Two months ago, a collection of fifty US and Japan-based adult movie studios filed a mass copyright complaint against around 10,000 South Koreans accused of being heavy uploaders of porn.

The studios also filed suit against 80 websites accused of aiding and abetting the distribution of the illegally uploaded movies.

A National Police Agency spokesman said that the lawsuit was filed at 10 police stations in the South Korean capital, Seoul, and in the Gyeonggi province. The studios asked the police to investigate the infringements, which carry a potential jail sentence.

However, from the 10,000 complaints issued, prosecutors charged just 10 people with copyright infringement. In response, the disappointed studios say they will fight back. Next week they promise to re-file their lawsuit, but this time will increase the number of individuals accused to 65,000.

Kim Han-Seo, a lawyer representing the movie producers, said that the prosecutors were not tough enough so they had decided to up the ante.

“Now, we’ve drawn up a new list of some 65,000 users who fit this guideline,” he said. “We’ll see whether the prosecutors will press charges against them all.”

As we reported earlier on our sister site FreakBits, at the end of August distributors of a hit Korean disaster movie called in the police after it was leaked to the Internet and was downloaded 100,000 times. Kim Han-Seo said that the Korean authorities had responded quickly to that local problem, but accused them of different standards when it comes to protecting foreign content, such as the material produced by his porn movie employers.

“We believe that [the prosecution] should not be discriminatory in applying copyright laws. Illegal copying and distribution run rampant in Korea because it is one of the world’s most wired countries. We decided to take legal action to minimize our past business losses and to protect anticipated future profits,” he said.

The threat now is that if the local Korean authorities fails to act in a way that pleases the porn producers, they will take their case directly to the US government instead.

The initial lawsuit indicated that the studios had also harvested the IP addresses of around 100,000 individuals who downloaded the adult movies but to date, there is no indication that they will become a target.

... client comparison is collected by a researcher known as ‘xXx’ of the Tribler P2P research team at Delft University of Technology. ...

BitTorrent has been the leading file-sharing technology for several years already, and we at TorrentFreak decided that it would be a good idea to track the changes in popularity of the various clients. Every two months we therefore publish an updated overview of the market share of BitTorrent clients.

Today we present our second report based on data from over 165,000 unique users in more than 400 public BitTorrent swarms. The data for this BitTorrent client comparison is collected by a researcher known as ‘xXx’ of the Tribler P2P research team at Delft University of Technology.

The results in the table below show the market share for each individual client. In common with the June report, only 5 clients reached the 1% threshold, the remaining 20 that were encountered are grouped in the ‘other’ category. Some clients were not identified by libTorrent (rakshasa) and those ended up the the unknown ‘category’.

The changes in market share compared to our June report are also included, and these show some interesting trends. First of all, uTorrent kept its dominant lead and even extended its market share to 56.81 percent. BitComet – ranked fourth again – is this month’s loser with a drop of 38 percent, falling from 6.50 to 4.71 percent market share.

On the winning side we see gains for Transmission and Vuze. Transmission’s market share increased to 44 percent and may move up a few spots if it maintains this growth rate. More on this in our October report.

The latest in a long line of scams targeting email users is attempting to capitalize on the increasing number using BitTorrent sites.

Targets of the scam receive an unsolicited email purporting to come from notorious anti-piracy company MediaDefender. The email, which is simply addressed “Dear User!” claims the individual has been monitored on any of several torrent sites while engaging in anything from copyright infringement, through to simply browsing the sites.

Of course, citing MediaDefender is a nonsense, since that company doesn’t get involved in anti-piracy warning letters – its specialty was spoofing on BitTorrent networks.

Additionally, most of the sites listed don’t even operate a tracker, so committing any type of copyright infringements on them is almost impossible. Here is the body of the email;

Pirate Scam Spam

Your recent internet activity was logged on the following sites:

* Btjunkie
* SumoTorrent
* isoHunt
* Btscene

hxxp://XXXXX.net/report_78478XX.exe (XX added by TorrentFreak)

We have a report about the copyrighted movies, music, softwares you downloaded or searched on these webpages. We strongly advise you to stop any future activities regarding the downloading of illegal content or you can expect prosecution by 17 U.S.C.512,1201?1205,1301?1332; 28 U.S.C. 4001 laws.

Sincerely,

MediaDefender Inc.

