At the 2010 event held in early January, Johnny Depp fought off Brad Pitt, Hugh Jackman, Robert Pattinson and Ryan Reynolds to be come Favorite Movie Actor, with Sandra Bullock triumphing in the Favorite Movie Actress category.

In music, Lady GaGa was awarded Favorite Pop Artist, with Favorite Female Artist going to Taylor Swift and Favorite Male Artist going to Keith Urban. During his acceptance speech, Urban had quite a surprise for his file-sharing fans.

After thanking people for voting, those watching the show at home and people who took the time to see him on tour, Urban gave credit to his fan club, Monkeyville, whose members work tirelessly to get his music out there.

“I don’t even care if you download it [my music] illegally, give it to your friends, I really don’t care,” said Urban. “I love the people to hear the music and come out and see us play live.”

It seems that Urban understands the positive influence the free download can have on his tour ticket sales. But speaking with Tennessean.com, Urban now says that his words came out all wrong.

“What I said came out nothing like I meant,” explained Urban. “I was referring to the old days when you’d buy a record, do a cassette tape and give it to your girlfriend, and then maybe she likes it and becomes a fan.”

That’ll be copying music and sharing it round then, just 1980’s style. Nevertheless, Urban is sure of his stance now.

“For the record, I absolutely care about my music not being taken for free,” he added. “But I love when people are passionate and want to turn friends on to music.”

Urban is on RIAA-member Capitol Records Nashville and they cannot have appreciated his comments one little bit, but apparently it was the show format that caused Urban to say something he didn’t mean.

“I’ve never done an awards show where they seem to let you talk infinitely,” he said. “I was waiting for the ‘wrap’ sign to come up, and it never came up.”

Urban’s speech was roughly 50 seconds long, so who knows what he would’ve endorsed if it had gone on for much longer.

Although the threats and accusations are often sent to the wrong people due to the shoddy evidence gathering techniques employed, thousands have paid off the copyright holders fearing they would end up being in more trouble if they ignored the threats. The scheme has proven to be profitable for all parties involved, except those receiving the letters.

Leaked documents have shed light on these practices, revealing that the core motivation of the companies involved is simply to generate as much cash as possible.

It will hardly surprise anyone when we allege that ACS:Law and fellow anti-piracy outfits are clearly abusing copyright for profit. However, it is good to see that our views are being supported by several Lords in the UK.

In recent weeks the law firm sending out these mass copyright infringement notices has been discussed in the UK House of Lords. The video below shows Lord Clement-Jones labeling the operation as a scam.

It is surprising that in the UK, copyright holders – some of which have ‘leased’ copyrights from other companies for the sole purpose of cashing in on allegations of file-sharing – can demand the personal details of thousands of alleged file-sharers without having to provide hard evidence. In most other countries this would be prohibited due to privacy concerns.

Lord Lucas has raised this problematic issue, saying that the Lords must do something to ensure that citizens’ personal details are not given out to companies like ACS:Law “willy-nilly”.

Like many file-sharers, some Lords would like to put an end to this copyright abuse, with Lord Lucas accusing the law firm involved of “harassment, bullying and intrusion”. But the criticism of ACS:Law didn’t stop there.

Noting that it could cost around £10,000 for those accused to protest their innocence, but a payment of ‘only’ £500 to make the accusations go away, Lord Lucas called the scheme “straightforward legal blackmail”.

For the public’s sake we hope they come up with a solution to end this madness. In the meantime, anyone accused by ACS:Law can learn exactly how this scheme operates and how to defend themselves efficiently, by downloading the ‘Speculative Invoicing Handbook‘ from consumer group BeingThreatened.

One of the options for the government is to criminalize unauthorized downloading by making it punishable by law. The entertainment industry, represented by Dutch anti-piracy group BREIN among others, have lobbied extensively for such a change. Consumers, on the other hand, prefer to keep things the way they are right now.

Backing interests of the general public, Dutch consumer rights organization Consumentenbond has started a campaign where they defend the public’s right to download copyrighted material without repercussions.

“Sometimes I buy, sometimes I download, but I am not a criminal..,” is the message the consumer organization is trying to put across in the newly launched campaign.

The rationale behind the campaign is that the the entertainment industry has failed to provide sufficient legal alternatives to online piracy, leaving consumers no other choice than to consume online media through file-sharing sites.

