			<content:encoded><![CDATA[<p>There are many ways of trying to influence those who like to share files online. Mostly the influence comes from the likes of the MPAA, RIAA and IFPI, who universally like to &#8216;persuade&#8217; would-be file-sharers with the threat of legal action, actual legal action and propaganda. This approach doesn&#8217;t work.</p>
<p>There are softer approaches available. In 2007 we <a href="http://torrentfreak.com/how-to-stop-warez-pirates-ask-them-nicely/">interviewed</a> Trey Harrison, a developer who instead of threatening the people who cracked his software (&#8217;Salvation&#8217;), actually took the time to engage them instead. The group responsible actually agreed not to crack any more of his software &#8211; quite a result.</p>
<p>Now it is the turn of <a href="http://www.aceteam.cl/">ACE Team</a>, an independent game development studio located in Chile. Their latest game, Zeno Clash, is described as a fighting/first person shooter and was nominated in January as a finalist in the Independent Games Festival competition, in the category of &#8216;Excellence in Visual Art&#8217;.</p>
<p>Of course, none of this can stop a game being pirated and Zeno Clash has turned up on various torrent sites &#8211; nothing out of the ordinary there. However, what is unusual is the developers&#8217; response to the situation. Instead of getting in touch with the sites and demanding that the torrent be removed, ACE Team have decided to tackle would-be pirates head on &#8211; with an appeal posted in the comment sections of the torrent.</p>
<blockquote><p>I&#8217;m one of the developers of Zeno Clash. I would appreciate you read this if you are about to download this file.</p>
<p>Zeno Clash is an independently funded game by a very small and sacrificed group of people. The only way in which we can continue making games like this (or a sequel) is to have good sales.</p>
<p>I am aware that at this moment there is still no demo of the game, but we are working on one which will be available soon.</p>
<p>We cannot do anything to stop piracy of the game (and honestly don&#8217;t intend to do so) but if you are downloading because you wish to try before you buy, I would ask that you purchase the game (and support the independent game development scene) if you enjoy it. We plan on updating Zeno Clash with DLC and continuing support for the game long after it&#8217;s release.</p>

<p>Interestingly, although posted officially on at least one site, this message has been spread by the torrent&#8217;s uploader &#8211; who says he wants to help ACE Team. &#8220;I want to help developers to sell more of this good game, that&#8217;s all,&#8221; he said.</p>
<p>Carlos Bordeu from ACE Team told TorrentFreak, &#8220;Our ‘anti-piracy’ technique is basically the best approach we thought was possible. I think appealing to the conscience of people who download the game is the best we can do. Zeno Clash is not an expensive game. We don’t believe in restrictive DRM.&#8221;</p>
<p>The responses from file-sharers have been pretty positive too &#8211; even from the hardcore over at The Pirate Bay. Here are a few of them &#8211; note, not a &#8220;F**K the MPAA/RIAA&#8221; in sight&#8230;&#8230;</p>
<p>&#8220;It was a touching comment (seriously) I will dl it and see if I like it and then will see if I buy it or not.&#8221;</p>
<p>&#8220;I love how the developers are commenting in here. Thanks a lot for doing it, instead of fighting the piracy.&#8221;</p>
<p>&#8220;I have not bought a game in 5 years, but the attitude of the developers has made me want to purchase their game. Fuck, if I like this game, I&#8217;m gonna buy it!&#8221;</p>
<p>&#8220;Developers like this deserve the money. They didn&#8217;t come on here with a preconceived notion that we are all thieves who don&#8217;t buy our software. I like that, because I and most of the people who use this actually do buy the software and other goods that we enjoy.&#8221;</p>
<p>Carlos told us, &#8220;We honestly think that ‘converting’ the people who download the game into buyers is a much better strategy than trying to fight them. We are also improving the original game, so it will include features and content that people who download the game will probably miss.&#8221;</p>
<p>At the moment downloads of Zeno Clash are pretty low, although it&#8217;s hard to say if the developer&#8217;s message has had anything to do with that, but a fresh approach is always welcome.</p>