So what is this scam all about? Attached to the email is a logfile which supposedly provides additional information about the user’s infringements, but of course this is a lie – the log is really a virus.

This type of scam is nothing new – the same type of thing has been tried before, probably by the same people. However, this time the virus is different. Here is the report, courtesy of ThreatExpert;

Threat characteristics of ZBot – a banking trojan that disables firewall, steals sensitive financial data (credit card numbers, online banking login details), makes screen snapshots, downloads additional components, and provides a hacker with the remote access to the compromised system.	Creates a startup registry entry.	Contains characteristics of an identified security risk.

Savvy Internet users will hopefully realize the email is a scam fairly quickly, but hardened file-sharers should smell a rat even earlier due to the omission of demands for money.

BitTorrent has been the leading file-sharing technology for several years already, but up until today little was known about the market share of the various clients. In December we estimated that uTorrent’s market share lay somewhere between 40 and 60 percent, but this measurement was far from scientific and based on a small sample size.

Today we present a more robust report based on data from over 150,000 unique users in more than 400 public BitTorrent swarms. The data for this BitTorrent client comparison is collected by a researcher known as ‘xXx’ of the Tribler P2P research team at Delft University of Technology. The research team will continue to supply TorrentFreak with bi-monthly updates so we can discover new trends and shifts in the usage of the different clients.

The results in the table below give the market share for each individual client. Only 5 clients reached the 1% threshold, the remaining 19 that were encountered are grouped in the ‘other’ category. Some clients were not identified by libTorrent (rakshasa) and those ended up the the unknown ‘category’.

Both uTorrent and the third placed mainline client are developed by BitTorrent Inc, meaning that the company holds an impressive two thirds of the market. The only main contender at the moment is Vuze, formerly known as Azureus, with nearly 17 percent. BitComet, which used to be a major contender, is in fourth place with just 6.5 percent.

The data also gives us more insight into the size of the BitTorrent ‘network’. In December we reported that uTorrent had 28 million unique users a month, and based on this figure that might have grown even higher in the recent months. It is safe to say that there are roughly 50 million active BitTorrent users on the Internet.

It will be interesting to see how the market share of the clients changes over the coming months. Will uTorrent be able to keep its dominant lead? What will happen to Transmission’s market share when they release their Windows version? Will there be any new clients to compete with the top three? Lots of questions that we hope to answer in the future.

Stay tuned!

Over the years aXXo has been built up to cult figure status by many BitTorrent users, to a point where the mainstream press and even documentary film makers show an interest. This March aXXo went silent, but some claim that he is still active on a relatively unknown private tracker named Speed.cd.

A few weeks ago, some blogs and commenters on Mininova picked up on this and reported that aXXo decided to go underground, releasing his torrents only on a few private trackers. Interestingly, he would also have left Darkside RG which was considered to be his home for years, and where he posted the following message only weeks ago.

“My home is my beloved Darkside and as i’ve said so many times before on each of my torrents…. Be aware of bogus sites and lamers,” aXXo wrote.

So here are some facts. There is indeed a staff member called aXXo (with identical capitalization) on Speed.cd. He joined the site in January 2008 and has been uploading (some) aXXo rips after they appeared on public sites such as Mininova. After aXXo stopped releasing torrents elsewhere, aXXo on Speed.cd continued to upload movies.

But is this member called aXXo on Speed.cd the real deal? No, not even close. A quick comparison of the codecs used on these “new” aXXo releases and an examination of some of the metadata such as the ripping software and specs, clearly shows that it is not the same aXXo his fans know and love.

Also, it is a bit strange that the mystical aXXo only uploaded his releases sporadically onto the Speed.cd tracker before he stopped releasing on public sites three months ago. To us, these are all clear signs that we’re dealing with an impostor here.

For years aXXo has been warning followers to “beware of bogus sites and lamers,” but apparently that didn’t help much. Over recent weeks, thousands of people signed up at Speed.cd, and according to a poll on the site, most of them joined because of the ‘aXXo’ releases.

aXXo poll on Speed.cd

The aXXo user on the private tracker is clearly enjoying his new status, and has even changed the NFO files bundled with his releases to point to Speed.cd instead of DarksideRG. In the comments he is chatting with his new found fans and explaining why he decided to leave Mininova and Demonoid.

