Smelling Blood, BREIN Targets Mininova, Torrentspy and Btjunkie

Written by enigmax on December 07, 2007

Following the huge pressure it successfully put on LeaseWeb to shut BitTorrent sites, anti-piracy outfit BREIN smells blood as it casts a wider net to force other ISPs to shut down other huge sites, including the likes of Mininova, TorrentSpy and BTJunkie.

During the last month we’ve reported a few times on the likelihood that BREIN pressure would lead to a shuttering of BitTorrent sites at LeaseWeb. After LeaseWeb issued an ultimatum for BitTorrent sites to leave its hosting by December 1st, at least ten major sites left for hosting in new countries such as Sweden, while others felt that re-locating within the Netherlands would be acceptable, providing it was with another ISP.

BREIN director Tim Kuik is proud of these successes in The Netherlands, and although some sites have moved outside BREIN’s ‘jurisdiction’ by moving abroad, he is delighted that they have “swept the Dutch pavement clean” of torrent sites.

It seems that BREIN is not planning to stop yet, as Kuik once again threatens BitTorrent sites that are still hosted in The Netherlands: “If they do not disappear, civil legal action will follow, or even criminal legal action.”

So who will be their next target? The site Dutch site Tweakers.net is reporting that established names such as Torrentspy, mininova and Btjunkie may be targets shortly.

BREIN intends to use the everlasting.nu case to force ISPs to cough up torrent site admin’s details. However, Kuik admits the difficulties in tracking down the owners of many torrent sites as the administrators take extraordinary steps to hide their identities, including giving false details to their hosting provider. Clearly, even if BREIN gets information from the ISP, there’s every chance that these details are false, giving the site admins the chance to relocate and start again with a different host, possibly in a different country.

Last week TorrentFreak asked BREIN why they didn’t take action against sites like mininova. Their address is easy to find since they are a registered company in The Netherlands. Tim Kuik from BREIN did not want to comment on that question (scared they will lose?), but it now looks like they have shifted strategies, and target the ISPs now.

BREIN is about to start pressurizing other Dutch ISPs after their successes at LeaseWeb, who incidentally still host dozens of other BitTorrent sites. Kuik issued a veiled threat to ISPs who accept these anonymous accounts: “Hosting providers who do not check that their customer data is correct run the risk that they themselves could be held responsible for the actions of those customers.”

I strongly disagree! Many, many people (inc. “noobs”) come here, and have no idea why the rest of the online shadow world is not as open as the public torrent sites.

This guy did a great job explaining what the situation is, and why it is; as opposed to the typical flame against the ignorant, this guy gave them education in a polite, friendly, but firm manner.

Please, do not make the common mistake of confusing ignorance/knowledge/education with intelligence. They are two _very_ different concepts.

Why doesn’t some torrent site make a successful case againt Brein, RIAA or what ever and then use that case in future problems?

Beat them in they own game![/quote]

Don’t forget, you are talking to amateurs with lower- and middle-class income and education; as smart and passionate as we may be, we do not have the same resources the mafIAA does.

I think it’s time to find a fat juicy SCANDAL tucked in BREIN as was found in Media Defender. Media Defender’s website is still up, but they were HURT BAD.

Quote from me, Mr Thomas ~ “I am all for freedom of speech, how can this file-sharing, making no profit, be as criminal as robbing a bank, non-profit File-sharing is not immoral & must be legal, will this mean lets throw constitution fights in prison as terrorists, wtf has our government been up too, protect our rights as a free Unionized nation, we are the land of the free, the land of human rights, not guillotines, and torture. The Geneva Conventions must be followed, any leader who disobeys the Geneva Conventions must get the Death Penalty under treason or else Americas government will f**k us all and rape our wives. Stop! Corporate America, and corporate child/adult pornographica”.

I agree, in fact I’ve taken it upon myself to host several trackers upon my web root hosting server infrastructure. For those who don’t understand, I’ve basically have a huge server that’s faster than your computer x10 combined on a gigabit fiber optic connection. Anyone who connects to my server while I’m seeding stuff can expect a down speed of about 1Mbs if their connection can handle it. ;)
This of course isn’t the main function of the server; just a little side job so it has something else to do with all that extra power.

Why don’t I hang myself, get a public TV station and show myself die on national TV, or show myself die on youtube. Yeah you would love that if I did that, boy you could sell stuff off my suffering and get publicity.

68 Dec 08, 2007 at 14:54 by sabret00the

mininova is the best public tracker out right now. while i know many enthusiasts are going nuts for private trackers. i’d argue they do more damage than good. look at indietorrents for example; it’s almost impossible to get into unless you’re deep in the scene and even then it’s hard. if you’re there for leeching then it’s all good but if you are really into the music and just want to pick up rare gems, you’re out of luck because the music is locked away inside these private communities.

Haha those tactics are low, they are using blackmail and mafia-esque tactics to bully the isps into booting the torrent sites off, because they know they have no chance if they take on the sites and their admin themselves. This is highly illegal, if the relevant authorities knew about this BREIN wouldn’t exist. Those of you who live in the Netherlands, let your government and consumer protection agencies know what these criminals are doing, shut them down once and for all.

The primary reason hit and run is such a problem is because people “with a brain” (as #11 put it) have heard of jimmy getting slapped with these ridiculous fines, and don’t want to receive that themselves.

Private Trackers are great, if you can get in. I’m a member in two and find it absolutely great. I wish I could find one that wasn’t music oriented though :/.

Public Trackers tend to be slower, and have many “dead” torrents and a lot of fakes, however, with Demonoid, I didn’t have to wait for the file(s) I was looking for to pop-up. They were burried in the masses. Sure, it took some digging and some effort, but it paid off.

One last thing, this whole “quality” focus is kind of annoying. Sure, I don’t want to download some 64KB/s GoogTube rip, but these FLAC files ranging from 500MB to 1GB are ridiculous. I’m perfectly happy with a 192KB/s-320KB/s MP3 but anything beyond that is too much space for too little quality improvement. Why use 1TB of space when I can use 300GB for slightly less quality. It’s good I suppose, to encourage the whole quality thing, but I think its going a bit too far when you have to wait 30min-1hour for an album to download, and after a few days of browsing you realize you’re out of HD space, kinda ridiculous.
