Are You An Accidental Movie and TV Show Pirate?

Another day, another anti-piracy campaign. This one, from the MPA and AFACT-backed Intellectual Property Awareness Foundation, is trying a slightly different approach. Instead of accusing people outright of being movie and TV show pirates, it cuts them some slack and treats them like children instead. It seems that some people just don’t know they are pirates.

The relatively new Intellectual Property Awareness Foundation (IPAF) was created by the Australian movie and TV industries to “promote the value of the industry by raising awareness, understanding and appreciation of intellectual property, and its role and value in society.”

Members of IPAF include Australian Federation Against Copyright Theft (AFACT), Motion Picture Association (MPA), Motion Picture Distributors Association of Australia, Australian Visual Software Distributors Association and various cinema owners and DVD rental outlets such as Blockbuster.

Last year IPAF embarked on a campaign to educate Australia’s children on the evils of copyright infringement in an attempt to “motivate a change in attitudes and behavior to reduce public demand for illegal copies of film and television programs.”

While many anti-piracy groups take a fairly aggressive angle when sending their message, IPAF take a more softly-softly approach. If AFACT is bad cop, IPAF is his gentler, more reasonable-sounding counterpart.

Good cop has just launched his new nationwide anti-piracy campaign with the unusual title of ‘Accidental Pirate’.

“New research, released just today, revealed that 34% of Aussies see piracy as stealing or theft but then regularly do it by burning, buying or downloading illegal or unauthorised copies of films or TV programs,” explains IPAF. “In other words, 1 in 3 of us do something that we don’t agree with. So to describe this disconnection between actions and beliefs, we coined the phrase ‘Accidental Pirate’.”

Right. So people know piracy is ‘wrong’ but because they still carry on it’s an ‘accident’? That doesn’t seem to fit very well does it?

Accidental Pirate

You can see what IPAF are trying to do though, it’s just badly executed. If you’re going to educate people on the premise that they didn’t know that their actions were ‘wrong’ in the first place (so as not to immediately antagonize them), at least don’t patronize them. “There, there, you know it’s wrong but let’s just pretend it was an accident, eh?” Please.

So what does the campaign have to say. Well, it’s pretty much standard stuff. The campaign’s homepage is running a Flash questionnaire with five questions that readers have the chance to answer. Getting a question right gets a round of applause from the assembled cinema audience, but getting one wrong gets a big X and a short lesson in copyright.

Questions 2, 3 and 5 all involve copying or buying pirated copies of real DVDs and the legalities of that. People don’t ‘accidentally’ believe that pirate DVDs are legal – do they?

Questions 1 and 4 involve file-sharing but if the industry IPAF claims to protect would simply get their act together, these questions wouldn’t even be necessary.

Question 1: Your favorite TV show has just aired overseas. It won’t be shown here for months. While browsing the web you notice it’s available for download for free. Do you download it?

Every time TV-show downloaders in Australia are asked why they do what they do, one of the top answers is always because they are treated like second-class citizens when it comes to release dates. Why do their favorite series take months to appear officially down under? Whatever the reason, it’s a very, very poor one, and no surprise people turn to BitTorrent.

Question 4: You’re browsing the Internet and come across a free download site. You notice a movie that’s just hit the cinemas here. Do you download it?

If people find those then, yes, they probably would. The movie industry is always very clear – if you see a brand new movie on the Internet it’s illegal, because we (stubbornly) don’t offer this service. This type of piracy could be all but wiped out by offering people a legal alternative at a reasonable price in their own homes.

Quiz aside, it’s all pretty much standard stuff. Movie industry people and actors rolled out to make ‘accidental’ pirates feel sorry for the little guy in the film-making world.

You can take the questionnaire for yourself. If you get any ‘wrong’ move directly to the back of the class, put you hands on your head and please try to do better in the future. And stop accidentally downloading torrents. The movie industry depends on it.

    DRM free, running on any platform I choose. Ability to sell my license to watch a movie to someone else (even if part of the sale goes back to the studios like maybe %5 – %10).

    Rentals could be encrypted, but I shouldn’t be restricted on what software and hardware I can watch it on.

    OH DEAR GOD, a terrible accident has happened! I just spent a few days setting up a seedbox and now there is copyrighted material on it!

    I wish people would be more careful

    1. learn about bittorrent from $SOURCE (friend etc)
    2. find bittorrent index (again, suggestion from a friend most likely)
    3. find, choose and install a bittorent client
    4. Find torrent that you like the look of on the index
    5. Download said torrent from index
    6. Add torrent file to bittorent client
    7. wait
    8. wait
    9. unrar your torrent / burn it to a dvd-r / mount it in a virtual drive etc
    10. make use of the downloaded data

    Yeah, really seems like an accident… and just think, if you could prevent any of those steps from happening to anyone else the disaster could have been avoided!

However, if the Walmart employee buys a Paramount CD, they probably won’t have enough to buy a new pair of pants which will prevent Walmart from growing and becoming stronger for the economy.

