An NBC representative explained that the network will only cover the highlights because people “are not dying to watch lots of long-form content on a 13-inch screen.” However, at the same time NBC contradicts itself by announcing that it will do all it can to prevent people from accessing unauthorized live feeds or downloads of Olympic broadcasts.

While NBC doesn’t believe there is much demand for live coverage, it will do all it can to prevent the ‘few’ people who do from downloading or streaming the events online. “Our aim is to make access to pirated material inconvenient, low quality and hard to find,” said Rick Cotton, NBC’s Executive Vice President commenting on their Olympic mission.

Once again one of the major entertainment industry outfits has got it entirely wrong. If NBC really wants to prevent piracy they have to offer at least some sort of alternative. Cutting 2,200 hours of live web coverage back to just a few hundred is certainly not going to help in stopping piracy.

NBC reportedly has teamed up with Ustream and Justin.tv, two popular live streaming sites, to use filtering schemes in order to prevent illegal broadcasts. However, it is inevitable that they won’t be able to stop them all since there are dozens of live streaming sites. Preventing torrents from being uploaded will turn out to be even more problematic for the network.

During the Beijing Olympics two years ago, The International Olympic Committee (IOC) asked for “assistance” from the Swedish government with preventing video clips from the Olympics in Beijing being shared via The Pirate Bay. This didn’t help much and during the weeks that followed millions of people continued to download broadcasts of Olympic events.

We assume that in the coming weeks most events will again appear online, despite NBC’s efforts to prevent the Olympics from being pirated.

In these previous cases the pirated films were only on display in the stores, but the multinational electronics company LG takes it a step further. The company is selling TVs that have the functionality to accept a connection from an external USB device. This allows customers to enjoy pictures, music and videos directly on their TVs, all with a piracy endorsement from the manufacturer.

In the packaged English language manual, LG does not try to obfuscate the true purpose of this nifty USB feature – playing pirated movies. In the picture below, LG included pirated versions of The Incredibles and The Aviator, while explaining how easy it is to play the films directly on a TV.

LG seems to understand perfectly what customers want, but we doubt that the movie studios will be very excited about this piracy endorsement from the Koreans. Whether the pirated films were included intentionally is unknown, we expect that a company employee simply downloaded the movies off a file-sharing service out of habit or convenience.

Just over a week after becoming available online in early November 2009, Ink pushed into TorrentFreak’s chart of top 10 most pirated movies with an incredible 400,000 downloads.

Unlike the majority of Hollywood movie bosses, the creators of Ink – Jamin and Kiowa Winans – decided to embrace their new-found pirate fans after the extra publicity pushed the movie to 16th place on IMDb’s movie meter and boosted DVD and Blu-ray sales. Kiowa wrote to TorrentFreak and said that the movie ending up on BitTorrent was “absolutely” the best thing that could’ve happened to it.

Now, Lars Sobiraj from German news outlet Gulli has interviewed Kiowa to see how things have progressed a couple of months on from the initial excitement.

As previously reported, Ink has been downloaded hundreds of thousands of times, so just how many of those translated into real-world sales? Kiowa says that is really hard to put an exact figure on that – they haven’t sold a DVD or Blu-ray for every download but sales have unquestionably gone up.

Money also came in from other routes too. As the movie gained popularity on BitTorrent, many Ink downloaders suggested that there should be a ‘donate’ button on the movie’s website so that fans could give money freely.

“We put that [donation link] up at the urging of some of the downloaders with the message ‘if you have watched Ink online for free and would like to contribute what you can, click here’,” Kiowa explains.

“Guess what country has been the most generous? Germany! Germans have been twice as generous as Americans so… thank you Germany. We have also shipped a lot of Deluxe Bundle fan packs to Germany so Ink seems to be a big hit there.”

Gulli asked Kiowa if she felt the movie had fallen victim to piracy, a notion she strongly denies.

“I think to say victim is to characterize piracy as an all-together awful thing. The piracy of Ink is unquestionably responsible for its popularity around the world. Sure our trailers have been out for over a year and have had plenty of views outside the US, but we think that 70% of the illegal downloads are coming from outside of the US and we do get a good number of international buyers at our online store every day,” she explained.