The site’s operators on the other hand are welcoming the many donations made by aXXo’s followers. “Since axxo is part of this site I have donated $10,” one user commented after buying some upload credit and VIP status. There are even better deals though. Three months of VIP access is only $50 and you’ll get a star next to your nickname as bonus.

Then again, if thousands of people can’t spot the difference between the uploads of aXXo and the fake aXXo, does it really matter? We’re inclined to say no, if it wasn’t for the price lists and money begging going on at that site.

Let’s hope that they don’t have the MPAA fooled and end up with their servers raided by the authorities. That would be a shame.

Update: A topic on Speed.cd linking to this article was quickly removed….

Apple is no stranger to making millions of dollars off the back of piracy. After all, rampant MP3 piracy has proven to be the lifeblood of its 160gig iPods, even if you discount the Middle Eastern Sheikh customers who can actually afford to fill one.

But there are other more subtle ways for the company to benefit from copyright infringement. Who remembers our article from 2008, when we showed an aXXo release being used to sell Macs in a John Lewis store? Well, now it looks like another retailer had the same idea – why spend money on real DVDs when you can just download them?

On a visit to the Rivas H2Ocio shopping mall in Madrid, Miguel Ángel Moro walked into a Saturn store. There, in the Apple section, he saw demo machines – and they were all running pirate movies.

Miguel told TorrentFreak, “This is not the first time I’ve seen this stuff in MediaMarkt/Saturn, a big consumer electronics store in Europe. They sell from computers to washing machines, including DVD and Blu-ray discs.”

Displaying their own DVDs is illegal without clearance, so they might as well grab a copy off BitTorrent and safe a few bucks – right? Sharing copyrighted files is legal in Spain, but not for commercial use which is clearly the case here.

Below is a photograph taken by Miguel of a ‘Cars’ Blu-ray movie rip running on VLC Media Player, on a Macbook, in the store.

April 1st. What fun. Everywhere you look torrent sites and release sites are being shut down, that’s if they aren’t teaming up with the movie studios. But what if there’s some really serious news to report? What if one of the summer’s biggest sci-fi movies leaked out onto the Internet way before its release, and before it was even completed? Still unconvinced?

This is the reality today with Fox’s ‘upcoming’ X-Men Origins: Wolverine and it’s spreading with determination on BitTorrent. At the time of writing there are at least three different ‘workprint’ versions, presumably from the same source. One is reported to be a few minutes longer than the others but all are missing special effects. The film, penned for a May 1 2009 release, was due to compete alongside the likes of Transformers: Revenge of the Fallen and Star Trek in this year’s summer blockbuster campaigns but has ‘premiered’ a little earlier than planned.

Here at TorrentFreak we’ve been monitoring this leak and since the movie hit BitTorrent just a few hours ago it has been downloaded at least 75,000 times, a rate comparable to that of the DVDrip ‘release’ of The Dark Knight. Interest is likely to be significant. X-Men’s target audience are tech-savvy people who are likely to have heard about BitTorrent. Multiply this by the desire to see something unusual and something you’re not supposed to have (like an unfinished Hollywood sci-fi movie) and things got hot – quickly.

The leak is the source of much speculation, but one particularly interesting discussion surrounds the source of the leak of this ‘workprint’ copy. Many early ‘reviewers’ of the movie noted that not only was the video and audio of a high quality (screenshots), but there were no ‘watermarks’. This is not strictly true. A little way into the movie from the top of the screen pops a very brief message which names Rising Sun Pictures and a date, 2nd March 2009.

Founded in 1995, Rising Sun Pictures (RSP) is an Australian visual effects company which has previously worked on the Harry Potter, Superman and Batman movies, so they have quite a pedigree. Of course RSP would absolutely not endorse any leak and the leak could have happened before the print even reached them, but somehow a print marked with their company name has made it onto the Internet and the downloads are mounting quickly.

Another interesting development is that Devin Faraci over at Chud.com said that he’d been told that the Wolverine DVD had been “switching hands” over the last couple of weeks.

TorrentFreak contacted Rising Sun Pictures but as yet we’ve had no response.

Update: Fox has released a statement confirming the leak. The FBI and MPAA are investigating the case.

In addition, this weeks list includes four newcomers. The Dark Knight, crowned the most pirated movie of 2008 is still present, but has dropped another place.

