Anyone who thinks that Comcast played this off real slick needs to think a bit more out of the box. Everyone that can just take the money.

If you end up getting charged for anything Comcast will have just admitted that they have the ability to not only log illegal downloads on their network but identify each and every one of them. This would be a retarded move to make, though they are pretty dumb. I would personally counter sue on ignorance because they did not let me know it was illegal. The **AA's of the world would sue in a second to have every illegal download blocked. And finally this would be the largest "facilitation" to commit a crime ever recorded as they would admit it happened and they allowed it without even a warning.

A lot of people can't switch because Comcast is the only ISP in the area.

There's 2 others in my area and I'm going to be switching soon.

I don't think they're in a position to make demands. The sheer arrogance is astonishing. How can they claim the moral high ground and sit in judgement of us with such a self-righteous attitude, when they were caught breaking the law.

This is clearly a two finger salute to any who use bt.

"What IS illegal is if I either A. upload it to someone else or B. make available for upload to someone else when, you are not the rights holder."

No but you don'get it. TBP does not make anything available. The user does. Kind off.

#73 Anon, let's look at it from another angle. Does ANY ISP require a similar sworn statement w.r.t. to the use of HTTP or FTP for example?

What's the difference between P2P protocols and HTTP, FTP etc., which all of them are agnostic of the copyright status of the bits being transported (there's no "copyrighted-do-not-transfer-bit" designed in them)?

Why does Comcast discriminate against P2P protocols, while you could just as well download and upload gazillions of bytes with the other protocols?

IMHO, all this is merely a matter of bandwidth provisioning, and has nothing to do with copyright. Comcast knows that P2P users consume more bandwidth than other users -- not because P2P is inherently more inefficient, but because P2P users tend to be power users in a more general sense --, bandwidth that they have to buy from their upstream Tier-1 network providers at a high cost.

Actually, it's not P2P users who Comcat hates, it's power users in general: they more people use their bandwidth, the less attractive they are as customers. So if Comcast tries to piss off P2P users with such legal rubbish non-sense, that's not really because of copyright infrigement (they couldn't care less), but because of them being power users (resource hogs, in their view).

"For example, there is still a large portion of BitTorrent users who think that downloading a TV-show that they could have watched for free on TV, is not a crime."

Um, because it isn't. As usual, TF, we've got some epic fail in the details. If downloading a tv show that would have been free (network, obviously) were illegal, then I couldn't watch it streaming on ABC, NBC, Hulu, etc. What IS illegal is if I either A. upload it to someone else or B. make available for upload to someone else when, you are not the rights holder. This is why BitTorrent falls into legality problems, due to the uploading that occurs - not the downloading.

Downloading on its own is still a mostly legal (though in some cases a grey one) area, at least in the USA.

I'm not sure how you're getting that out of what the form says. The form states:

" I certify that my use or attempted use of the “Peer-to-Peer” protocol(s) specified above to share computer files and/or Lotus Notes to send
emails was for a lawful purpose consistent with applicable copyright and other laws. "

I read this not as "100% of your torrent downloads must not have infringed copyright", but as "if you downloaded an (even 1) uncopyrighted work (within the time frame) and believe your download was hindered"

What do you think?

EVERYTHING created is afforded the status of copyright by its creator. Even open-source free software that can be legally transmitted over P2P networks is copyrighted.

So, Comcast have managed to work out a way to not pay anybody and just sit on that money.

Piracy is one thing, asking someone to pay you for it is plain stupid.

Do Comcast even have the right to ask for a sworn statement?

What if someone denies making such a statement, and sues Comcast because they didn't want to pay?

What's hilarious about the comments here are the people saying that Comcast users should just switch ISPs. As anyone who has Comcast knows, often times CC is the only ISP in the area. As such, they'll monopolize the zone and force absurd payments on the users (I just recently switched from 12mbs to 1mbs because I couldn't afford anything above $50 a month. there's literally a $15 difference in cost).
On top of that, they throttle bittorrent? Come on, seriously. Just switching ISPs isn't an option, and it certainly doesn't fix the problem of Comcast acting like they own the whole fucking internet.
And what if users were seeding both legal and "illegal" torrents? Certainly they're entitled to some sort of settlement.

Don’t just blame Comcast. The main blame should go to the law firm that brought this class action suit and agreed to the settlement. They don’t care. They got paid for helping who?
The lawyers win again. :(

Comcasts network has basically 0 security.
Meaning you can run a modem un-provisioned on there network..

