i heard about a game that if during installation it saw it was a warezed copy it activated a hidden on the iso disc format-partition tool and after you pressed restart my computer and waited for win to load and play your game it would have formatted most of your harddisk – even files in the /windows dir

It depends on which law you’re addressing in the T&C’s.

Lots of laws say that certain activities are illegal *without permission* (e.g. charging someone’s credit card), while other activities are always illegal (murder obviously, also identity theft).

So if it’s a law that just requires permission, then putting it in a EULA (when someone then explicity must click “I Agree” to to proceed) then it’s 100% legal.

How legally binding the “I Agree” button on a EULA actually is has been tested in court several times in different states/countries. In the majority of cases, the defense of “I just couldn’t be bothered to read it” does not go down well with the judge.

So if Utorrent or any other popular application had in fine print that they will install applications that feed all your activities and personal information such as saved passwords, it would be legal to do that?

And that’s why downloaders should always read torrent comments before grabbing something, or if something is brand new on a public site like TPB, let other n00bs find out first.

Or better yet, get your content from a private tracker. Something like this would get nuked rather quickly.

For those that haven’t made the connection, this game is a spin-off of School Days. The title, Cross Days, is kinda straightforward, as some of the characters you can do your business with are crossdressers, and there’s routes in it that let you go either way.

Another thought….
The fact that a program notifies (somewhere secretly) what it will do and you agree, doesn’t make it legal (or illegal). If something is against the law it won’t work putting it in an agreement. For example: It is still not allowed to kill someone even if the victim agrees to it.
