File-Sharing for Personal Use Declared Legal in Portugal

Hoping to curb the ever-increasing piracy figures in Portugal, local anti-piracy outfit ACAPOR reported the IP-addresses of 2,000 alleged file-sharers to the Attorney General last year. This week the Portuguese prosecutor came back with a ruling and decided not to go after the individuals connected to the IP-addresses. According to the prosecutor it is not against the law to share copyrighted works for personal use, and an IP-address is not enough evidence to identify a person.

sharingWearing T-shirts with the slogan “Piracy is Illegal”, the movie industry sponsored anti-piracy group ACAPOR delivered several boxes full of IP-addresses of alleged ‘illegal’ file-sharers to the Attorney General’s Office last year.

The “evidence” was handed over in two batches and the group demanded the authorities act against 2,000 alleged pirates.

“We are doing anything we can to alert the government to the very serious situation in the entertainment industry,” ACAPOR commented at the time, adding that “1000 complaints a month should be enough to embarrass the judiciary system.”

However, a year later it turns out that ACAPOR’s actions have backfired and the anti-piracy group is now facing the embarrassment.

The Department of Investigation and Penal Action (DIAP) looked into the complaints and the prosecutor came back with his order this week. Contrary to what the anti-piracy group had hoped for, the 2,000 IP-addresses will not be taken to court.

Worse for ACAPOR, the prosecutor goes even further by ruling that file-sharing for personal use is not against the law.

“From a legal point of view, while taking into account that users are both uploaders and downloaders in these file-sharing networks, we see this conduct as lawful, even when it’s considered that the users continue to share once the download is finished.”

The prosecutor adds that the right to education, culture, and freedom of expression on the Internet should not be restricted in cases where the copyright infringements are clearly non-commercial.

In addition, the order notes that an IP-address is not a person.

The ruling explains that the person connected to the IP-address “is not necessarily the user at the moment the infringement takes place, or the user that makes available the copyrighted work, but rather the individual who has the service registered in his name, independent of whether this person using it or not”

This means that the account holders connected to these 2,000 IPs are not necessarily all copyright infringers, similar to orders we’ve seen in the United States previously.

Finally, the prosecutor ruled that even if file-sharing for personal use would be seen as illegal, the artists themselves should explicitly declare that there are not authorizing copying for personal use.

ACAPOR boss Nuno Pereira is disappointed with the decision and he accuses the prosecutor of dropping the case because it’s the easy way out.

“Personally I think the prosecutors just found a way to adapt the law to their interest – and their interest is not having to send 2,000 letters, hear 2,000 people and investigate 2,000 computers,” Pereira says.

Another way to frame it is that the prosecutor adapted the law in the interest of the public at large, which is generally speaking not a bad idea.

While the decision is hopeful for Portuguese file-sharers, it is still a matter of how the law is interpreted. For now, however, it is save to assume that Portugal is spared from the mass-BitTorrent lawsuits we’ve seen in the United States, Germany and the UK.

      Hope more interpretations of the law like these one spread out. Seems fair and it also allows artists to still make their money. (not so much for the big copyright companies, but hey, nowadays none of us earn what we should!)

        They basically ruled that, by default, all private copying if defined as legal. Only the author himself (not a publisher, but an author) can declare private copying of its works as illegal, and it has to be said explicitly.

        Furthermore, they declared that the state is not going to prosecute anyone. If someone wants to IP troll around, they must do it on their own dime.

        Also, they reinforced the idea that an IP address is not enough to uniquely and unequivocally identify a person, so IP trolls will have to work harder, even if they want to persecute people with their own money (LOL, not likely).

        In a nutshell, fuck you.

    2.) WTF is the use of delivering boxloads of digital evidence in paper form? Seriously, this is only any good as a data set for analysis by expert witnesses.  Delivery in paper practically prevents this.

    Music industry really does suck and deserve this outcome.  Sadly I assume there will be an appeal, the US State Department will exert pressure behind the scenes, make threats of including Portugal on its Special 301 trade blacklist, and this ruling will be overturned….

       Unfortunately for the MAFIAA, blacklisting Portugal isn’t an option. You see, portugal apart from having several treaties with the US, actually rents and lends military bases/power to the US since it doesn’t need it much itself.
      Seeing how the US really values its military-related stuff, blacklisting portugal could result on the severing of some of those partnerships and I really think they rather leave it be than risk losing some military assets (even if it’s not a lot) just to have the possibility of maybe selling a dozen more z-rated holywood movies.

      Actually the judiciary in any country tends to listen closely to groups which bring them boxes of papers wearing interest-group T-shirts. However, that tends to be because such people are usually bringing them thousands of citizen signatures.

      ACAPOR’s big mistake was in thinking that it’s wearing a T-shirt and toting boxes which does that trick, not the content.

      Which only goes to show that once again the copyright industry demonstrates they are unable to grasp that content, not the packaging, is what matters.

      Not that it matters and this is old news, but Portugal is part of Europe. That “trade blacklist” can’t be applied to PT without being applied to the whole EU.

      If you’re an american, it’d be the same as declaring that people from, let’s say Ohio, would not be able to acquire goods from Canada, while the rest of the United States had a trade agreement in place. The “Union” if you will, prevents that. :)

    Cool.  Good for them, in general it seems judges have more common sense about the issue of copyright than “lawmakers.”  Perhaps it has to do with the balance between elected officials and those who aren’t directly responsible to voters or corporations?  So in different situations it’s better to have one than the other.