			<content:encoded><![CDATA[<p>For those that have been hiding under stone recently, here&#8217;s a summary. In a break from going after alleged games pirates, and what is being viewed by some as a cynical ploy to force &#8217;settlement by embarrassment&#8217;, UK lawyers Davenport Lyons have started targeting people its client DigiProtect says have been pirating their porn on file-sharing networks. DigiProtect&#8217;s company slogan is: &#8220;Turning Piracy Into Profit&#8221;. There can be little doubt that they are trying to do just that.</p>
<p>When we broke the news on <a href="http://torrentfreak.com/anti-piracy-lawyers-start-protecting-gay-gestapo-porn-081118/">18 November</a> we noted that things would be very different this time, particularly when the frailties of the evidence gathering were exposed by the <a href="http://torrentfreak.com/magazine-forces-lawyers-to-drop-p2p-wireless-defense-case-081029/">wrongful accusation</a> of innocent parties.</p>
<p>It didn&#8217;t take long. On 29 November <em>The Guardian</em> <a href="http://www.guardian.co.uk/money/2008/nov/28/internet-porn-bill-mistake">reported</a> that a couple in their sixties were horrified that they had been wrongfully accused of illegally sharing the gay porn movie <em>Army Fuckers</em>.</p>
<p>Many people have commented on these developments, and now it&#8217;s the turn of a sex writer. Placed by Forbes in their <em><a href="http://www.forbes.com/2007/01/23/internet-fame-celebrity-tech-media-cx_de_06webceleb_0123land.html">Web Celeb 25</a></em> and named by Wired in their <em><a href="http://www.wired.com/techbiz/people/multimedia/2008/03/gallery_etech?slide=3&#038;slideView=1">Faces of Innovation 2008</a></em>, Violet Blue is, amongst seemingly a million other things, sex columnist for the San Francisco Chronicle and a best seling author. She also lectures cyber-law classes at UC Berkeley and is a Geek Entertainment TV <a href="http://www.geekentertainment.tv/tag/violetblue/">reporter</a>.</p>
<p>Writing in her blog, Violet Blue headlines her <a href="http://www.tinynibbles.com/blogarchives/2008/11/the-new-face-of-porn-racketeering-money-grabs-riaa-style.html">article</a> &#8220;The New Face of Porn Racketeering?&#8221; Pointing out that this isn&#8217;t just any old porn, but &#8220;a Nazi gay male hardcore flick&#8221;, she goes on:</p>
<blockquote><p>It’s sort of like if someone came up to you on the street and said, ‘hey I think you slandered me in a way that could be really embarrassing to you if anyone found out — but if you give me a couple hundred bucks, I won’t take you to court [where you’d lose even more money].&#8217;</p></blockquote>
<p>Having enjoyed the work of writer Roald Dahl in both written and TV form (Charlie and the Chocolate Factory, James and the Giant Peach and the genius of <a href="http://en.wikipedia.org/wiki/Tales_of_the_Unexpected_(TV_series)">Tales of the Unexpected</a>), Violet&#8217;s description of how she sees this operation reminded me again of something i&#8217;d mused upon earlier.</p>
<p>In 1987, Playboy published a short story by Dahl, entitled <em>The Bookseller</em>. The story features a gentleman called William Buggage who ran a rare book shop in London with his secretary Miss Tottle. Their business model was a little unconventional. Every day the pair read the newspaper obituaries looking for the deaths of married men who had left a wife behind. Armed with this information, they would send invoices to the grieving widows demanding payment for books their husbands had supposedly ordered. The books contained European hardcore pornography and &#8217;sexual deviance&#8217;. Rather than face the ruination and humiliation of being named in court or the press, the widows would quietly pay up.</p>
<p>Those familiar with Dahl&#8217;s work will know that this master story teller is famous for the &#8216;twists&#8217; revealed at the end of his stories, and <em>The Bookseller</em> is no different. In the end, Mr Buggage and Miss Tottle were found out when they tried to get money from a widow who revealed that her husband &#8211; far from quietly titillating himself with porn &#8211; was in fact, blind.</p>
<p>While most people acknowledge that Davenport Lyons have made some pretty big mistakes, no-one is suggesting that they or their clients simply make things up. However, for every set of allegations they get right (around 50% admit infringement and pay up), they absolutely get some wrong. They wouldn&#8217;t have expected that their allegations of sharing Atari&#8217;s Race 07 would&#8217;ve landed on the mat of a pair of pensioners and we will see if they choose to withdraw the allegations that the other pair of pensioners shared <em>Army Fuckers</em>. At the moment they find themselves in the position of the blind man &#8211; in receipt of a sordid accusation against them and absolutely no way of defending themselves.</p>
