Dragons’ Den Company DMCAs Google To Censor Competitor

This week millions of Brits sat down to watch the start of a new series of Dragons’ Den on the BBC. As usual, a handful of budding entrepreneurs put their businesses before five captains of industry in the hope of securing investment for their company. One such business, SendMyBag, was slated by the Dragons as “easily copied”, but now in an interesting twist the delivery service is having entire pages from a competitor’s website removed from Google due to a copyright dispute over a single image.

Fans of Dragons’ Den who watched the launch of the new series on the BBC last Sunday will have felt completely at home. Cosmetic alterations to the set aside, the format – which is licensed from Sony Pictures – remained completely unchanged.

As usual, a series of hopeful entrepreneurs pitched their business ideas to five venture capitalists with the aim of securing a cash injection. One of them, SendMyBag founder and CEO Adam Ewart, hoped to persuade the Dragons to part with a £100k investment in return for 5% equity of his door-to-door luggage delivery service.

It didn’t go well.

Despite a decent pitch and having a profitable business already operating, the Dragons’ trashed Ewart’s idea as “ridiculous, ludicrous, stupid and insane,” with one of the Dragons bemoaning the fact that SendMyBag’s business model could be easily copied by a competitor.

Interestingly, and as revealed by a series of DMCA takedown notices sent by SendMyBag to Google, what can also be easily copied by SendMyBag’s competitors is the company’s intellectual property.

SendMyBag’s complaints are against a company called UniBaggage. The Dragons’ Den hopeful told the search giant on numerous occasions that UniBaggage had infringed their copyrights.

SendMyBag say that UniBaggage are using their company logo without permission. Each time Google complied with the takedown requests and de-indexed not only the image but entire webpages, meaning that UniBaggage’s website became less visible to potential customers trying to find the site using the search engine.

As can be seen from the screenshot above, UniBaggage did indeed use SendMyBag’s logo for price comparison purposes. In the US so-called ‘comparative advertising’ is perfectly acceptable but it took until 2008 and a directive from the European Commission to establish comparative advertising as a means for improving competition and fostering consumer choice in Europe.

“The directive provided that ‘it may… be indispensable, in order to make comparative advertising effective, to identify the goods and services of a competitor, making reference to a trademark or trade name of which the latter is proprietor… Such use… does not breach [the trademark owner’s rights]’,” explains Richard Taylor of DLA Piper.

However, advice from the lawfirm Chadwick Lawrence suggests that to avoid accusations of “unlawful comparative advertising” and complications with infringement claims, companies should “avoid reproduction of competitor’s logos.”

And this is exactly what is happening here. SendMyBag are complaining to Google about copyright infringement and may even have a claim, but considering the way the company has gone about it one has to wonder if their main aim is to put right a possible wrong, or to hinder a competitor in its quest for business.

TorrentFreak contacted both companies for comment but only UniBaggage responded. They told us that SendMyBag didn’t contact the company with any infringement complaints before filing complaints with Google.

“This company has done this to us a few times,” Managing Director Paul Stewart explained. “Each time [we complain] Google reverses [the takedowns] but we still lose say 10 days each time they do this. Considering we are a very seasonal business it does affect us.”

Stewart appears grateful that Google eventually reinstates his webpages but says his company will be taking legal advice if the problem isn’t sorted “within the next week.”

While we leave SendMyBag and UniBaggage to fight out their dispute, again we have to come back to the almost impossible task faced by the middleman – Google.

Instead of a simple email to their competitor (who may or may not have a case), SendMyBag have chosen to take their punitive action through a proxy, one that can’t reasonably expected to be judge and jury in a complex copyright dispute that is potentially affected by fair-use issues provided for in secondary legislation.

So next time you search Google and don’t find what you’re looking for, are you going to presume as you have done for the last few years that the reason for that is because the content or product you want doesn’t exist? Or are you going to wonder if a copyright holder has censored your search?

    I don’t understand how Google have got themselves into this position. Surely they should have fought and explained early on to the Judges, courts and US government that Google are nothing more that an indexer and that the real peope who need/should be held responsible are the websites that are accused of infringement.

      sadly they are bound by US law and have to respond to DMCA takedowns

      that whole law is very flawed and only now we slowly begin to see the amount of damage it does to the whole economy, just to try and protect an obsolete monopoly

        Google only has to respond to valid DMCA takedowns. But they respond to every takedown under the sun without any fact checking, and refuse to punish false takedowns, because they’re a bunch of cowards whipped by the copyright industry.

