generated torrent categories, such as &#8216;Top 20 Movies&#8217;, the court said that the fact that these lists &#8220;almost exclusively contained copyrighted works and that Defendants never removed these lists&#8221; indicated that isoHunt knew about ongoing infringement yet failed to take action to stop it.</p>
<p>Several other instances of staff members giving users advice on how to download copyright movies (including providing .torrent links), rip copyright DVDs and use software such as PeerGuardian were also cited.</p>
<p>Even the forum user ranking system didn&#8217;t escape criticism. Since user ranks included titles such as “I pir4te, therefore I am” and “All Day I Dream About W4rez,” the court concluded that the Defendants &#8220;promoted their users’ infringing activities by consciously fostering a community that encouraged – indeed, celebrated – copyright infringement.&#8221;</p>

At 46 pages long it&#8217;s a pretty heavy read, but contains essential information for anyone interested in what can&#8217;t be done when operating a torrent site or other similar service in the US.</p>
<p>At this stage it&#8217;s unclear if isoHunt will appeal the US decision, but of course, in the meantime the site is fully operational in Canada, and will remain so for the foreseeable future.</p>

			<content:encoded><![CDATA[<p>In March 2007, TorrentFreak interviewed a guy who since the 1990&#8217;s had been making his living from commercial piracy. Starting off with PC software and later Playstation games, &#8216;Tony&#8217; made a very good income from illicit sales at the UK&#8217;s markets and pubs.</p>
<p>As demand grew Tony&#8217;s business expanded year after year, but by 2001 and although still busy, profits were being squeezed. By 2004 demand started to fall dramatically and in 2005 he had to close down his factory unit. Tony <a href="http://torrentfreak.com/p2p-file-sharing-ruins-physical-piracy-business/">told</a> TorrentFreak there was a new competitor in town.</p>
<p>“File-sharing, P2P – call it what you like. When you asked a customer why he wasn’t buying anything, 9 times out of 10 it was ‘BitTorrent this, LimeWire that’. Add that to the fact that huge numbers of PC users have burners and fast broadband and it&#8217;s obvious why I had to get out and earn a living another way. We had it good for a while but I don’t think those days are coming back.”</p>
<p>Cheap pirate media had just got even cheaper. With the advent of super-fast broadband there was little point in visiting the local counterfeiter when everything was just a few clicks away for free on increasingly user-friendly BitTorrent and other file-sharing sites. But what happens to the physical piracy market when the file-sharing sites are no more? Maybe China is about to find out.</p>
<p>During the last month Chinese authorities <a href="http://torrentfreak.com/chinese-authorities-shut-down-bittorrent-sites-091207/">shut down</a> hundreds of video sites, including some of the biggest BitTorrent trackers such as BTChina, for operating without an appropriate government license.</p>
<p>Now, according to a Chinese illegal DVD vendor, these shutdowns could be set to bring him and his competitors a sudden windfall &#8211; the exact mirror image of what happened to Tony several years ago.</p>
<p>&#8220;Pirated DVDs are the cheapest choice for people without free downloads online,&#8221; <a href="http://www.chinadaily.com.cn/life/2009-12/15/content_9179920.htm">he said</a>. &#8220;I expect my sales to triple before Christmas.&#8221;</p>
<p>While it&#8217;s still early days, officials in charge of clearing illicit vendors from the streets said that they had not yet witnessed a surge in demand for illegal DVDs. A spokesman for a Chinese IP lawfirm said that while there could be an increased demand short-term, file-sharers are resilient.</p>
<p>&#8220;Simply shutting down those websites might have an immediate impact, but where there&#8217;s a will, there&#8217;s a way,&#8221; he said. &#8220;The problem is, if you shut down the top two BitTorrent sites, then people are simply going to go to number three, number four or number five on the list,&#8221; he said. &#8220;You can cut off the head but sooner or later two more will grow back.&#8221;</p>
<p>Time will tell if an Internet crackdown on video sites will force customers back onto the streets, but perhaps more intriguing is the answer to this question &#8211; will it push them back into the arms of the legitimate vendors of movies and music? It seems unlikely.</p>

			<content:encoded><![CDATA[<p><img alt="" src="http://torrentfreak.com/images/drm-no.jpg" align="right" width="175" height="206" />Danish copyfighter Henrik Anderson has a dilemma. Although the laws in his country allow him to copy DVDs for his own personal use, they forbid him to remove the DRM in order to do so.</p>
