If ISP’s are not involved in the monitoring then there is no way they could monitor newsgroups,ftp or rapidshare (only physical access to cables would be an option). Also for rapidshare a lot of files are password encrypted to protect them from being deleted which also prevents the usefullness of deep packet inspection.