          Google gets like a million DMCA notices per week. How can you expect them to do fact checking with that many notices to handle? Should they employ half of America’s population to do the fact checking? Last time I checked the rightsholders don’t pay a single penny to get these notices processed and served.

          Next time use your brain cells a little before commenting. Unless the law is changed this is the way things will remain. So please concentrate your efforts on changing the law rather than bashing Google.

          that’s why there should be a fee attached to each takedown, so the company that gets them can hire people to actually check them

       Google and all other search engines should steer clear of this shit and ignore any and all takedown notices.

      The whole CopyWrong concept is so outdated and prehistoric it simply needs to be scrapped completely.  But if proprietary asswipes want some sorta protection in our modern, internet-enabled life then they should propose proper and decent ideas to parliament and let us ALL have a chance to debate the proposals democratically and in full.

      The current law is a crock of shit and needs abrogated ASAP.

          The problem is that Google doesn’t WANT to put an end to this.

          The could boycott the MAFIAA as they have no obligation to show their webpages at all.

          However Google can also be less extreme and use the DMCA law against the MAFIAA by sueing them for all the bogus takedowns they received.

          The victims of the MAFIAA mostly don’t have the financial capabities to do it but Google does, so why wouldn’t they ? It could even make them some money in awerded damages.

          Because there is no incentive for Google to sue MAFIAA and drag it out in court. A lawsuit starts at $100,000 ….A lawyer’s fee starts at $400 (and can go even higher) an hour. Now, who are we fighting again? Google rather NOT want to go in a lengthy court battle with the MAFIAA for “false” takedowns.

          What damages are you talking about? Treble damages to the victims? Ye right :)

          Google suing is not in their nature OR business to do so. If YOU want to do something, take a law degree and try your luck; getting in touch with “victims” and then proceed. You’ll be out of roof and desk by the 3rd year in court.

        Why on Earth would Google sue? They don’t lose anything. The other company loses business. It doesn’t hurt Google, so why get involved?

      The problem is, Google’s no longer just an indexer. It’s also a video hoster which needs to make deals with the big record companies so it can legally host their music, it’s a book searcher which needs the favor of book publishers to stay alive, it owns Android and needs to make deals with content providers to lure users to it, and it’s trying to find ways to get into the music/TV business. If Google were just a search indexer, yeah, it would fight a lot harder than it is, but right now, it needs to suck up to the RIAA/MPAA/etc for its other ventures to thrive.

    Something must be done already! I suggest that DMCA requests must be charged dependent on how many false requests someone did. For example charge someone 50€ for the initial request. If it is acceptable true return the 50€. If not keep the 50€ and request a 50€ fine. If the same person does a new DMCA request charge him 50^2€ and if true return the money back and if false charge an extra (50*2)^2€ and so on. Then we will see if companies like Dragons’ Den will have such large balls and bucks to make useless requests. Google can make a lot of money out of this.

    ONE ISSUE…. which continues to piss me off about “mainland” based companies.
    NI –> Mainland UK , is more expensive. (at least it’s not too much with you guys)
    Northern Ireland –> Northern Ireland is DEARER ? WTF…. N.I is a smaller country.

    Considering the amount of students etc… going to Scotland / England from N.I.
    They will hate that too.

    Royal Mail is the same price for everyone, for a reason.

      Far better would be compromise server, monitor comms, expose malpractice. (that is, if you actually want to smack a business down hard enough it’s unlikely to get back up again.)

    I search engine should be neutral, only modifying results in order to improve accuracy. All these infringement and copyrights modifications should be handled outside of google. Google has been pulled in to referee a fight it had no business being near.

      As it just indexes sites publicly available, it is only showing you what is available to you already. It has done nothing wrong, even if the site is violating some rules. They can’t be expected to go through each site and verify that they play nice and follow all rules. That’s the authorities job.

      DMCA is a load of BS to. It needs scrapping altogether because of what I said above. If I set-up a search engine and left it without being touched for 5 years, how can I be liable for the users actions? A simple search engine can be easily done by a novice. Are they expected to know the laws of everything before being able to share it with the network? The internet should have no laws. The network protocol is the only thing that determines any rules. You accept all risks when you connect to another computer. End of. This should also include financial transactions. Encryption, knowing the risks and being aware are your tools for protection. Buy from trusted places.

      Honestly copyrights are only going to get extended from now on, it is not going to get better.

    Just one thing. It seems to happen regularly, so why not just replace the “SendMyBag logo with a clear text “SendMyBag”? That would remove the excuse of “copyright infringement” to Google while they sort things out with a judge.

    Note that this is a clear case where sanctions for DMCA abuse would be really needed.