<p>Wanting to have this legal contradiction dealt with by his government, he confessed to anti-piracy group Antipiratgruppen that he had illegally broken the DRM on a hundred movies and TV shows. <p>After Antipiratgruppen missed the deadline to respond, Henrik announced a couple of days ago he would report himself to the police. But now the group has responded, in a way that is possibly as confusing as the original law, although in a way that also makes perfect sense.</p>
<p>Their first paragraph notes that it is illegal to circumvent the &#8220;so-called effective technological measures&#8221; without the consent of rights holders &#8211; a reference to copy protection on a DVD. They also note that making a copy of the DVD in order to watch it on a media center (this issue Henrik is trying to draw attention to) is also illegal.</p>
<p>So far, so good. Now here&#8217;s the interesting part:</p>
<blockquote><p>That said, the main purpose of the rule is to ensure against abuse of films and music being illegally copied and distributed further. The Association of Danish Videodistributors certainly have no interest in suing consumers who like you have purchased legitimate products &#8211; quite the contrary. </p></blockquote>
<p>In a nutshell, Antipiratgruppen says that as long as people buy movies initially, they don&#8217;t mind them a taking digital copy for their own use, as long as there is no distribution to 3rd parties &#8211; despite both acts being equally illegal.</p>
<p>Commenting on the news, Henrik told TorrentFreak: &#8220;I&#8217;m glad that they will not prosecute me. But at the same time it&#8217;s still illegal, so &#8230;&#8221;</p>
<p>Henrik says that since this section of copyright law has no effect in the real world, it should simply be abolished so that people know where they stand, since other people in the future might take a different stance.</p>
<p>&#8220;Who is to say that if the anti-piracy group suddenly falls over a man with a 1000 films that they would not prosecute him, even though he has paid for his films? Once again: it is still illegal,&#8221; he told us.</p>
<p>Although Antipiratgruppen have responded promising not to prosecute, Henrik told TorrentFreak that he&#8217;s not going to rest here.</p>
<p>&#8220;Act (§ 75C) is not modified / removed yet. Only on the day where the Culture Minister said the law will be removed / changed will my goal be reached.&#8221;</p>
<p>Next week, Henrik will try to contact the Culture Minister, who thus far hasn&#8217;t been interested in doing much, but at least at this point must realize that there is something very wrong with the law.</p>

			<content:encoded><![CDATA[<p><img alt="" src="http://torrentfreak.com/images/drm-no.jpg" align="right" width="175" height="206" />At the end of October, a Danish citizen took drastic action to draw attention to some restrictive and seemingly contradictory copyright legislation.</p>
<p>Henrik Anderson <a href="http://torrentfreak.com/drm-breaker-reports-himself-to-anti-piracy-group-091103/">told</a> TorrentFreak that in order to force his government&#8217;s hand on laws which allow him to copy DVDs for his own personal use, but forbid him to remove the DRM in order to do so, he decided to turn himself in.</p>
<p>Henrik informed the Danish anti-piracy outfit Antipiratgruppen that he had broken the DRM on more than one hundred legally-purchased DVD movies and TV shows for use on his home media center, an act forbidden &#8211; but seemingly also allowed &#8211; under <a href="http://www.kum.dk/sw4550.asp">Danish laws</a>, both detailed below;</p>
<p><em>12.–(1) Anyone is entitled to make or have made, for private purposes, single copies of works which have been made public if this is not done for commercial purposes. Such copies must not be used for any other purpose.</em></p>
<p><em>§ 75 c. It is not permitted without the consent of the rightholder to make circumvention of effective technological measures</em></p>
<p>“I’ve started this because I don’t want to be a criminal,” Henrik told us, in his own similarly and deliberately contradictory way, noting that he&#8217;d requested a response from the group by today, December 1st 2009, indicating whether or not they intend to prosecute him.</p>
<p>However, in the period up to today, Henrik heard nothing from Antipiratgruppen, although their lawyer Thomas Schlüter did <a href="http://torrentfreak.com/anti-piracy-group-responds-to-media-not-drm-breaker-091107/">speak</a> to the Danish press, saying that it was a political matter but had nevertheless reported the issue to the Association of Danish Videodistributors for consideration. In response, their chairman, Poul Dylov, said they would have a meeting to decide whether to report the matter to the police.</p>
<p>Antipiratgruppen said it would reply to Henrik by they date he requested. It seems they have broken their promise.</p>
