You are correct the cant be used in court. But if you are innocent and submit to one you wont need to go to court.

It’s good to here a bit of due diligence is being done by these guys. My social media now states my favourite music is Des O’Connor, Val Doonican & Jim Reeves :)

These are civil cases meaning that if the defendant has no real attachable assets then a judgement against him/her is worthless. A good example would be a student accessed of downloading something.

These greedy companies work on the idea of numbers and volume. It is not worth their time to go after someone if there will be nothing to attach.

I think, rather that simply dropping the case and eating the lost sale(s), they would probably amend their threats to reflect a living person currently using the account.

My Grandmother, for example, left all of her utilities in my Grandfather’s name after he passed nearly 20 years ago. If Malibu Media discovered a pirated copy of Captain America Winter Solider on “his” internet account (assuming they had one), the initial letter would likely be sent to my Grandfather. But once Malibu discovered he has been dead for awhile and obviously not in anyway possible to offender, would then begin addressing my Grandmother instead, assuming she had been using the account.
