Nice but they should also have the IP address along with dates and times of the activity.

I presume the ISP in question does not have logs covering these events to be able to identify the user which would explain the original lack of this user’s name and address. Being a DirectConnect case this could be years old and out of logging range.

So it is easy for this ISP to reject this Court order when it is impossible to comply with without total ISP closure for all of this ISP’s subscribers. Happy news indeed for this music pirate.

The ISP have said today in their blog (in Galician and in Spanish: http://quecheparece.blogs-r.com/weblog/ver-post/sobre_a_sentenza) that they are not going comply with the ordered action because they can not since a nickname is not enough information for them to identify a client.

I’m Guessing it wont take him long to find a new ISP.

I’m not sure that isn’t a breach of his human rights.

This is clearly a violation of EU law and a human rights violation according to the UN who make very clear that copyright infringement is not a reason to cut a connection.

I don’t get why they did not do this the right way of discovering this user’s name and address to sue them in Court directly. Whatever the reason for that failure then using a human rights violation as a back-up plan is clearly false.

Someone in Spain needs to send this Judge as copy of this UN declaration that was passed unanimously by all UN members including Spain with added text like “proof you are a moron”. Any volunteers for that one?