Before Ink was pirated, the movie’s IMDb rating was a lowly 12,991. As reported in our earlier article, it reached 16 and even moved up to the 14th position at one stage. Incredibly it has stayed as one of the top 200 movies in the world for the last two months, a feat that would have been impossible without the extra exposure.

Looking forward to future distribution models, Kiowa feels that everything will change during the next 10 years as people demand instant and simple access to media and their TVs and computers merge together into one device.

“That said, I’m not sure what the revenue model will be for films,” she notes. “Hollywood producers are quickly finding out that the instant films start circulating on DVD they will wind up on torrent sites.”

Kiowa broadly puts BitTorrent users into two camps – those who want media in an instant and those who want it for free. Noting that there are those who fall into both categories, she acknowledges the challenges that lie ahead in figuring out a way to make this situation bring revenue to the filmmakers.

“I think a reasonably-priced instant download the moment the movie becomes available would largely cure the piracy issue so we will see how it all shakes out over the next several years,” she adds.

As most observers are aware, many music and movie companies consider torrent sites as entities to be crushed and in recent years have set about a strategy to achieve that. Gulli asked Kiowa if she believes that is the correct strategy to deal with the problem.

While one could argue that non-physical digital formats such as MP3 are part of the reason that piracy has flourished in recent years, Kiowa feels that the invention of the iPod has helped to reduce piracy, largely through the existence of competition from one service – iTunes. The movie industry needs to catch up.

“Until the equivalent of the iPod is invented for film or long-format video files I think that piracy is going to be a huge battle ground, one in which I doubt Hollywood will win,” Kiowa predicts.

“There is always a smarter programmer out there that can move faster than bureaucracy. The film industry really needs to set its sights on overhauling its distribution system. Right now there are horrible things like region-coded DVDs that tie up a film’s rights in various countries and this is what has made the film business plenty of money over the years.”

The industry needs to move its thinking to encompass global distribution, says Kiowa, not concentrate on pushing movies out to dozens of separate territories.

“We are going to keep all the rights to Ink and not give them away country-by-country so that when that iPod-for-movies emerges Ink can be the first film that debuts to the whole world,” she says, adding: “That is the hope anyway.”

Looking to the future, partner Jamin is currently working on scripts for two new films, one a sci-fi psychological thriller called ‘The Frame’ and another a sci-fi fantasy called ‘Myth of Man’.

“For the time being we’re just really happy that Ink is rolling along and gaining fans around the world. How ever people come to the film, we’re just happy that they are watching it, Kiowa concludes.

“As Jamin likes to say, the battle of independent films is not piracy, it’s obscurity. Hey – at least we’re winning that one!”

There is no doubt that the final season of the show will again be a strong contender in 2010’s list. However, it already has the honor of becoming the first TV-show to leak online after being recorded using a webcam on a tropical beach.

The copy of the first episode that appeared online two days ago was recorded during a live screening hosted by ABC at an Oahu beach. Well over 10,000 fans of the show attended the screening and at least one of them decided to record it via their laptop webcam.

The recording was posted online a few hours later and is now available on virtually all BitTorrent sites. The video quality is ‘reasonable’ according to initial reports from people who downloaded the file. The sound quality on the other hand is not that good, which is not really a surprise considering that thousands of people were present.

The cammed version of the episode has been downloaded a little over 25,000 times on BitTorrent thus far, which is really low and unlikely to cause ABC to lose any viewers tonight. If anything, it might serve as free publicity reminding people that the new season is starting soon.

From the torrent site comments we indeed learn that the majority of fans say they would prefer to see the episode in full quality on TV, or download a copy on BitTorrent a few hours later. In this case, most people seem to prefer quality over early access, which must be a comfort to the makers of the show.

An insider at a US base in Japan has been in touch with TorrentFreak to tell us of a new initiative underway which is being operated by the Department of Defense. The campaign is running in overseas bases and is targeting members of the military currently using BitTorrent and other P2P software to obtain media.

While millions of regular US citizens also use file-sharing to acquire tv shows, movies and music, we’re told that military personnel overseas have a unique problem – their physical location excludes them from obtaining media from US-based services.

