Alleged UK File-Sharers Better Armed and Ready To Fight Ben Dover

After initially attempting to target around 9,000 individuals, Golden Eye International acting on behalf of pornographic film producer Ben Dover are about to start dumping cash demands on the doorsteps of 2,845 alleged file-sharers in the UK. TorrentFreak has obtained a copy of the letter due to be sent out and it amounts to little more than a demand for cash wrapped up in an ACS:Law-style fishing exercise.

Starting next month, Golden Eye International (GEIL) will start sending out letters to Internet account holders they accuse of downloading and sharing various adult movies produced by UK porn outfit Ben Dover.

Despite protestations to the contrary, the exercise amounts to an ACS:Law-style scheme to extract cash settlements from Internet users.

The one big difference is that when ACS:Law entered the ‘pay-up-or-else-market’ their targets were largely unprepared. Today the situation in the Ben Dover case is quite different, not least due to the intervention of Consumer Focus, a group that has sought to protect consumers by bringing GEIL into line.

“We intervened in this case to make sure that consumers are treated fairly. People will not have ready access to the sort of specialised legal advice necessary to respond to allegations of copyright infringement. That is why we are working with the Citizens Advice service to provide clear advice to consumers about what to do if they are accused of copyright infringement,” said Consumer Focus Chief Executive Mike O’Connor in a statement this morning.

This is welcome news. Many original ACS:Law victims, including the author of the campaigning site ACS:Bore, turned to an ill-prepared Citizens Advice service in desperation only to leave dissatisfied. Hopefully things will be different this time around.

Originally, GEIL wanted to target more than 9,000 individuals alleged to have downloaded adult movies. However, the High Court has only given permission for ISP O2 to reveal the identities of 2,845 account holders alleged to have downloaded and shared Ben Dover movies, striking out the remainder who are alleged infringers of other studios’ content. They may be back though, pending the outcome of a 2013 appeal.

So when the letters finally appear through the doors of alleged infringers, what will they look like?

TorrentFreak has obtained an advance copy of the final letter and we can confirm that it amounts to little more than a rehashed ACS:Law-style scheme to extract cash settlements from Internet users based on flawed and incomplete IP address-only ‘evidence’. While the intervention of Consumer Focus and the High Court means that it is less aggressive than the letter sent by ACS:Law, it still has plenty of faults.

We say you’re a pirate, but we can’t prove it and need you to help us

“This letter assumes that you, as the internet account holder at your address, were the user of the relevant computer on the day and time in question,” the letter states under the title “Infringing acts.”

But in common with ACS:Law, GEIL then go on to admit that they have no proof that the individual being written to is the actual infringer.

“In the event that you were not responsible for the infringing acts outlined above because, for example, another member of your household was the user of the computer, you should make full disclosure to us of the other parties at your residence using your internet connection to make the Work available for download,” the letter states.

“A failure to make such disclosure may lead to a claim being made against you with the court being asked to conclude, on the balance of probabilities, that you were the user of the computer.”

While GEIL are perfectly entitled to “ask the court to conclude” whatever they like, it does not necessarily follow that a High Court judge will take their advice. The law states that if the defendant did not carry out the infringement or did not authorize someone else to do so, they are not guilty of copyright infringement. If they do not know who infringed, then it will be impossible for them to tell GEIL, despite the firm’s veiled threats.

Michael Coyle, a solicitor advocate with Lawdit Solictors, a company that previously helped people fight off ACS:Law, says that while there is a chance GEIL will take a case or two to court, this is all about settlements.

“The exercise is an attempt to obtain as much money as [GEIL] can and it will cause significant embarrassment [due to the pornographic nature of the content],” Coyle told TorrentFreak. “However the two key points remain the same, no infringement can be proven unless people accept that they did it or GEIL get to inspect their hard drive.”

And admitting to wrongdoing is exactly what GEIL are asking for people to do.

“Please state whether you admit that you have downloaded the Work and/or made it available for download by others, and if so the extent to which you have done so,” the letter adds.

It should be noted that earlier in the letter GEIL state that the level of damages claimed in any court case would be directly linked to the “extent to which you have downloaded the Work and/or made it available for download by others.” Why anyone would want to help GEIL formulate a claim against them by providing them with the ammunition is anyone’s guess. If GEIL had evidence to show the actual extent of any infringement, they would show it.

Settling with GEIL will involve paying them money, although in their first letter they don’t say how much. It is widely believed that they will ask for £700 once negotiations begin, perhaps even more if people help GEIL build a case on a full confession.

Anyone receiving a letter should contact the Citizens Advice Consumer Service on 08454 04 05 06 or their local Citizens Advice Bureau. And don’t forget to contact TorrentFreak too, in complete confidence of course.

    Since it seems unlikely that these people will actually take anybody to court one wonders what would happen if a person just stonewalled them and never responded or acknowledged their letters. Surely the senders know that many of their letters are going to innocent people, dead people, people who moved away long ago, even non-existant people. I’ve found that the best way to get rid of the scam “bill collector” telemarketers is to not ever answer their calls, let alone argue with them. This method works well for corporations that ignore calls, emails and letters from wronged customers. Would it work for us too? Does the urge to “tell ‘em off” actually play into their hands by establishing communication?

      So I took that final notice and changed my phone number LOL
      I still get notices to my mothers house every now and again but she just writes on the evelope “not at this address” and sends it back. They dont know my real address, and nothing has ever come of it.

      I would think applying for credit cards and not paying back any of it would be worse than downloading a few movies or tunes.

      I believe under British law, that the burden of proof is with the letter originator (the sender) to prove you received the letter not just that they sent it. hense why most company’s use special delivery for important mail.

