FAIL – Prominent Pirate Party Politician Goes After Book Pirates

Julia Schramm, a prominent board member of the German Pirate Party, had success in scoring a lucrative book deal and finally had her work published this week. Nothing out of the ordinary there, if it wasn’t for the fact that Schramm and her publisher are now clamping down on book pirates. Dropbox removed a copy of Schramm’s book after it received a DMCA take-down request today and another copy hosted on the Pirate Party’s own site also vanished into thin air.

Julia Schramm is a well-known German blogger and prominent member of the local Pirate party.

In common with many other Pirates the 26-year old detests the “content mafia” and she previously described the term “intellectual property” as “disgusting“.

At least… she used to.

Yesterday, when Schramm’s book “Click Me: Confessions of an Internet exhibitionist” was released both on paper and as an e-book, the tide started to turn.

To help her publish the book Schramm signed a major deal with the Random House owned publisher Albrecht Knaus Verlag. In addition to earning a 100,000 euro advance, this deal with the “content mafia” required her to sign away her copyrights.

This means that Schramm, nor any other person, is able to share a copy of the book. This is quite obviously an awkward position for a board member of the German Pirate Party.

To make matters even worse it turns out that Schramm and her publisher are policing the Internet heavily for unauthorized copies of the book. While it is still available on many torrent sites, a pirated version posted to Dropbox disappeared this morning, to be replaced by the following message:

“This file is no longer available due to a takedown request under the Digital Millennium Copyright Act by Julia Schramm Autorin der Verlagsgruppe Random House.”

A copy hosted on the Pirate Party’s wiki disappeared as well.


No pirates please

Responding to the controversy, the Pirate Party politician defends her move with the argument that people can still read her work elsewhere.

“There will always be free texts from me on my blog, and there are also book excerpts,” she told Welt, adding that she will make her book available for free in 10 years when she gets her copyrights back.

While we’re not condemning people’s right to sign copyrights away to publishers, it is certainly not something you would expect from a Pirate Party politician.

At the very minimum, it’s not in line with the party program which states:

“We propose to legalize noncommercial copying, publishing, storage and use of works to improve the overall availability of information, knowledge and culture, as this represents an essential prerequisite for the social, technical and economic development of our society.”

After the issue was widely reported in the German media, Schramm eventually came to the realization that it wasn’t her best decision ever. “In retrospect, of course, I could have negotiated more aggressively with the publisher on some aspects.”

“I was just very glad to be able to fulfill my dream to write a book,” she adds.

While writing a book is free and doesn’t require the exploitation of copyright (see other Pirates), being in the spotlight and making good money often requires sacrifices.

When that’s the case, it appears that certain ideals and aspirations are easier to throw overboard than others.

          I’m confused. I’ve read this story in several places now and some (like Techdirt which posted the story earlier) say the publisher is the one doing this in her name, while others (like TorrentFreak) are trying to imply it’s her doing it. After reading this particular version of the story, the first question I have to ask is this; if she doesn’t own the copyright, why would she be the one claiming copyright by sending notices? I really would like to know once and for all who is behind these take downs. As an aside I’d also like to point out that while Pirate Party members have a desire to change copyright law to something more ideal, they still have to follow current law until that actually happens.

        If you’re talking about the Streisand Effect, then, yes, this will help promote her book. But by encouraging more people to pirate her book because of how hypocritical she’s being, we can essentially negate the Streisand Effect.

        The German title is “Klick mich”, which is pretty close to the well-known cliché phrase “Fick mich” (= fuck me)… and it ends with “exhibitionist”.

        Yeah, as a matter of fact it does. You can’t proclaim to be in support of piracy, aka be in the Pirate Party, and then do something that is so obviously NOT in support of it. When she signed away her rights to a publisher she was essentially aligning her beliefs with the publisher, i.e. that she needed to aggressively protect her copyrights.           That’s bullshit. Maybe she could’ve be more aggresive in the negotiations, but maybe she wasn’t in any position to argue. It was either publishing a book, that somebody else will try to ‘protect’, or not publish a book at all. Of course, option #1 isn’t ideal for a member of the Pirate Party. But it’s still better than the other one. More ‘added value’.

          I also dare say that due to it being published and advertised, it will be pirated by more people than it would have been, should she only upload it on her blog.

          Being pro-piracy doesn’t mean giving away all your things for free. There wouldn’t be a book to talk about in the first place, if she knew she wouldn’t get any money for it. There’s nothing unnatural about it.

        You know, the 100,000 euros isn’t even the biggest issue I think. The emotional blackmail is worse – publishers KNOW authors want desperately to see their work in print (““I was just very glad to be able to fulfill my dream to write a book,” she adds.” )and can be easily manipulated.  