“For years many of us have spent time and money, hand over fist, looking for ways to work around IP blocks placed by companies operating from the states to access services such as NetFlix, Amazon, and others, to enjoy the same level of access as anyone living in the US does,” the insider told TorrentFreak.

“We have offered money to the companies in exchange for lifting the blocks and have offered up information as to how to allow military members into their content while strictly enforcing the contract,” he added.

However, the pleas to the various media companies appear to have fallen on deaf ears. Our contact believes that the content providers must have no interest in the business available from overseas military personnel, as they continue to block them from accessing content legitimately.

In a response to this inaction, we’re told that US military personnel have stepped up their campaign to download as much content as they can using BitTorrent.

“We have sent letters to the RIAA and the MPAA repeatedly letting them know that our downloads are a direct representation of their failure to allow us to be good consumers as others in the US can be,” our military insider explained.

Of course, the response from these groups has been predictable. On a daily basis, the MPAA and RIAA send copyright notices to military personnel via their base ISPs. In turn, the personnel are threatened with account suspension and in serious cases, disconnection.

“Sucks, but all of us have kept doing it [file-sharing] as we have made every reasonable attempt to gain access to the content legally as any person living on US sovereign ground can,” says our clearly frustrated contact.

While there is an apparent crackdown on online file-sharing, there is an interesting footnote to this story. TorrentFreak is informed that when personnel are deployed, they have access to sanctioned “Morale” hard drives which are allegedly filled with copyright materials acquired by “nefarious” means, and available for anyone to download and keep.

Their decision to prevent BitTorrent users from sharing content over their network has sparked the Net Neutrality debate, resulting in an FCC investigation and various lawsuits. One of these suits was settled last month.

Comcast agreed to put $16m into a fund to pay BitTorrent users that were affected by the ‘network management’ which made it impossible for them to share files after their downloads had completed.

Each of the affected users can now claim their $16 in damages, but those who do are required to state to the Court, under penalty of perjury, that their use of BitTorrent “was for lawful purpose consistent with applicable copyright and other laws.” This required statement came as an unpleasant surprise to many affected Comcast users.

“Am I supposed to be able to remember everything I downloaded during that period, and be cognizant of the copyright status of those items not only then, but now?” one worried Comcast user told TorrentFreak. “I certainly do not think that sixteen dollars is enough incentive to possibly suffer the penalties of committing unwitting federal perjury.”

Other Comcast users will have to agree with this assessment, simply because it is often not clear when one is violating copyright law. For example, there is still a large portion of BitTorrent users who think that downloading a TV-show that they could have watched for free on TV, is not a crime.

It wouldn’t surprise us if a large portion of the $16 million fund is left unclaimed because of this required statement, saving Comcast a significant amount of money.

That leads us to the question why was included in the first place. It somehow suggests that Comcast was attempting to stop copyright infringement with their throttling practices, aside from the network management purpose it served. Maybe they just want to hang on to their money.

Whatever the motivation to include this option, it is completely irrelevant to the case itself. Comcast has never used copyright infringement as a justification for stopping BitTorrent traffic, so the lawfulness of the traffic should not be an issue.

Downloading music illegally, or watching a movie online without paying, was okay with a much smaller group, 18 and 13 percent respectively.

In fact, hiding your online porn viewing habits from your spouse is still more morally accepted than downloading a movie or music album without paying for it. Of the respondents, 18 percent thought that is was fine to secretly watch porn in a marriage.

At first sight the results of the survey are not really that surprising. Downloading music and movies without consent from the copyright holders is in violation of the local laws in New Zealand and watching porn obviously isn’t. Still, a closer look at the findings reveals some remarkable inconsistencies.

Firstly, most of the adult entertainment is actually viewed on sites that are dominated by copyright infringing content. So, many of the people who watch porn online are actually pirating as well, without realizing it.

Another remarkable finding was that people seem to be fine with copyright infringement if it’s on a video streaming site such as YouTube. Of all respondents, 31 percent said that it is morally acceptable to stream copyrighted TV-shows on YouTube, while only 13 percent believed that downloading copyrighted video was morally okay.

Thus, streaming copyrighted content is somehow perceived as more acceptable for some odd reason. The 5 percent difference between the moral acceptability of music and video downloading is another mystery that is left unexplained.