    Well it is nice to see the file sharing culture being declared lawful in Portugal but that of course can change at any time. It is still refreshing to see a country welcoming non-commercial infringement but I find it odd they reference the United States concerning IP addresses when that country does not even separate out commercial infringement from non-commercial infringement.

    I just welcome the day when many other countries take this same stance and see that file sharing is natural, unstoppable and non-damaging. For now I see this news from Portugal as premature when the real battle is a global political fight about the nature of one’s laws and what freedom the population is allowed.

    File sharing has been a major market force for 14 years now ever since Napster rounded up lots of MP3s and gave them away for free. Hundreds of millions of people now share media daily. We should now see the affects on society when media still sells when in their own markets once official services are in place and matured enough to serve the public needs. The good parts about file sharing are that it is very anti-monopoly gatekeepers who either have to meet the public need or fail. Then media creation has certainly bloomed when you can see people creating, mixing and reusing media everywhere.

    So the law does not reflect the modern world yet but it is good of Portugal to remind them all that there is another way of thinking.

    The issue of COPYING MEDIA FOR PERSONAL USE dates back to the introduction of Digital Audio Tape (DAT) to the home consumer market in the mid 1980′s. The RIAA was pulling it’s hair out because any one could make a perfect copy of a Digital Audio Disk, and they feared every music enthusiast would become a mass producer and distributer of copyrighted material. The high cost and limited demand for this technology quickly proved the RIAA’s fear unjustified, but this did not stop them from trying to ban the import of DAT decks from Japan to the US. When the attempt to ban DAT failed, COPY CODE was born… The question became: Does the individual have the right to copy media for personal use? The answer, I have always believed, is YES!         On a related note, I made a joke in a post above here that was considered offensive by some under the username “Frenzied Customer”. When I tried to reply to the complaintants, I found the system would no longer allow me to post. I changed my username to ‘Apologetic Frenzied Customer”, and was able to post a few more retorts until, you guessed it, unable to post again. Again I was forced to change my name to finish the exchange of wits.

        I stand before you now “Defeated”, yet enlightened. Censorship is real, and it is everywhere. Shame on you TF.

    What empowers the perpetual copyright corporate machine the most?

    Yet, we adopt defeat against a mountain of good news:  We can fire bad politicians.  We can write humane law.   We can be the beneficiaries of wise judicial decisions.   We can abolish monopoly corporations. 

    In short, we can own our future. 

    Whether, we dare to own our future is an entirely different matter.

    The question  people should ask themselves is:

    How did ACAPOR got access to IP addresses?

    Even if IP are visible in most P2P torrents, does it means you can record them and use them as proof of anything? Clearly it does not!  IP are a personal and without any previous authorisation (ACAPOR had none), they have no business recording what people are doing in the privacy of their homes.

    Personally, i think ACAPOR should be criminally sued for spying on thousands of people without having any right to do so.

    Wow, Portugal’s government and justice system seems to have far more respect for it’s citizens than my country. I guess they’re not ran by an oligarchic plutocracy like US, UK and some other nations that are only “free” when multinational corporations don’t object to it.

    i am from portugal and every single week we have new news regarding to new scandals about money stolen from Portugal coffers and doubtful businesses made by former ministers or these so well called protectors of the public interests that have seats in the parliament, and i am not talking about a single person stealing thousands but millions from the country directly to the pockets.the same penal sistem that close the eyes to this real criminals and let them walk freely in the streets killing ppl and making us paying for what they have been stealing for almost 40years is the same system that condemn one homeless guy to pay 250€ for stealing 1 octopus (food) and 1 shampoo (health) this process cost 1400€.let me explain what i mean with “killing ppl”. if one single million is stolen from the country no matter how this means that 160 grandparents without pension for one year, this if the pension is 480€ per month for 13 months per year. and believe me we have alot of grandparents leaving only with 300€ or less after they have worked the entire live.now lets take a look to one fine news that is appening in Portugal. searches to ex-ministers because some businesses regarding public-private partnerships for highways management that give to our country 5.7 billions in debth. this means 913 461 pensions for one year. taking again a close look:480€ per month, 13 months per year this is equal to 6240€. so 5 700 000 000€ divided by 6240 its equal to 913 461 pensions for one entire year.for those who dont know the population in Portugal is only 10millions.so who is the criminal? this is my question.

    Don’t get excited. Portugal will now suffer a lot of pressure from both internal and foreign forces, and we will concede. Our economy is weak and we are too dependent from other major economies. USA will simply write a new law for the government to approve, just like they did with Spain.
    Only strong or emerging economies can take this kind of position, and still be able to resist the pressure exerted by the various entities.
    Sad but true.

    Interesting. Portugal have also decriminalized marijuana which had a statistically positive effect since it inception. Perhaps this move towards freedom will also have a positive effect and hopefully then other governments around the world use what little sense they have to take note, follow suit and cease hijacking everyone’s personal freedoms for corporate gain.

    In all this rejoicing you forgot to mention that downloading is limited to 15 GB per month  and no matter what you pay ‘illimited’ or other and no matter which provider.So just calm down 15 GB is not much and after that we get squeezed slow…So unless one has many different computers downloading is really limited….most days it is slow too….

      Most packages nowadays here come with unlimited international and national traffic.

      I download and upload about 100GB every month and pay roughly the same each month for my phone, TV and internet( 50 euros)

    eeeeh .. u guys missing the point here. This is not new law. Also, this law applies only to in borders traffic, meaning that is legal only for Portuguese IP’s. If you file-share to international IP’s that is a crime. Go read the law.