<p>&#8220;Today was the last chance for the anti-piracy group to come up with an answer,&#8221; Henrik <a href="http://enfrustreretforbruger.dk/home/?p=853">told</a> TorrentFreak a few minutes ago. &#8220;And although, as you know, they told the press that they would give me an answer before the 1st of December, they have not done that.&#8221;</p>
<p>Henrik told us that even though he has broken the law, Antipiratgruppen doesn&#8217;t seem interested in responding. &#8220;They are obviously aware that there will be an outrage if they reported me to the police,&#8221; he points out.</p>
<p>The other possibility, he says, is that Antipiratgruppen themselves don&#8217;t see his actions as illegal &#8211; but this creates another problem. The Ministry of Culture have already written to Henrik informing him that breaking DRM in this way is against the law.</p>
<p>Clearly frustrated, Henrik told us: &#8220;But who should I follow? Those that determine the laws in this country? Or those who are lawyers for the companies that i&#8217;m committing a crime against?&#8221;</p>
<p>But Henrik has a solution to their inaction.</p>
<p>&#8220;I decided to try to see if I can report myself directly to the police, for the case must be resolved,&#8221; he told us.</p>
<p>Henrik feels that the situation he is trying to draw attention to can only be solved by him going to trial. Hopefully then the Minister for Culture and the Danish parliament will see that the law has to be changed.</p>

<p>The case progressed in the Federal Court today, with iiNet barrister Richard Cobden continuing with his closing submissions.</p>
<p>As detailed earlier in the case, after AFACT sent many thousands of copyright infringement notices to iiNet, the ISP responded by sending them to the police. Cobden defended that decision today, claiming that the notices could constitute evidence of copyright crimes.</p>
<p>While the studios had earlier insisted that they would never sanction unlawful investigation methods, <a href="http://www.itnews.com.au/News/160896,day-20-afact-snoops-arguably-committed-crimes-in-iinet-probe.aspx">ITNews</a> quotes Cobden as saying that in gathering that evidence, it was likely the investigators themselves had also committed offenses, <a href="http://www.austlii.edu.au/au/legis/cth/consol_act/ca1968133/s132aj.html">breaching section</a> 132AJ(1) of the Copyright Act.</p>
<p>The barrister said that both investigators committed primary acts of infringement online, and while AFACT had earlier claimed that iiNet users burned copyright material onto DVDs after downloading it, in fact the only evidence of that being done relates to the copies made by AFACT investigators.</p>
<p>Continuing to attack the evidence provided by AFACT and its anti-piracy partner DtecNet, Cobden returned to an earlier assertion that DtecNet investigators did not behave as normal BitTorrent users would. Regular users would allow their torrent client to connect to any peers, but DtecNet filtered out any that weren&#8217;t issued with iiNet IP addresses.</p>
<p>ARN quotes Cobden as <a href="http://www.arnnet.com.au/article/326984/iinet_turns_spotlight_back_afact_investigators">saying</a> this action was &#8220;foolish&#8221; as it slowed download times to several days. As we heard earlier in the case, this led to investigators counting the same infringement more than once.</p>
<p>Last week, Cobden argued that AFACT hadn&#8217;t provided any evidence that iiNet customers had engaged in copyright infringement as they were only sharing small parts of files (such is the nature of BitTorrent), rather than the &#8220;substantial&#8221; parts, as required under the law. In order to prove his point, Cobden went on to cite an earlier copyright case.</p>
<p>In 2002, Australian TV station Channel 9 sued Channel 10 citing infringement under the Copyright Act 1968. Channel 10 had broadcast short sections of Channel 9 programs The Today Show, Who Wants to be a Millionaire, Days of Our Lives and Sale of the New Century in their television show called The Panel. The view was that of the 11 segments played, only 3 were long enough to constitute infringement.</p>
<p>As anti-piracy tracking companies such as DtecNet only record an instance of alleged copyright infringement timed to a single second, Cobden is <a href="http://www.computerworld.com.au/article/326964/afact_v_iinet_isp_draws_tv_copyright_battle">arguing</a> that there is no evidence to prove any &#8220;substantial&#8221; part of any movie was shared by iiNet users.</p>
<p>Cobden went on to insist that in order to confirm that evidence of infringement provided by AFACT was indeed accurate (before passing notices to their customers), it would be necessary for the ISP to breach copyright.</p>