Overall, this survey shows how malleable peoples’ perceptions are when it comes to copyright issues online, with approval rates swaying back and forth between different types of media and the various distribution platforms.

It is difficult to downplay this success. BREIN must have been absolutely delighted that all their hard work and investment had paid off, stopping Mininova in its tracks just a short time after the site had served up its 10 billionth torrent.

The Dutch anti-piracy group also had a fairly significant victory over The Pirate Bay. In common with the earlier decision against Mininova, a Dutch Court ruled that The Pirate Bay has to remove a list of torrents linking to copyrighted works by 1st March 2010.

While it had a win over Mininova and a limited win over The Pirate Bay, both of which attracted mountains of press, it seems the Netherlands-based group has been hiding its biggest successes from almost everyone.

According to figures just released by BREIN, the group shut down a staggering 615 “illegal websites” in 2009 and, apparently, BitTorrent sites made up the majority.

TorrentFreak knew that BREIN had shut down a handful of torrent sites, 19 very small sites for example (plus TorrentVault which was targeted but still operates today via Sweden), but we were absolutely oblivious to the sheer numbers now being claimed.

Total BitTorrent sites BREIN said it closed down in 2009 – a staggering 393.

And it doesn’t stop there. The anti-piracy group also says it shut down 35 eD2K servers, 38 streaming video sites and 14 Usenet portals/NZB sites.

While these closures would have no doubt been very noticeable for those that used the sites and services in question, one has to question how many people were actually using them. Unfortunately, we’re a little bit in the dark, since aside from the sites we mentioned above, a grand total of zero emails flooded into TorrentFreak during 2009 requesting information on the other several hundred closures.

So, if you know any of those we haven’t listed, please post them in the comments. We’d love to know exactly how much damage these closures did to BitTorrent. Our suspicions at this point are, not very much at all.

His first website, Moneysavingexpert.com, was founded in 2003 for around £100 but has since grown to receive around 7.5 million users each month. Lewis’s new venture, Tunechecker, is designed to help music fans get the best deal from online music stores.

Recent research by the site has revealed some alarming differences in prices for exactly the same products. Downloading all of 2009’s top 40 albums from the cheapest retailers would cost £864 less than if they were all bought from iTunes. That’s a lot of money.

When looking at singles, specifically last week’s number 1 record in the UK, the cheapest retailer offers the track for 29p, while iTunes wants 99p – nearly two and a half times more. The cheapest retailer sells Michael Bublé’s number 1 album at £5, while the iTunes price is £7.99.

Not surprisingly, recent research by TorrentFreak and millions of users worldwide reveals that the biggest savings are to be made on file-sharing networks, where all tracks by all artists, big and small, on any label, in any country, are to be found for free.

These are savings that Lewis can only dream about, but being realistic, most people recognize that the labels, musicians and the companies behind them have to earn a living. Lewis notes, as we did yesterday, twice, that the solution lies with competing with piracy.

“The music industry needs to wake up and embrace price competition. it’s facing annihilation from illegally download tracks, yet there are still remnants of an attitude that price doesn’t make a difference.

“If it promoted cheaper, legit music it’d mean fewer illegal downloads.”

Yet while millions flock to file-sharing networks and the knowledge on how to use them continues to spread, there is still a huge and largely untapped market out there, eager to funnel money through the official channels.

“Since we launched the TuneChecker.com a month ago we’ve had 400,000 users, an indication there’s a real appetite to download music at the lowest price,” concludes Lewis.

We get the feeling it’s is going to be a recurring theme in 2010. Pressurizing ISPs, monitoring Internet users and throwing around meaningless warnings is going to do little to bring customers back to the music industry.

The solution, the only solution, is good product, available now – right now, at a fair price. But that’s not going to happen, not for a long time yet.

It might not come as a surprise to most people, but Bono’s wish is a little out of touch with reality. By mimicking the words of the record label bosses high up the food chain of the music industry, he fails to see where the real problem lies.

Over the last ten years the RIAA mounted the most aggressive anti-piracy campaign against file-sharers seen anywhere, collecting millions in settlements from thousands of households. The songwriters didn’t benefit much from that.