“At the moment, paid downloads don’t offer any added value compared to unauthorized downloads,” Bart Combée, Director of the Consumer Rights Organization said . “Before criminalizing consumers, the industry has to make sure that they offer a decent amount of content. Once that improves, I think consumers are willing to pay,” he added.

Previously, the consumer rights organization also stood up for users of The Pirate Bay, after the Amsterdam court ruled that the site should block Dutch users without reviewing the evidence carefully.

The present campaign reiterates what many others have said before. There has to be a fair balance between the interests of multi-billion dollar companies and the individual rights of consumers. And since a report commissioned by the Dutch government recently concluded that file-sharing actually has a positive effect on the economy, it might be best to keep things the way they are for now.

“The industry has been extremely slow to listen to the demands of its customers, and has had something of an abusive relationship with them, seeking to punish them before thinking of how to serve them better,” he noted.

Lucas went on to say that it took the industry a decade to produce sensible alternatives to illicit file-sharing and cast doubt on their ability to identify infringers from an IP address alone.

However, hidden away in the text of the 2nd reading of the Digital Economy Bill were some encouraging signs that the government will have to take notice of the companies generating profit from alleged file-sharing (by sending threatening ‘pay up or else’ letters), under the guise of protecting the ‘creativity’ of the porn industry.

“We have to be careful too about the industry cloaking itself in the finery of the small, creative individual,” said Lucas. “We are not talking about the small, creative individual here, but about powerful, monopolistic industries and giving them power over citizens. We must be careful of that.”

Although he didn’t mention them by name, there can be little doubt Lord Lucas was referring to UK lawyers ACS:Law (and previously Davenport Lyons) and their German partners, Digiprotect.

“Pornography is widely used on the internet and is one of the most assiduous industries when it comes to pursuing people for supposed non-payment for illegal downloads et cetera. We have to face it that we will be putting a lot of people into the hands of pornographers and their lawyers if we are not careful about the way we draft the Bill,” he said.

As we pointed out in a previous article, the proposals being put forward in the Digital Economy Bill do not trump the old copyright system, meaning that if rights holders (Digiprotect) and lawyers (ACS:Law) wish to continue with their campaigns of sending letters and demanding huge sums of money instead, they will be perfectly entitled to do so.

But not if Lord Lucas has his way.

“Secondly, it should be compulsory for copyright holders to go through the mechanism we are putting in place. It is not acceptable that we are putting in place a mechanism for them to deal with peer-to-peer file-sharing and for them still to go immediately to lawyers and harass people as the pornography industry does already. The briefing that noble Lords will have seen from Which? describes the consequences well. We should take the opportunity of this Bill to stamp that out,” he said.

Noting that claims from porn rights holders have often been made against innocent people, Lord Clement-Jones also said that provisions should be made to bring the scheme to an end.

“Of late, we have seen a proliferation of lawyers’ letters, acting for the pornography industry, as the noble Lord, Lord Lucas, pointed out, often against innocent people asserting copyright claims and threatening court action,” he said.

“Which? and others are right to raise these cases, but I hope that the provisions of the new code will obviate the need for this heavy-handed type of action.”

Lord Mandelson, or ‘Mandy’ to those speaking of him affectionately, has truly set the cat among the pigeons with his Digital Economy Bill, pleasing almost no-one apart from Big Music and Big Movies, and alienating everyone from most of the ISPs in the country through to millions of Internet users.

In protest, ISP TalkTalk is running the Don’t Disconnect Us campaign, which is gathering great momentum after being endorsed by Stephen Fry earlier this week, and hopefully will receive yet another boost with the help of some catchy music and cutting lyrics.

Yes, just when you thought it was safe after ‘Dear Lily’ – musician Dan Bull is back, this time with a new track – ‘Dear Mandy’.

“I’ve just recorded and uploaded a new video, aimed at Peter Mandelson, and getting people to sign the petition against his three strikes bill,” Dan told TorrentFreak.

“The most worrying part of the Bill is that Mandy has given himself the power to create new legislation as he pleases, meaning he can pretty much do whatever he wants to people he suspects of copyright infringement,” added Dan, echoing the autocracy fears outlined by the Liberal Democrats last week.

“This is one of the most serious threats to privacy and presumption of innocence in the UK for a long time. I would urge people who are concerned about this to contact their MPs, and sign the petition, Dan concluded.
