If UltraMegaBit failed to “adequately disclose” that these subscriptions renewed without members’ express approval – they deserve everything that the courts can throw at them. Any free trial that ends with an unwanted obligation is an unscrupulous business practice to say the least.

It’s hard to say if he’s telling this in good faith, but that’s irrelevant. This is simply an Invalid defense.
People should know by now that DMCA only holds as long as entertainment industry tolerates it. Once they have their sight on you, DMCA means nothing to them.

Everyone, especially the Americans, know there isn’t even a pretense of “law” in the USofA. Legalese is merely the vocabulary used to negotiate the bribe/extortion (depending on which side of the ledger you’re on).

Russia has Putin, America has Obama. Both are shocked, appalled, that the gangsters that bought them their entire careers are actually found in their administrations, doing what they’ve always done. And, when exposed, the citizens are so amazed, shocked, that they shuffle to the polls and re-elect them.

So, an American company gets a visit explaining that they’ve got “A nice thing going here. It sure would be sad to see it get all shot up.” A sack of cash changes hands. And it’s business as usual. Not back to business as usual. Nothing changed. That’s what you signed on for when you hung out the sign.
