Another sad reminder that the “rule of law” has mutated into a particularly sordid form of corporatocracy in which the apparatus of criminal justice is subverted for use in maximizing profits for politically connected oligarchs.

Back in the old days, we used to call this foetid merger of corporate and political interests “fascism.” Now, when we’ve become the new fascists, we are expected to accept it as inevitable.

It’s not.

Fight back. When the law becomes a tool as repression, protecting oneself from the repressive regime is necessary on both practical and moral terms. Governments fear privacy technology because it subverts this modern flavour of fascism, at a deep structural level. A direct conclusion is that widespread adoption of reliable privacy technology serves as a viable and powerful bulwark against the further spread of the fascist corporatocracy.

We all see the writing on the wall. The courts are now largely in control of the oligarchs, across a wide swath of “civilized” countries. The cows have left the barn – no use in crying about the open barn doors. Best to figure out how to deal with a free range world…

The same as aiding and abetting. Guilty, as much as it sucks. I do believe the claimant should prove loss of earnings in such as case as that’s what they use to actuate the compensation.

If you read through the cases you can see The Pirate Bay and Newzbin in the UK both lost their cases for “making available” even though they uploaded nothing themselves. Linking is making available.

odd the article is vague.. it kinda reads he made available.. provided the content rather then links.. perhaps thats the problem the law dont have a clue what they talking about either and confusing linking with actual providing. Seems they just want to throw every in jail now days and let the tax players pay for it all. regardless whos affect and lifes ruined

Not fair !
I’m sorry to hear a forum admin was victimized considering he would be lower on the totem pole when it comes to who is providing the services.. I don’t think indexing web sites should be charged at all !
And if anyone should be ? maybe the uploaders, sure as hell not the forum mod’s (assuming an actual real law was broken in the first place)
