The fastest way to push back hard on Canadian Record labels and the CRIA is to launch a counter suit asking the courts to rule against any further “blank media levy” payments to these companies.

That levy attached to all blank media in Canada is to reimburse them for this very thing.

If they wish to shut down PSP’s in Canada then they should be made to give up their levy checks…

That statement is just utterly false. No laws have changed to state that, and they probably won’t ever be, if the politicians are smart enough (which, perhaps some aren’t, but enough are). Pure bullshit. Meaning of course, THIS WOULD NOT HOLD UP IN A COURT OF LAW.

Illegal in Canada? I am still looking for good references on that. About the “Federal Court, in a decision issued March 31, 2004 [...]“, the only thing I found is a judge stating that an anonymous name, sharing ’something’ (that may or may not be related to the file name) on a computer (P2P), at a specific date and time is NOT enough for that judge to force an ISP to break a client’s right to privacy.
According to the Canadian Copyright Act (R.S., 1985, c.C-42) you can clearly download, it’s legal; but the ’sharing’ and letting others download from YOUR computer (distribution) is unclear.