<p>In a statement to The Guardian, Davenport Lyons said: &#8220;We allow ample opportunity for the recipient to respond, and if they have done nothing wrong they have no reason to be concerned.&#8221;</p>
<p>The truth is much less straightforward. No matter how people defend themselves in the face of these allegations, Davenport Lyons continually argue that they are right, and the accused is wrong. When I pointed out the Dahl story to someone involved in the cases, this was the reply, which is an adaptation of a real response to those who try to plead their innocence:</p>
<blockquote><p>It&#8217;s a shame for Mr. Buggage and Miss Tottle they didn&#8217;t have the knowledge and expertise of messrs Davenport Lyons. They could have easily argued in that case that &#8220;it is irrelevant for the purposes of our clients evidence how the European books of pornography and sexual deviance (&#8221;the Work&#8221;) came to be acquired in your blind late husband&#8217;s name. What our client&#8217;s evidence shows is that the Work was made available from an Internet connection registered in your late blind husband&#8217;s name on a certain date and time&#8221;</p></blockquote>
<p>But while there are certain similarities with Dahl&#8217;s story, one point appears entirely mirrored. While the widows in <em>The Bookseller</em> pay up to avoid appearing in the press, those wrongfully accused by Davenport Lyons are going to the press for protection. Those that don&#8217;t have age on their side don&#8217;t find the going quite so easy.</p>

			<content:encoded><![CDATA[<p><img src="http://torrentfreak.com//images/tpb.jpg" align="right" alt="pirate bay hacker" />It turns out that the MPAA will do pretty much anything to obtain information about BitTorrent sites and its users. Back in 2006, they <a href="http://news.com.com/2100-1030_3-6076665.html?part=rss&#038;tag=6076665&#038;subj=news">made a deal</a> with a &#8220;hacker&#8221;, better known as Robert Anderson, to steal e-mail correspondence and trade secrets from TorrentSpy. </p>
<p>The hacker later admitted that this was indeed true, and in a surprising turn of events, he switched sides, and <a href="http://torrentfreak.com/mpaa-hacker-now-working-with-torrentspy/">joined TorrentSpy</a>. The court case between the MPAA and TorrentSpy eventually led to the <a href="http://torrentfreak.com/torrentspy-slapped-110-million-080507/">downfall of TorrentSpy</a>, but it turned out that the MPAA was also interested in intel on The Pirate Bay.</p>
<p><a href="http://news.cnet.com/8301-1023_3-9999018-93.html">Cnet cites</a> court documents showing that Anderson wrote to the MPAA: &#8220;We can provide the names, address, and phone (numbers) of the owners of Torrentspy.com and Thepiratebay.org &#8212; along with evidence, including correspondence between the two companies.&#8221;</p>
<p>In addition, the court documents reveal that MPAA&#8217;s Dean Garfield stated: &#8220;We were going to get information about the location and identity of the people who were running Torrentspy, as well as information related to a general conspiracy and relationship between Torrentspy and a number of other prominent services including ThePirateBay.&#8221; </p>
<p>I a response to the news, <a href="http://torrentfreak.com/the-pirate-bay/">Pirate Bay co-founder</a> Peter Sunde told TorrentFreak: &#8220;We&#8217;re very open with what we do. I think the e-mails between us and Justin would be something along the lines with &#8220;what&#8217;s up with the scraper that is going berserk&#8221; or &#8220;what the fuck is up with that filerights-shit?&#8221;.. I think it&#8217;s amazingly funny if the MPAA bought information like that, expensively, and against the US law. Only proves their stupidity and that they have no case.&#8221;</p>
<p>The Pirate Bay has always been one of the main targets of the MPAA. In 2006, John Malcolm, Executive Vice President of the MPAA <a href="http://torrentfreak.com//images/pirate_mpa.pdf">wrote a letter</a> to Sweden&#8217;s State Secretary in which he urged the authorities to take action against the site: &#8220;It is certainly not in Sweden&#8217;s best interests to earn a reputation among other nations and trading partners as a place where utter lawlessness with respect to intellectual property rights is tolerated.&#8221;</p>
<p>It is of course interesting to see that the MPAA is interested in the identities of the Pirate Bay founders, but they could have easily done a Google search, because that info is pretty much public information. I guess they rather use a hacker.</p>
