No, they don’t have to prove you downloaded anything. They have to prove you were uploading (sharing) the file to others. Merely downloading is not infringing — in the same way that watching a streaming video is not infringing.

As for your client blocking an IP after receiving “X” number of hash-fails, well…by then it’s too late. If your client sent a packet which matches the hash for the piece requested and the MAFIAA’s client validates the checksum, it is now considered to be evidence.