The RIAA also collected as much as $400m from settlements from the likes of Napster, KaZaA and Bolt. That money was supposed to go to the artists whose rights had been allegedly infringed upon, but the labels weren’t that keen to hand any of that over either, even when faced with the threat of lawsuits from the artists themselves.

The major labels, Warner, Sony, EMI and Universal, are currently being sued by another group of artists over sales of compilation albums featuring their music for which they haven’t been given a cent. The money they’re owed collectively is a staggering $6 billion. Looks like the ‘little guy’ is in trouble without the assistance of file-sharing.

While one set of corporates ripping off musicians doesn’t get a mention in Bono’s top 10, other supposed evil-doers do. Singing from the same sheet as his paymasters at Universal, Bono also takes aim at ISPs, claiming that their “swollen” profits “perfectly mirror” the lost revenues in the music business.

This “blaming of the messenger” will be a continuing theme in the next decade, and one which Bono dwells on for a moment, noting that if it’s possible to crack down on online child pornography in the US, and China has the ability to suppress online dissent, then it’s also perfectly possible to track downloads of copyrighted music.

Well, yes, of course it is. That’s been perfectly possible for the last decade, but what good does it do? The RIAA has largely given up suing individuals and even when countries like France pass fairly draconian legislation to have people removed from the Internet for sharing content, there are plenty of ways around it.

“The only thing protecting the movie and TV industries from the fate that has befallen music and indeed the newspaper business is the size of the files,” says Bono. “The immutable laws of bandwidth tell us we’re just a few years away from being able to download an entire season of “24” in 24 seconds. Many will expect to get it free.”

While it’s true that we are only a couple of years away from being to download huge amounts of data in just a few seconds and that will have an impact on the volumes of movie and TV show downloading, we can’t actually watch a full season of “24″ in 24 seconds. Real-time will suffice, though.

Right at this moment via sites like Watch-Movies-Online, it’s possible to view the very latest movies instantaneously. With the new streaming functionality available in the latest beta of uTorrent, the same can be achieved via torrent swarms.

Bono, the future is now. Suing Internet users does not work and blaming the ISPs will only prove counter-productive. Monitoring the Internet will prove futile. The only way to deal with piracy is to compete with it.

As we pointed out in our article covering the most downloaded TV shows of 2009, there is huge interest in on-demand TV and there are millions of viewers that can potentially bring in millions of dollars in revenue.

The growth in unauthorized downloading of TV shows and other media is a sign that consumers want something currently unavailable through the official channels, and while price is a factor, it is not necessarily all about ‘free’.

Serving the insatiable demand during the next decade at a reasonable price should be the main aim of the media industry, as locking down the Internet will not only suffocate their customers, but also their own business. That definitely won’t help the songwriters.

When ‘caught’ uploading copyright works for the first time, the owner of the Internet connection used for the alleged infringement will receive an email warning. On allegations of a second offense, a physical letter will drop through the door. On the the third, the account holder will be summoned to appear before a judge who will have the power to fine, or even disconnect them from the Internet.

French senator Michel Thiolliere has told the BBC that the so-called Hadopi legislation will have the desired effect, with nearly everyone warned a second time abandoning illegal file-sharing for good.

“What we think is that after the first message… about two-thirds of the people (will) stop their illegal usages of the internet,” he explained

“After the second message more than 95% will finish with that bad usage.”

It is, however, much more likely that after getting a first warning, or even before, French Internet users will try to find a way round this system. They will discover that it’s surprisingly easy.

MP3 Search Engines

One of the simplest ways to find music online is to use an MP3 search engine. That won’t be difficult as there are dozens to choose from. Sites like Skreemr, Songza, beeMP3, MP3Realm and AirMP3 are very simple to use and since there is no uploading, they drive a cart and horses through Hadopi. For those who don’t mind getting their hands dirty, Google offers similar functionality with their filetype: search operator.

Direct Downloads

During 2008 and 2009, the continued rise of blogs and forums that link to music, movies, tv shows and games stored on so-called cyberlocker sites was difficult to ignore. Although links can get taken down very quickly by copyright holders, they are often replaced just as swiftly by the communities that frequent such sites. The international music industry is particularly worried about the phenomenon, as tracking those that download from sites such as Rapidshare and MegaUpload is completely impractical.