Buy yourself a SB5101 and a jtag cable . Flash the modem with haxorware.
Enjoy your free 30+Mb internet.
I have had free comcast i-net coming up on 3 years.
BTW
d11_m_na_c05.cm <- this config was never throttled. As its considered a "business" config.

"Comcast’s BitTorrent Settlement Excludes Pirates"

"Affected users can now claim their part of the $16 million fund that was setup, but only if they state under penalty of perjury that BitTorrent was never used to download copyrighted content."

So which is it? Are they only excluding pirates, or everybody who downloaded copyrighted content?

This does not surprise me one bit. cheap parasitic scum that they are, also recently bought NBC Television which was owned by General Electric. This will make them even more threatening and idiotic as such.

They should now be known as "Con-cast"

Look at it this way:

The internet is like music. The ISPs are like record companies and the common user of the internet is like the musicians. We use ISPs for a while to get our internet but once technology advances (just like in the music industry) we'll either be producing our own abilities to connect or it'll end up being a government run/world run internet which will cut out ISPs for good.

I know some would say thats impossible or highly unlikely but I say this, think outside the box. Its very possible but not currently with the still infant internet. Every year the internet improves, its just a matter of time.

@51 Well you say there is no other provider that give you so much bandwidth as comcast provides.

You say they (comcast) throttle the bandwidth they provide to you.

So how you know that others don't provide you more bandwidth, because if they don't throttle it then they might actually be faster by providing less (unthrottled) Mbps than comcast many (throttled) Mbps.

What i mean is let's say i buy from provider A a 50Mbps connection that is throttled and pay 40euro per month. A neigbor buy from provider B a 40euro connection but it's not throttled and it's only 30Mbps.
After a month of downloads my download managers say that my real average bandwidth was 28Mbps (because ok i pay for 50Mbps but provider throtted it). So, lets say, i ask my neigbor to tell me his monthly stats and in my surprise his average bandwidth was 27.5Mbps and he didn't have slowdowns on various sites or downloads because his provider don't throttle the bandwidth they offer.

So my conclusion is if your provider gives more bandwidth than other providers BUT throttles. in reallity he might actually be slower that other providers that offer unthrottled speeds.

Considering the near monopolies the giant ISPs have on Internet access, I don't think they should be free to do whatever they want because there's so little competition.

Stop trolling.

2 Jan 15, 2010 at 00:41 by lol
do yourself a favor, tell them to keep there money and switch providers.

First I wish I could.. give me a the name of a provider in my area that even comes close to bandwidth they provide ... oh wait there isn't one riiight.

Secondly, I know they are already doing the same with video streaming from Hulu/Youtube/Netflix etc ... Somedays its pretty decent but it's definitely gotten slower over the course of the past couple of months. I run speed and download tests and they come through decent enough but streaming content from all those providers above within the same window have noticible bandwidth issues. I hope others more inclined and move skilled are watching for this too and making note.

So comcast CAN distinguish which torrents you download are illegal? Oh I see; get maximum profit by throttling all torrents without distinction to minimize bandwidth costs, and later, minimize settlement payouts by making moral users jump through legal hoops for 16 bucks. If comcast doesn't want to distinguish your legal torrents from the pirates' illegal ones at the time then your beef is with comcast.

Thank HEAVENS my internet provider is not, and has never been, Comcast!
But, I get offers for their stinking cable service and internet almost every day by mail. Let them keep sending me mail. Let them keep wasting money.
I will make sure to stir everyone I can away from Comcast.

@40

Not to mention they would be pirating themselves if they did keep storage like that around, whether or not it was used for 'evidence' or otherwise.

Honestly? Who cares! Check the damn box and move on! It ain't that big a freaking deal, they ain't gonna hunt you in the streets. What evidence do they have that you did download anything? An IP log? Blah! We've seen how many of those have worked. As long as you don't go ZOMG I feel so guilty over $16, you're fine. If you are seriously feeling guilty, then why the bloody hell did you pirate in the first place? Seriously people, figure out if you have morals or not before doing this crap.

Even if they kept logs, that doesn;t prove anything. They won;t have logged contents, since the storage space required would be far outside of anything they could afford, so all they'll have are a bunch of entries showing (possibly encrypted) connections to seemingly random residential IP addresses; i.e. absolutely meaningless.
