Exactly. All this buzz is just a reaction to the ongoing abuse of judicial system. And the root cause of this abuse is not even ethically challenged lawyers — there always be those who exploit loopholes in the law to their advantage: it’s a question of the usefulness of parasites. The culprit is the law, and in this case, the copyright statute, which allows plaintiff to elect statutory damages if he cannot prove or does not want to prove the actual ones.

And the numbers are outrageous 150K for a piece of smut? The laws were written prior to Internet and meant to deal with large-scale commercial infringement, not individual file-sharers.

Perhaps we should focus more on how outrageous the penalties are for copyright infringement, rather than arguing over what is copyright-able.
If I get caught illegally downloading, I should have a chance to pay for the price of the product, and a little bit more for the cost of catching people doing it.
