Dying is no excuse says the RIAA
Written by Ernesto on August 13, 2006The RIAA is known for their shameless actions, there’s really now way to escape a lawsuit. Take the Warner Bros. v. Scantlebury case for example.
The defendant in this case passed away before the court made a ruling. However, according to the RIAA this was not enough to “close the case”.
Instead, the RIAA gives the family of the deceased defendant 60 days to grieve, before they start taking depositions of the late Mr. Scantlebury’s children.
In the “motion to stay case and extend all deadlines” we read:
Plaintiffs do not believe it appropriate to discuss a resolution of the case with the family so close to Mr. Scantlebury’s passing. Plaintiffs therefore request a stay of 60 days to allow the family additional time to grieve.
Way to go….

If the lawsuit was filed against the deceased “name” then how can the damn RIAA now go after the family now? If this suit isnt dropped someone should email cnn\cbc let them know lol… Maybe they will actually air something etc.. That is sad..

Now that is just a tad crazy, isnt it? I mean, it wasn’t against the FAMILY, it was against HIM. Now, why does the RIAA do shit like this? Probably because they are assholes, obsessed with showing the world that they are right, and that they know what the people of the world want.
The RIAA will do what they feel like until they are shown they cant get away with it and accept that P2P sharing wether its historically on slower networks (IE dubbing cassettes, vhs) or modern faster networks(napster, kazaa, bearshare, torrents). Its here to stay and they need to adapt their marketing campains(sp) to utilize it instead of throwing more problems at their customers. They are alienating every potential customer due to their “need” for profits.

My bet is that they will go after the estate left behind by the deceased. Is it ghoulish? Yep. Can they do it? I wouldn’t doubt it for a second.
MelL is right they will try and take it from the estate. Unfortunately what is right and what is lawful is not the same thing.
Is there absolutely no real law in the US? (Yeah, I know it’s some shitty “case law” system there…)
So can someone (with enough money?) just can hold a random person responsible for something (just because he has money?) which said person never did?
If that’s truly so, then I’m glad to be living in Europe. :-)
P.S. I understand that relatives are somewhat ‘related’. :-) But still, they’re different persons. Or maybe a man should spend his whole lifetime in a jail just because his second cousin murdered someone? That’s the same logic to me.
