I disagree with your assessment of Russia. The internet, in a way that was never predicted at its birth, has shown every single person in the world that all governments are conducting internet surveillance, counter intelligence and covert operations against outside forces as well as their own citizens. When you presume that your political system is better than a foreign political system all you do is deny your own governments culpability with regards to surveillance. These methods are universal and there is no state free of them. Even the comments at Torrent Freak are analyzed by the US and Russian authorities. All governments are trying to hold onto to the old world model of propaganda and political control. This was an easier task in the past when I could be told by my government during the Falklands War that Argentinians were the enemy. After all I had never been to Argentina and had never spoken to an Argentinian in Argentina., Now I see an Argentinian flag in my client and I know he is not my enemy because we are sharing files. You don't share information with the enemy. I share with Russians, Ukrainians, Indians, Africans, Americans, etc, etc, and of course my own people. Who is my enemy then?

No surprise to see BREIN in the back stage-whispering to the politicians what they want said. Not that it will do them much good. Any nation trying to implement data retention must now prove the necessity of implementing such surveillance trumps what the highest court in the EU has laid down.

That will not be easy. And trying and failing will be EXPENSIVE. As in the nation being fined for being in violation of the EU charter.

True, as far as it goes.

However, there is a VERY large difference between clandestine intelligence operations without the sanction of law...

...and legally abolishing the right of individual privacy for everyone which is what the data retention directive does.

In one of these paradigms, it is assumed that everyone is innocent until proven guilty. In the other it is assumed everyone is, or will be, guilty of something. This is a VERY big step.

The most obvious reply to that is "We have a lot more parties in the EU than the US does, and quite a few of them got where they are on humanitarian platforms".

The EU could create the Hague tribunal. The US hasn't been able to prosecute war criminals impartially since Nürnberg.

In short, we can still react by firing the bums who try to peddle us the antihumanitarian agenda. I have no doubts that 30 years from now we may create our own Cheney's, Wolfowiczes and Rumsfelds trying to sell us officially sanctioned torture...unless we take care not to follow down the US example.

But that day is not today.
