Yep. IINet have been down this road and they dont take any shit from the foreign troll companies, and apparently the courts here concur with the ISPs that the trolling stuff is nonsense.

The courts in Australia are highly likely to tell CEG TEK to f**k off if they want to try and make ISPs “comply”. The courts require a name and solid evidence (More than an IP address!) to issue a warrant, and since privacy law prohibits ISPs from investigating most customer activity, the ISPs aren’t even *allowed* to comply with info requests from trolls without a court order (which the trolls are unlikely to get).

Unless this stupid conservative govt changes the law which it very well might.

well canada now requires a warrant to collect this info thanks to the Supreme Court of Canada’s Spencer decision. Chalk one up for the good guys.

it isn’t per infringement it is all, this is right from Micheal Geist blog who is some what of an authority on this here.

‘This Bill ensures that Canadians will not face disproportionate penalties for minor infringements of copyright by distinguishing between commercial and non-commercial infringement. Under current law, for commercial and non-commercial infringements, copyright owners can sue for statutory damages ranging from $500 to $20,000 for each work that is infringed. This Bill will dramatically reduce an individual’s potential liability in cases of non-commercial infringement. In such cases, statutory damages will be reduced to a one-time payment of between $100 and $5000 for all infringements that took place prior to the lawsuit.’

So whether it is a single song or your PC is full of content there is a cap as of the update to copyright law bill c13

I wouldn’t be so sure about that, Brandis will almost certainly try and push it. It depends how much Labor will resist in the senate, although they are now on the corporate teat as well. The Greens and Nick Xenophon won’t support it. Bob Day is conservative and may go with the government. David Leyonhjelm is a true libertarian so I’d be inclined to think he’d vote against it. Not sure what John Madigan would do. Ricky Miur may vote against it as the motoring enthusiast prefer minimal government interference, however he is really an unknown and will depend on what is arrangement is with PUP. Who knows what Clive will get PUP to do, he will definitely make a song and dance about it.

In Australia, there is only one ISP that forwards DMCA notices currently, and that is TPG.

Use a VPN from torrentfreak’s VPN providers that really take you anonymity seriously list and you will never receive one of these notices.

The iinet group of companies won’t be complying, and they are the 2nd biggest ISP in the country. Not sure the number 1 provider, Telstra, will be in a hurry to “comply” either, but time will tell.