        And note, I’m NOT saying that’s okay.  It’s still pretty bad that she abandoned her ideals – which now basically mean nothing because she walked away from them when nudged a bit (it’s not like there was a gun to her head.)  But I think the manipulative publishers are also pretty disgusting.  We hear about HER story because of the irony, but there are many, many, many authors who get pressured into stupid contracts and get swayed towards ossified business models because of this kind of emotional blackmail.  

        What I don’t understand is why she didn’t publish it herself.  Self-publishing is generally much more successful when the author already has a platform, which she did.

      She also thinks she has to go around suing people for her book to make money, despite the fact authors like Peter Coelho(among many others) have proven that it doesn’t matter if people download your book for free – because there are more than enough people willing to pay for it.

    This just goes to show, how ideologies are often just a mask on top of desire. For example, many conservatives carry the flag simply because they don’t want to pay taxes and share their money with other people. Nothing wrong with that, I just wish people would say it straight.

    This is one of the reasons for political stale mates. People are discussing and fighting through invented positions, rather then addressing the real issues at hand. Take the Tea Party, for example. Now, there are probably genuine intellects there. Still, you can discuss policy with them at exhaustion with no effect. It doesn’t matter what you say, to many the bottom line is, they don’t want to take care of other people, period.

    This dummie just got exposed for what she is, an opportunist seeking to maximize personal benefit. That’s pretty much what the core of this whole copyright fight is about. On one side, people who want to download free stuff, without fear of legal consequences. On the other, people who want every penny possible, from their content. That’s what the average man cares, not information policy.

    At least that’s the way I see it. As for this girl, I hope she has the decency to resign from the party. Hypocrisy doesn’t suit anybody.

      For example, I want to watch some TV in say the next hour.. And there’s nothing on TV except crap and adverts.. Also the tv isn’t a computer, i have to just sit there and watch it, its boring, i hate it..

      So basically my point is.. Nobody appears to want to give me the media i want… I can find so much media on torrent sites all under the same roof, or on youtube (even though it sucks)… But the hassle i have to go to to buy it. Is ridiculous.. (plus i have low income)

          My point about having a low income is i can work for four hours at minimum wage and buy a series of a tv show on blueray.. But that is an utter waste of time… I have like 40 different tv shows downloaded.. Any idea how much that would cost me to buy? And how much time ide waste buying the shit and then encoding it all to mp4?

          I guess you’de say “don’t watch it if you can’t afford it” and ide say “fuck you” in response so we’ll never get anywhere with this debate.

    I believe that this woman needs to explain herself. She could be doing it to start controversy, she could be doing it to prove that nothing will stop pirates, she could be doing it because she just didn’t read the contract, or maybe her views have changed. I would suggest reading the book to see what it says about her, if it says anything, and make judgements through time, instead of right this moment. You never know, she could be seeding her own torrent to make some kind of statement. Who knows.

I could say I am explaining myself and proclaim that I have a space ship on Mars that seeds torrents which are on TPB, but that wouldn’t make it the case. I often look into people’s intentions and by default, I have a belief that they will coincide with what they have claimed to be their values.

    My main problem with this is that the publisher has sent the take down request in her name. I don’t claim to know German copyright laws or the contents of the signed contract but I bet the publisher owns the copyright and has falsely sent the request on her behalf.Self publishing a book must be almost impossible. I guess it’s a one book contract and if it was any good ( apparently the reviews are not ) she’s got the option then to find alternative publication and a better position to argue the contract.

      That was my first thought as well.  I’ve written to authors whose work was the subject of takedowns that they had nothing whatsoever to do with.  

      However, it’s not the takedowns themselves but her response that is the fail in this case.  She could have responded differently, but instead chose to issue justifications (“There will always be free texts from me on my blog”… she will make her book available for free in 10 years….) and then a half hearted “Oops.”  Legally, having signed a contract, she probably has no way of changing it.  However, ethically, she could have argued, defended the downloaders, or at least shown SOME effort to mitigate the attacks of her publisher.

    A pirate member could do many many things that some people would consider wrong or controversial but as long as it is something that is meant to bring common sense and freedom, it is all good. We’re all pirates.
    This is just wrong though.
    She should be kicked off the party. Because this is exactly how corruption starts, every big sold out party today was once small and honest, but slowly became evil.
    Betrayal of the ideals should be unacceptable, it is the only way to avoid corruption.