<p>“If one wanted to check the DtecNet evidence and see on a range of IP addresses supplied by iiNet that infringing material was online, the only way to do it would be to use the BitTorrent client like DtecNet did, construct the parameters of the IP address range, locate the file and compare it to details in the spreadsheets,” said Cobden, as quoted by <a href="http://www.itnews.com.au/News/160915,day-20-iinet-cant-vet-afact-copyright-allegations.aspx">ITNews</a>.</p>
<p>Cobden said that if iiNet passed unproven infringement notices to its customers, it would face problems if the account holder disputed the claims. After all, iiNet had only AFACT&#8217;s word that an infringement had been carried out, but absolutely no proof or other information to have a meaningful discussion on the issue.</p>
<p>It is likely that Cobden will finish his closing submissions next Tuesday 24th. The Internet Industry Association’s application to become a ‘friend of the court’ will be heard on the afternoon of that day, bringing the original date forward by two days.</p>
<p>The case will then end either next Wednesday or Thursday, but readers are advised not to hold their breath for the verdict &#8211; it could take several months to arrive.</p>

<p>The case continued in the Federal Court, with iiNet barrister Richard Cobden beginning his closing submissions.</p>
<p>Referring to the allegations by AFACT that it detected around 97,000 instances of copyright infringement carried out by iiNet subscribers, Cobden said that there was actually only sufficient evidence to prove that a single subscriber had carried out any. That individual was the mole planted by AFACT and DtecNet to carry out deliberate &#8216;infringements&#8217; on behalf of the plaintiffs.</p>
<p>iiNet&#8217;s protection under Safe Harbor provisions which limit a carrier&#8217;s liability under the Copyright Act remained intact, since no infringer had been identified other than AFACT&#8217;s own investigator. Since he was authorized by the plaintiffs, he committed no offenses and could not even be accurately categorized as an infringer. On this basis, iiNet did not disconnect him.</p>
<p>Cobden admitted that AFACT&#8217;s method of counting infringements indicated that it&#8217;s possible that from a sample of 20 iiNet users, on average they could have downloaded two to three movies each in the reported monitoring period of 59 weeks.</p>
<p>“It’s clear from the accounts that ultimately the [infringing] activity is likely to account for a very modest percentage of that user’s activity [and] a very modest percentage of their quota,” said Cobden as reported by <a href="http://www.itnews.com.au/News/160466,day-19-iinet-tries-to-show-disbalance-in-studio-demands.aspx">ITNews</a>.</p>
<p>Cobden went on to say that this didn&#8217;t amount to the &#8220;dramatic&#8221; amounts of infringement alleged by AFACT, so there was no evidence that this activity drove the uptake of iiNet high-bandwidth accounts from which the ISP profited.</p>
<p>Disconnecting users on such limited numbers of infringements shown on the sample accounts would have been a disproportionate response, he added.</p>
<p>The iiNet barrister also spoke in detail on iiNet&#8217;s privacy responsibilities under Section 112E of Australia&#8217;s Telecommunications Act, which he said undermined AFACT&#8217;s claims that by not complying with its requests it authorized the infringing activities of its subscribers. <p>iiNet was never legally obliged to deal with AFACT infringement notices, Cobden told the court, noting that the law concerning copyright &#8220;authorization&#8221; does not require any ISP to suspend or terminate a customer&#8217;s account. </p>
<p>Cobden attacked allegations by AFACT that iiNet&#8217;s business model relies on illegal file-sharing, saying that the anti-piracy outfit had a distorted view of the world.</p>
<p>&#8220;In many ways the applicants look at everything that iiNet does entirely through the prism of their own concern for copyright infringement,&#8221; he said, noting that the company had been in business for many years and had simply kept up with offerings from its rivals Telstra and Optus.</p>
<p>&#8220;Once you take that prism away and look at it in terms of business and keeping up-to-date with technologies, and keeping its customers happy, almost every document, internal document, takes on an entirely different reflection,&#8221; he added, as quoted by ZDNet.</p>
<p>Cobden said there was zero evidence to back up AFACT allegations that iiNet users burned downloaded material onto CDs and DVDs and distributed them. This, he <a href="http://www.computerworld.com.au/article/326202/afact_v_iinet_iinet_kicks_off_its_closing_arguments?fp=4194304&#038;fpid=1">said</a>, significantly decreased the number of copyright infringements claimed by AFACT.</p>
<p>iiNet&#8217;s legal team will continue with their closing submissions next week.</p>