    Anytime you depend on voluntary payment you are asking for failure. In the US we supposedly have a voluntary compliance tax system. We are supposedly trusted to report our income. ALL our income. Yet the IRS is probably the most hated and feared government agency next to the police. Nobody wants to part with their money when they feel much of it is wasted or stolen by crooks in office. So our voluntary payments are assured with draconian tax laws and rigid enforcement. Now the movie companies want us to voluntarily pay them just because “nice people” don’t try to save a buck. Theaters don’t have a “pay as you exit” policy because it wouldn’t work. When the policy is “it would be ever so much nicer if WE had your money instead of you” its a real stretch to think it will work. Their little silly quiz may have allowed some guy in the MPAA or whatever to keep his job a bit longer but they won’t get much of a return on investment with this program.

    I love how they want to “decrease demand for pirated films”. Here’s how to bring my demand to zero: offer movies and TV shows in a DRM-free format, $5 US for movies, $1 for shows. And make new shows available for legal, $1 to $2 downloads around the world. I guarantee transmission would start collecting dust.

    1. Fire all anti-piracy people. Saves you about half your total budget.
    2. Hire 2 people to find out how to earn from torrents.
    3. profit.

    I do copy/download for personal use, but I won’t buy pirated movies, because I believe Copying for your own profit is bad. They should indeed make it less interesting by opening their own (legal) site, where you can download and watch movies for a reasonal price. Also, when a show/movie/game is aired somewhere and it won’t be launched for months where you live, you download it! it’s that simple…

    So there I was, blundering about the interwebs like a blind kid flailing around in a sandbox, and all of a sudden I tripped over a huge cache of german clown porn and *BAM* when I stood up I had 6.5TB of pirated content spread across two PCs and a laptop. It must have been a virus or something like that because it also managed to burn about 250 DVDs worth of music, movies and games and left them in a convenient binder for safe keeping.

    Whoops! Where did all of this awesome stuff come from? I don’t know for sure, but what I do know is that I won’t be spending any money on entertainment since I already have a master collection of all kinds of content and all of it seems to be stuff I would want to buy too. Although I am too stupid to comprehend what happened I am really beginning to like this internets stuff.

    This accident is the best thing that has happened to me in my adult life. I’m going to buy a new home and vehicle with all the money I’ve saved. I can’t wait until the next “accident” happens! Thank you, german clown porn!

    Almost everyone knows they are stealing. No plan to stop them will ever work. People steal because it gives them a rush and there are too many of them to regulate them.

    The FCC saw the futility of trying to regulate millions of Citizen Band Radio users back in the 1970′s. With only 26 field agents they didn’t have a chance.

    It’s pointless to keep wasting money on trying to regulate billions of pirates. I just laugh every time I read a new plan to stop them. :)

    So, there ingenious plan to educate the public is provide legitimate reasons for piracy? Let me counter their first question with this one. Why the hell should I or anyone else have to wait months to watch an episode of my favorite TV show?

    I’ve said it before and I’ll say it again. Get off your lazy, greedy asses and provide the content people want at affordable prices. Piracy will die off in no time. Instead, I have to wait decades to see the shows and movies I watched as a kid released on DVD. Then, I watch the DVD and find out half the music has been changed, logos are blurred out and a bunch of footage has been cut due to copyright claims. All problems caused by the same jerks who see to it that the DVD cost me 39.99…thanks boys, thanks a lot.

    Your Favorite show has an episode, that wont be around in your area for another year. so…you could do one of the 2 things. you could either pay for a plane ticket for what? say $500-$800 plus hotel costs and wait for the episode to re-air, or you could download it and watch it, because lets face it, your gonna see it on TV for free anyway.

    Had a discussion with a copyright lawyer a few weeks ago (disclaimer: we were both drinking at the time) and after an entertaining discussion for and against torrents, we got onto why copyright laws are around.

    In short, they are designed for a physical world, not an online world, and the laws have never caught up.

    The fact they are even applicable to a digital world says a few things (like how loose the laws are, how torrents are a telecommunications act, things like that) and how penalties are aimed at commercial piracy, not home piracy. Was entertaining to say the least.

    The question that stumped him was why a kid sneaking into a cinema isnt piracy, when he’s doing the same thing – viewing a free copy of a movie. That sort of thing has been around for 100 years.

    Well, of corse I don’t buy stuff. I can understand that the Producer/artist wan’t to make some money from his work and hold the rights for commercial use.

    With that in mind, anybody else selling this stuff and making money of someone elses work without permission is depriving him of his income.

    BUT! Filesharing is usually not commercially.
    You shouldn’t make money of the hard work of others, when they rely on it and wont to make a living.

    I will download, make a decision about the product and if I like it, I buy the good quality original.
    If I buy a DVD or CD, I rip it to my hardrive. Much more convenient to have such a huge archive than hundreds of discs that might scratch or decay.
    And if a friend likes something or I want him to know about some, I give a copy to him. And if he likes it, he might buy it and spread the word too.
    So simple. So I dont feel like doing something wrong in doing it non-commercially.

    I think copiright holders should hold only all commercial rights.