       In all of history, I can’t think of one political party that was ever honest to the people they claimed to represent. In my country, the Democratic and Republican parties have long histories of repression and propping up the powerful (ex. Palmer Raids, support for the KKK, PATRIOT Act, etc.) The problem with parties is that they exist to perpetuate their own existence regardless of how individual members may feel and what their constituents actually want. They set themselves up as separate from the rest of us and thus feel that they don’t have to be held to the same standards. It also doesn’t help that electoral politics don’t do much to ensure any radical change because they exist to keep the current system which allows for draconian copyright laws to exist in the first place. That being said, I’m sure there were alternatives (ex. Kickstarter if they allow donations in Euros) to fund and distribute the book. I don’t know why Ms. Schram did not consider those. Either way, she should leave the party because it is a blatant conflict of interest which contradicts what the PP is supposed to stand for.

    I don’t think it is a coincidence that the deal with the publisher gives the copyright to someone else, this woman knew far well that the book would be pirated and chose to get paid €100.000 so that she would not be seen persecuting pirates.

    The result is the same, her book is copyrighted, hypocrite.

    I have no problem with her getting laid for her book, but she shouldn’t bitch at all, or aid the publisher in any way, to cause trouble for those pirating her book, if she’s a member of the German Pirate Party, because to do so would be hypocritical to say the least.     well im actually glad she and the party she was involved with, didnt get in. simply becuase she obviously actually has no clue about what she was fighting for. either that or greed and money blurred or vision. just imagine it, the partyy gets in and starts to have power to get things done, then all of a sudden the book deals happen, dmcas happen and then they start screwing everybody they were supposed to eb fighting for.

    …and this is why publishers suck and the sooner they are no longer needed, the better. The Internet can be a fine tool to let your work be known if you know how to use it and if it is actually worthwhile material. You don’t need some leech company mooching off your profits and making you look bad like in this case and with that band who had someone file claims on their behalf without knowledge nor consent.

      I would not do exactly the same thing as her and I’ve been there, done that.  How does one make a living? Ad revenue, paid writing jobs, concerts, and getting rid of the middle man.

         That’s idiotic.  Who’s going to pay you to write if it’s given away for nothing.  Ad revenue is insignificant unless you’re a major artist.  Most bands see very little from concerts – by the time costs of putting on a show are taken off.  Middle men (distributors etc) are just an economic fact of life – if self distribution was viable then nobody would use middlemen but its not.

    What’s the problem here? She got money from distributor because she gave him exclusive rights, and now the distributor is sending DMCA notices, thus increasing medial impact of her work. It will be pirated anyway + she get pocket money. So what’s the problem? It’s ok to be greedy, and it’s ok to break law. I’m breaking law every day, so why wouldn’t she sell the book, knowing it will be pirated anyway + the possibility for negative publicity… you guys don’t get too angry, just go and smoke some weed, hehe ;)

    Is there any better way to promote a book than to create a huge controversy around it? For a pirate (!), the best controversy would be, of course, sending DMCA takedown notices left and right and allying herself with the MAFIAA. C’mon guys and girls, this is nothing more than a cheap marketing ploy… and it works perfectly, judging the buzz this totally insignificant book is generating right now.

    This book isn’t wide spead yet, I strongly discourage Germans from uploading it by any means.  Fair game for everyone else.  What a hypocrite indeed.  Not only should she be removed from the party, she should be forgotten; ignored.  Wouldn’t be surprised is she was seduced into it; we all know they have a big wallet and all they know is prostitution.  It’s funny really to see criminals trying to catch criminals; always amusing.  What a tool.

    if you want to write a book, write a book. if you want to make money on it publish it yourself, release the ebook first, put it on your site for free and provide a donate button and the suggestion of “if you like the book, donate” you can use the download counter to give an idea of how many physical books to make, then requisition their production (lots of places will print off your book in bulk) and sell through your site. you dont need a publisher. it’s a fair system that people will like (you might not make a $million profit or anything but you will make enough to make it worth your while, maybe even enough to make it your job)

    Writing a book isn’t exactly free. It takes time and effort. Irregardless of whether you want to pay for the book, recognize that it did take some work on the part of the author.

    After these news came out, Julie resigned from the Pirate Party. As much as I don’t like freetards, I can see why the PP would drive her out. They claim to defend culture by ending copyright opening up all media and content to free distribution.

    Therefore, if she wanted to respect those principles, she should’ve just written the book and published the whole thing in her open blog, and print copies and hand them out to people on the street.

    Of course, reality kicked in – you need money to pay bills, the website hosting, printing, and, well, eating.
    Life is tough.

    It would be nice to find out how many Pirate-Party supporters around the world are discreetly making money through the present copyright system. I’m sure we would be in for a big surprise.