The data for our weekly download chart is collected by TorrentFreak, and is for informational and educational reference only. Currently both DVDrips, DVD Screeners and R5 rips are counted.

Empornium.us is probably the world’s largest adult-material tracker. Indeed, at one stage it had over a million members which could elevate it to the position of world’s biggest private tracker, for any material. The site found itself in controversy in 2006 when an Israeli advertising company took over the site and kicked out many of the admins. For its part, Targetpoint denied the allegations, claiming one of its associates simply brokered the sale to an unknown third-party.

Today, users searching Google for Empornium.us are met with a warning under the URL: “This site may harm your computer”. After ignoring the warning and clicking the link using Internet Explorer, the Empornium main page starts loading, but is then punctuated with virus/malware/exploit warnings from an up-to-date anti-virus scanner. Google reports “Malicious software includes 4 trojans, 3 exploits. Successful infection resulted in an average of 11 new processes on the target machine.”

During our tests we caught malware or exploits which seemed to originate from:

hxxp://hardmoviesporno.com/test/exp/update1.pdf
hxxp://ffseik.com/25/2/getfile.php?f=vispdf

At this point we deemed the Google Safe Browsing report to be correct and abandoned our own tests. Accessing the Empornium homepage using Firefox3 caused an immediate halt:

Google notes that the ‘malicious software’ is actually hosted on 4 domains, including gianttopnano.cn, mmcounter.com, filmmultimediaonline.cn. Furthermore it states that two domains appear to be “functioning as intermediaries for distributing malware to visitors of this site” including vxhost.cn, and filmmultimediaonline.cn.

TorrentFreak has contacted Empornium management for a comment, but so far there has been no response.

Update: Empornium Team contacted us, confirming that the malicious code has nothing to do with them and they are “taking action to shut down the infiltration & remove the code asap”. Their own tests so far show it is “exploiting a known & patched security hole in Acrobat”.

...

We have attached a report about the copyrighted movies, music, softwares you
downloaded or searched on these webpages. We ...

Over the years BitTorrent has attracted some shady figures. We’ve reported on malware ridden BitTorrent clients and media players, a BitTorrent site that infects its users with spyware, and several other scams.

Although most scams can be avoided easily when a few simple rules are followed, they still manage to trick thousands of novices every day – and this is not going to end anytime soon. Since BitTorrent has become more or less mainstream, with millions of users worldwide, it also proves an interesting target for email spammers.

The latest scam, unlike the others we have reported on before, is one that is sent by email. The email is disguised as a message from the anti-piracy company MediaDefender (using their logo etc.), and warns the recipient that his or her download behavior has been logged. The email has a report attached with more details about the infringed material, which turns out to be a virus (A Mytob worm which installs a trojan, and allows outsiders to gain access to your computer).

Pirate Spam Email

Dear User!

Your recent internet activity was logged on the following sites:

*	Btjunkie
*	SumoTorrent
*	isoHunt
*	Monova
*	Yotoshi
*	GetInvites
*	Btmon

We have attached a report about the copyrighted movies, music, softwares you
downloaded or searched on these webpages. We strongly advise you to stop any
future activities regarding the downloading of illegal content or you can
expect prosecution by 17 U.S.C. §§ 512, 1201?1205, 1301?1332; 28 U.S.C. §
4001 laws.

Sincerely,

MediaDefender Inc.

To the more experienced and BitTorrent savvy users it is clear that the email is a scam. First of all, MediaDefender has never been involved in anti-piracy enforcement. The only thing they do is spoofing, flood BitTorrent sites with fake files, and the occasional DDoS attack on Revision3.

In addition, the email claims to have data on what the user searched for on the sites, which is irrelevant and practically impossible. It seems that the spammers should have done some more research on the topic. A good spammer would have included The Pirate Bay in the list of sites instead of Getinvites, which is a BitTorrent invite trading site, and not a search engine

A related scam email, sent out by the same group of people judging by the style and format, is also targeted at filesharers and threatens to suspend their Internet connection. The email claims to be sent by the Internet service provider consortium, and again includes an infected attachment with a report.

The email is a clever scam that shows how mainstream BitTorrent has become. The emails are sent out randomly, but many recipients, scared by be cut off by their ISP, or sued for downloading copyrighted material, might open the infected attachment without realizing that it is a scam.
