1.) OK, the computer is automatically tagging these files, but...  Couldn&#039;t the humans who programmed it be a little more specific in what constitutes a match?  Wouldn&#039;t having match criteria being so broad as basically saying
if(file.name==&quot;*.mp3&quot;)
then send.DMCA-Alert
basically be &quot;deliberate lies&quot; via proxy?  In other words, they knew they were going to take out a ton of stuff that wasn&#039;t theirs, and did nothing to prevent it.


2.) Considering the documentation that exists on how poor the automated scanners are (see the nearly weekly &quot;Google refuses DMCA requests to legit sources&quot; reports, the bird songs that got tagged twice till the issue went viral, etc)...  Couldn&#039;t the EFF also argue Warner Bro knew there system was not working well, and by not having a human review the automated results, or at least not trying to tweak their filters to weed out false positives, that they should be held capable for their requests.]]></description>