Of course there are also perfectly legal alternatives, such as the excellent Jamendo.

Streaming Music and Video

While there are dozens of sites to visit directly, for those who really can’t be bothered to look any further and don’t mind closing a couple of slightly annoying popups, OVGuide is a huge portal to thousands of movies, TV shows and general video. With the assistance of the DivX plug-in, most content can be streamed directly in compatible web-browsers.

Music fans who don’t mind to stream tracks in their web browser actually have a few dozen legal alternatives. Grooveshark is one of the most elaborate music services. It holds more content than the average download store, supports playlists and it will roll out an iPhone app.

Premium options

Overseas MP3 Sites

Just over the English Channel from France lies the UK. Research carried out there recently by the BPI indicated that usage of MP3 pay sites had increased by 47%. While users do have to hand over money to use these services, at a tiny fraction of prices they would pay in their homeland they prove attractive to those on a tight budget.

Newsgroups

Using Usenet, or newsgroups as they are commonly known, is one of the most secure ways of downloading movies, TV shows, music and video games.

While the learning curve on Usenet is considered by many to be quite steep, once an individual discovers .NZB files – the .torrent of the newsgroup world – everything is hugely simplified. Within seconds of starting a transfer, the user’s connection will be completely maxed-out.

On a practical basis, and certainly as far as Hadopi is concerned, paying a few euros each month for a decent newsgroup account means that French citizens need never fear being disconnected from the Internet. Indeed, not even the first warning email will arrive.

Anonymous VPN

While the above options require that Internet users modify their behaviors, by spending a few euros a month on an anonymous VPN account they won’t have to change any of their habits at all. They can continue to use BitTorrent, eD2K or any other P2P method of file-sharing.

Once subscribed to a service such as Netherlands-based ItsHidden (who also offer a free, but speed-limited service), Hadopi file-sharing investigators will believe that the user behind that IP address is from another country and simply move on.

As the failed and now largely abandoned campaign against file-sharers in the United States proved, scare tactics simply don’t work. There are millions of file-sharers in France and many will simply carry on their activities in the belief that the odds of being caught are extremely slim.

And they would be absolutely right.

The new year starts without The Pirate Bay tracker, which was closed in November, and also without Mininova, which saw its site being censored and stripped down by a Dutch court. To counter these losses, several public tracker-only services have made a comeback along with multiple torrent-only storage sites.

Where do we go from here? Let’s make some predictions.

Prediction 1: The Pirate Bay will cease to offer torrent links

After closing its tracker in 2009, The Pirate Bay will further evolve by removing all torrents from its index in the new year. The site will be reduced to a BitTorrent platform that no longer stores torrent files. Users will still be able to submit torrents through a third party service such as Torrage, but instead of linking to these torrent files, The Pirate Bay will list only Magnet links.

During the second half of 2010, The Pirate Bay four will appear before the Appeal Court. They will be found ‘not guilty’ and walk away free. Shortly after this victory in court, Pirate Bay’s YouTube killer The Video Bay will be released to the public.

Prediction 2: A BitTorrent client will be dragged to court

In 2009, the entertainment industry and authorities took legal action against various BitTorrent users and numerous sites. They left BitTorrent clients alone, but this will change in the new year. A coalition of copyright holders will file a lawsuit against one of the major BitTorrent clients, in an attempt to stop the ever increasing piracy rate.

The copyright holders will argue that BitTorrent clients play a vital role in downloading and uploading copyrighted files, and that the software is assisting in copyright infringement. They will demand that the torrent client implements a filtering mechanism to prevent users from downloading movies, music or games without the permission of the copyright holder.

Prediction 3: More people will use BitTorrent anonymously

2010 is the year where copyright holders gain more control over the Internet. Three-strikes legislation will be rolled out in various countries and global trade agreements such as ACTA will result in humongous fines for casual downloaders.

As a result of this newly founded Internet police state, millions of BitTorrent users will take measures to hide their identities online. By the end of the year, a quarter of all BitTorrent users will use a VPN service or similar anonymity software, with another quarter looking to do so in the following 12 months. This will make new legislation ineffective, and lead to further lobbying by the entertainment industry for even harsher anti-piracy measures.