    All other rights interfeere to much with public interest and the comon good.

    I recently returned home from a 2 year stay abroad and looking at the TV schedule I realized… They are showing the EXACT same shows as when I left. 99% are re-runs of old american sit-coms and CSI whatever.

    So what if the tv show you want to watch from a different country is never made/released legally in your country what then? I watch a lot of korean Dramas which are never released in America only way I can see them is to download them.

    Also why is it if you busy and can’t sit down in front of the tv to watch the shows at that specific time and you download it the next day to watch it, wrong, I’ll never understand that.

    Looks like the attitudes of these people need to be changed. I think all this will do is anger the populace more.

    When will they ever learn, it’s always more more more more and just plain greed. I mean, do you have to drive exotic sports cars and live big? The rich have 90% of the wealth in the USA so what are they complaining about a few people sharing? It’s more than likely the average joe not some guy selling fake dvd’s out of his jacket.

    It’s greed and the refusal to change that will be your downfall!
    Until you find a happy medium you will never stop it, so adapt or dissapear.
    Chill out and go away please or quit acting like spoiled brats and work with these people(TPB) as it’s likely they have some insight to how the future may be, and could be of some help. I’m sure there are better solutions than weird videos.
    Companies are charging too much for downloads!!

    Well, apparently when a new movie breaks box office records, it seems that all those people arent pirates.
    I live in the US and I dload alot of TV shows, why? Because they run alot fo shows concurently and I cant watch all them shows. I pay $75 a month for cable and I watch about 6 shows. But i will be damned if I let them come get me for downloading the damned things. As far as im concerned my CABLE BILL is the RIGHT to download the TV shows that i couldnt watch. I pay $75 a month for that right.

    ahh i need to also ADD that I hate commercials. I pay for the damned channels already, wtf would i want the commercials for? I have 99 channels and 5 that we as a family watch. The rest are shit we have to skip over to get to the ones we WANT. So keep in mind that we have 6 channels we PAY $75 a month for. And thats luckily about 4 hours a night TOTAL for all 6 channels. Considering 3 of those are LOCAL channels that we DONT need on CABLE, that would leave 3 channels that we pay $75 a month for. Oh and about 2 SHOWS that are on cable, and the REST would have been FREE if we DIDNT have cable. So SOMEONE needs to BLOW it out their ASS, for what we pay for those 2 shows, that are inundated with COMMERCIALS. Then those channels have PAID advertising on them ALL night and lord only knows what they play during the day since WE DONT WATCH it during the day. SO really we PAY $900 a year for 2 fuckin shows. ooooh please come after me for dloading those shows. Its humiliating enough!!!

    I thought I’d respond to your question. Around 150,000 people’s jobs depend on the film and TV industry in the UK. Many of these are people who are freelance and project workers who depend on DVD / film sales for their income. When you pay for internet access that money goes to the internet service provider, not to the people who’s hard work went into creating the film and TV content that you enjoy. So paying for internet access is not the same as paying for film and TV content.

    As you probably already know, the film industry is heavily reliant on reinvestment – it ploughs the money it makes from one film into the next and so on. The less money there is to reinvest, the more the industry dries up. The £500m we estimate as lost could go a long way to making more films.

    One of the things I think it is easy to forget is that for all the big successful blockbuster films, there are more which the industry took a risk on – put money into but didn’t recoup their production costs.

    For example, statistics collated by the UK Film council tell us that between 2000 and 2006, only 53 (8.1%) out of the 658 certified UK films released would have made a profit when you consider all the associated costs such as production, VAT, exhibition, distribution and retail margins, prints and advertising etc.

    I hope you agree that it is really important that the industry can still take these risks as otherwise we may lose the diversity of films. If downloading unauthorised copies of film content continues – then there is a real risk that we will end up with all our films following popular formats – as they will be the only ones which get funding.

    @ 102 Hi David. Here’s a response to your letter. Boo Hoo! You’re so full of shit, I hardly know where to begin.
    First, the days of Producers and actors raking in the dough is over. The crew and actors have to peel the dollars out of your hands, so don’t act generous. Like any company, the CEO’s reap the million plus rewards while the crews hired to run the show are paid a pittance. (How many cameramen have a 40 foot yaught in the bahamas?) So blow that argument out of your ass.
    150,000 people huh? Well. That’s a lot. So what? I’m sure Blockbuster had a few people working for them. Fuck ‘em. Who cares? If you, as a producer, could eliminate 150,000 jobs, I don’t think you’d hesitate. I hate how you try to come across as altruistic. That 500m could go into your pockets as profit, not overhead.
    But the most idiotic thing you said has to do with your production company putting out turkeys and expecting people to support your bad movie decisions. Want a profit? Stop making shitty movies! Don’t expect the viewing public to support your dumb ideas.

    Go on, take your risks, and if your movie sucks…well, tough luck chump, you took a risk!

    Um…did you see the shit that was released last year? Your prediction obviously came true. Movie companies always hinged their success on popular formats. That’s why you have dismal statistics.