    Well it is great to see Consumer Focus included when we know from the ACS:Law days the subscribers had no voice at all in Court when the ISPs were only happy to sell their own subscribers to the exploitation of the copyright trolls.

    As I like to be optimistic then lets hope these claims are well countered.

    I wonder if the ratio of IPs captured by the “monitoring software” to the actual number of account holders identified by the ISP will be exposed this time as it was in the ACS:Law shakedown.
    If I were to be a recipient of this fishing letter, I’d certainly include a few quotes from Crossley’s catastrophic scam, starting with Judge Birss’ statement that the scheme was designed to avoid judicial scrutiny and then from his Solicitor’s Disciplinary Tribunal ruling saying neither Crossley or Media CAT had any evidence of the work being make available.

    i.e. Para 91.11
    “The Respondent was aware that in order to bring a successful claim, his clients needed to establish that the whole or a substantial part of the copyright work had been made available, and yet the Letters of Claim made no mention of this. The letters therefore gave the misleading impression that there was no requirement to establish that a “substantial part” of the copyrighted material had been infringed.”

    & Para 91.12 “Neither MCAT nor the Respondent had evidence that the “Work” had been made available. They had a report from the monitoring company which showed that its software had captured pieces of the two pornographic videos being made available from an IP address at a particular second in time.”

    I wonder if GEIL are paying Davenport Lyons a fee for using their copyrighted speculative invoicing model ? Crossley certainly was, it came up in the disciplinary tribunal of Brian Miller and David Gore.

    Seems like an elegant and simple solution to the problem, if the service can be maintained.
    Most of these lawsuits go through because people don’t know what to do and can’t hire a proper lawyer so they’re basically scared into paying because lawsuits are usually a serious deal and people don’t know these lawsuits aren’t real suits but full scams.

    Dear GEIL,

    At the time of the alleged offence, I was inadvertently operating an open WiFi network due to a faulty router. As you are aware, your evidence of my downloading simply points to the external IP address of my router, and in no way can identify the individual responsible for infringing your rights. Unfortunately, I have replaced the router since then so logs are unavailable from the device, I do however recall seeing connections from several dozen devices listed in the devices DHCP table – it was this that prompted the swift replacement of the device.

    As you have no proof that I am guilty of any of your alleged offences, and there is no longer any way to recover those logs, I would suggest that you remove me from your database and drop any legal action against me. I would like to remind you that you will be responsible for my legal costs should you fail to prove your case.

      You could advise them that the law will require them to show that you either performed the infringement or authorised someone else to do it (letting someone else use your connection is not authorisation btw.)

      If you don’t get that first denial in and the swine to risk court, this looks bad in front of the judge. If you make a defense (such as the above) and they manage to show it is not entirely true, this also looks bad.

          I think you are confusing 3 strikes scheme with the settlement demands scheme.
          A LAW FIRM is demanding you to settle, NOT THE ISP. The only way the ISP is involved in these settlements is them giving up your account information because a court order told them too.
          MONEY YOU (allegedly) OWE TO Mr. Bend-over IS NOT OWED TO THE ISP. So I dont see what their terms have to do with anything.

          That remains untested in this context. However, increasingly we are seeing charges and successful prosecutions being brought for facilitation of copyright infringement.  Any plaintiff would seek to use your breach of the T&Cs against you to prove this. It’s just a matter of time.

           Ignorance is no defence. O2 determine whether you have breached their terms and conditions, not you. It is up to you to “beat”  IP evidence as Judge Birrs questioning of it as a reliable means of identification remains, as far as I am aware, unanswered. If ISPs can disconnect you based on activities (or a singular activity) through your IP then there appears to potentially be a very big test case ahead and all the “please provide….” in the world will not matter a jot.

    Well if I was an O2 customer and had D/L Ben Dovers shit porn, I would send a letter back denying any wrong doing and then say someone must have hacked my wifi. I learned how to do it over a few days and was able to get into a few wifi connections – my point is that it is entirely possible for it to happen even if its ‘secure’ especially if you have a crap password such as ‘password’ or ‘wifi’ or ‘qwerty’.

      2. Start downloading using these wifis
      3. Copyright cartel goes after wifi owner
      4. wifi owner denies downloading anything
      5. wifi owner goes to court and sues for defamation

      If this happens enough times and these wrongly accused people actually takes the case to court instead of settling, then hopefully the courts will demand the cartel to show better proof.

    I see that Ben Dover’s website is advertising a video of a contestant on ITV’s Britain’s Got Talent, complete with that programmes logo. Now I wonder if that logo is copyright and if he obtained permission to use the logo on his own website?. I doubt very much he asked for permission, and if he had, I very, very much doubt ITV would have granted permission.

    I got a letter today – AT MY WORKPLACE!!! 

    The worst of it is though, I’ve never been an O2 broadband customer – I had a PAYGO iPhone years ago that you couldn’t data tether…so I have no idea on 

    a) how they got my work address

    b) what I downloaded – I’ve never downloaded any Ben dover movies

    c) how my PAYGO phone could be associated with my work address.

    The work PC’s are behind mega security and you can’t download anything or even use it for anything other than work related information…..

    Already registered a complaint with Consumer advice and trading standards and I will not tolerate these scam artists contact me at my workplace again

    cant get away with it legaly cause all they have is an I.P. address of computers that have downloaded the Sorry Ass videos he puts out, anyways they have no name of the person who did it which cannot stand up in court ant their lawyers know this. So what they will do  is threaten the person with a heafty fine and im shure they will pay it unless they go through the courts and try to get it desissed but that it being adult films and the person not wanting to be embarrased about it they will pay the fine in the Biggest B.S. Scam that the makers know is not legal and that will be it