This cycle will repeat itself until the entertainment industry decides to innovate.

Prediction 4: BitTorrent (live) streaming will take off

Advances in technology and growing broadband penetration have brought us to a point where BitTorrent-powered streaming solutions have become reality. BitTorrent inventor Bram Cohen is working on a streaming implementation and experiments have shown that it is possible to stream high definition content.

In the second half of 2010, the first BitTorrent-powered YouTube competitors will be launched. These new BitTorrent sites will mainly offer streams of pirated movies and TV-shows. Live BitTorrent streaming will gain worldwide traction during the 2010 soccer world cup in South Africa. In the second half of the year, commercial implementations will follow, allowing broadcasters to stream live content at zero cost.

Prediction 5: uTorrent will become a resource hog

In 2010, uTorrent will be transformed from a lightweight BitTorrent application into a media portal similar to its nemesis, Vuze. Unlike Vuze, BitTorrent Inc. will continue to offer a lightweight uTorrent version for the the people who don’t want to make this switch, preventing a revolt among conservative uTorrent users.

The new uTorrent will be a resource hog, featuring a full blown search engine, video conversion, iTunes integration and a video player. The browser interface will allow uTorrent to be put on set-top boxes, which opens up the possibility for BitTorrent Inc. to reopen a new and improved version of their video store that can be easily hooked up to TVs.

Due to the changes, uTorrent will obviously have to remove its tagline ‘a (very) tiny BitTorrent client.’

The rise of unauthorized downloading of TV-shows is a signal that customers want something that is not available through other channels. Availability seems to be the key issue why people turn to BitTorrent, and this is also reflected in the fact that most downloads occur from countries where the show has yet to air on TV.

Outside the US, fans sometimes have to wait for weeks or even months before the show airs on TV in their own country. Many of them are simply not that patient or willing to torture themselves, and turn to BitTorrent in desperation.

Despite massive piracy of TV-shows, there are plenty of opportunities for distributors and broadcasters to win viewers back. The piracy figures simply show that TV viewing habits are changing. There is a huge interest in on-demand TV and there are millions of viewers that can potentially bring in millions of dollars in revenue.

Below we have compiled a list of the most downloaded TV-shows, together with the viewer average for TV in the US, based on data from Nielsen. The data for the top 10 is collected by TorrentFreak from several sources, including reports from all public BitTorrent trackers. All the data is carefully checked and possible inaccuracies are systematically corrected.

Suprnova was founded by Andrej Preston, a Slovenian teenager better known as Sloncek, who started the site as a fun project to show off to some friends on IRC. The site started off with a very primitive setup, hosted on a Linux box at Sloncek’s home.

In the weeks that followed, word of the “Universal BitTorrent Source” spread like wildfire. It was no surprise that the traffic generated by Suprnova quickly maxed out the meager 16kb/s upload capacity Sloncek had at home.

The increased popularity of Suprnova came around the same time as other torrent sites like donkax.com, bytemonsoon.com and torrentse.cx, decided to quit. These sites were more or less forced to go offline, either due to bandwidth constraints or cease and desist letters. But Suprnova made it very clear that it wasn’t going anywhere.

Suprnova continued to grow, and Sloncek spent most of the time looking for mirrors to guarantee that the site stayed up. At its peak it indexed almost 60,000 torrents and served around 1.5 million visitors per day. Suprnova had a very active community, and its forum was among the biggest on the Internet.

In November 2004, Suprnova’s ISP told Sloncek that the servers had been taken into custody by the Slovenian police. The raid was initiated by the French anti-piracy lobby RetSpan. The police never contacted Sloncek about this personally, but it was a sign that things were about to change.

Around the same time, Reuters wrote about Sloncek and his rapidly growing site in one of their articles, which soon after spread out to the Slovenian press.

This was the turning point for Sloncek. He later said: “So I ended up reading about myself in Slovenian newspapers. And right about that time, I had a feeling something was wrong. I do not really know what the feeling was or where it was coming from, but I decided it was time to take Suprnova.org offline.”

Sloncek eventually pulled the plug on December 19, 2004, which marked the end of an era, and the beginning of a new one.

The fall of Suprnova resulted in an avalanche of new sites that aimed to fill the gap. Among these new sites was Mininova, which despite its name outgrew Suprnova within a year, establishing itself as one of the leading torrent sites for nearly five years.

In 2007, Suprnova returned to the BitTorrent stage, resurrected by the folks behind The Pirate Bay. The site never even came close to what it was though, and as of today it is just serving a few torrents a day to some lost souls.

Sloncek himself moved on with his life. He moved to San Francisco in 2007 where he’s attending the Academy of Art University. He didn’t cut his BitTorrent roots completely though, as he’s currently directing TorrentFreak TV in his spare time.

On Christmas day the idea was born and just a few hours later the tracker named ‘BaconBits‘ was already up and running, with the first torrents being uploaded by an enthusiastic crowd. The day after Christmas the number of users who signed up at BaconBits had already exceeded 2000, and more were coming in nearly every minute.

When the tracker’s founding member deemed that BaconBits was stable enough, an announcement was made on Reddit under the title “Sharing is caring: Late Christmas Present, Fresh BitTorrent Tracker For Redditors,” which was upvoted by nearly a thousand Redditors.

In the announcement the tracker staffers explained that BaconBits is meant to be a private BitTorrent tracker for established Reddit users only. “The site will only accept Reddit users who have been signed up for at least 3 months, have at least 100 comment karma, and have at least 1 link Karma,” they explain.

Reddit users who meet these requirements can send a private message to the user baconbitsinvites on Reddit, and if deemed eligible, will then be invited to join the tracker.

Unlike most other trackers, BaconBits does not have any ratio requirements, instead trusting that the Reddit-sourced community will be sufficiently self-motivated to share. “The site does not require a minimum ratio, we trust that most Reddit users will upload as much as possible,” they say.

Currently the site has more than 1300 torrents being shared by nearly 3500 peers, 3000 of which are seeding.

The swift emergence of the tracker and its democratic nature are not the only surprises. Ironically, a vote among the site’s users has resulted in a ban on adult content. In contrast with the “no censorship” stories that often surface on the Reddit frontpage, the community decided to censor itself, much like the Australian democracy did.

The enthusiasm of the people involved in the project is skyrocketing and appears to be highly contagious, with dozens of people contributing to the site’s overnight success. That said, the emergence of the tracker came about so rapidly that it may cause problems in the long run.

Talking to some of the staff members, TorrentFreak learned that not all of the people involved fully understand the risks involved with running a BitTorrent tracker. Some staff members are openly uploading copyrighted files under the same name they use on Reddit, and hosting and payment issues weren’t thought through beforehand.

With operators of other BitTorrent trackers being arrested left and right, a bit more caution might be appropriate here or the ‘fun’ will end prematurely.

Nitpicking aside, BaconBits may have set a new trend where social networks and communities form the basis of private BitTorrent trackers. Niche BitTorrent trackers that specialize in specific types of movies, TV-shows or musical genres have grown significantly throughout 2009, and community based trackers may become a new niche.

Unlike the Pirate Bay operators, Oliver didn’t host any torrents on his website. No, he committed the crime of dressing in clothing similar to that worn by The Village People thirty years ago, but without their permission.

In a promo trailer for the show, Jamie’s American Road Trip, the British cook dressed up as the 70’s style icons. The clip ran on TV, accompanied with a poster campaign in the London Underground, all featuring Jamie dressed up as each of the six members of the hit disco band.

According to the Web Sheriff, Jamie Oliver’s actions are blatant trademark infringement, seriously hurting the revenues of the Indian chief, cowboy and the four other members of the band. “The Village People are still a huge, multimillion-dollar global business,” the Sheriff commented.

Much like the Pirate Bay, Channel 4, the broadcaster of Jamie’s show, is not impressed by the Sheriffs threats. “We are confident that the promotional campaign for Jamie’s American Road Trip does not infringe any copyright/trademark rights which the Village People may have. No parties have received a formal legal claim from the Village People and, if one is received, it will be vigorously defended,” a Channel 4 spokesperson said.

If the case does indeed come to court, it could be risky for the Web Sheriff to dress up in his usual outfit, as that is more than likely trademarked by a third party who might also wish to issue similar frivolous legal threats.
