First off, it doesn’t matter what the artist or label says. Fair use LAW states I can make a backup of any MEDIA I own… That includes Audio CD, Data CD, DVD, VHS, Cassette, Blue-Ray, HD-DVD… ANY media… Secondly, the RIAA, has no authority over anything legal. Everyone wants to make the RIAA out to be the DEA. Congressional authority to music? Don’t think so.

Stopping someone from making a backup of media that they have PAID for is OBSTRUCTION OF THE LAW, and therefore punishable!

RIAA needs to be sued for making frivolous lawsuits.

There are many who assume the point of the argument is to attack G. W. Bush.

Although I am not a fan of the President’s policies, I do not see that argument.

What I see is the argument that if the President does it, is casual about it, sees nothing wrong with it, then as the primary representative of all US citizens, what does that say about the policies of the RIAA?

Basically, is the RIAA wrong in their policies OR are the basic, everyday practices and expectations of the US citizenry right?

Either the RIAA sues the President or admits their logic in court is without merit – it cannot be both ways because the law itself does not allow for their to be a distinction based on the who’s involved, only the what’s and the how’s.

Another similar argument is:

Is it OK to censor Rush or is it not ok to censor Michael Moore? To censor Michael Moore is to censor Rush. To allow Rush to speak is to allow Michael Moore to speak. A case about censoring, not about Rush or Michael Moore specifically.

Its not about right or wrong, its not about what you want to do or hear, want stop others from doing or saying, its about equal application of the law and of policy – nothing more.

Your rights depend on defending the rights of others – in particular, those with whom you don’t agree.

How many times and does modern civilization have to go through the same exercise, using different players each time for this to be realized by the majority of the populace?

no, he is not immune from civil penalties, look what happened to Nixon and Clinton, but I highly doubt he will lose this case, or even that the RIAA will sue, it’s just insane. What are they going to do, sue the world? As a mucician, I believe that downloading from sites like limewire is wrong, but there is a point where I have to put my foot down. Why should people have to purchase music twice? You know what the RIAA reminds me of, that snot nosed little tattle tale that just about everyone has had growing up in school.

The RIAA may allow a backup, but try to rip a backup from a new Capitol Records CD. You’re out of luck! I promise that I will never again purchase another CD from Capitol. I can’t even play my legally purchased CD on my PC. It will play in the car. It will play on my DVD/CD player in my living room, but when I try to play it on my PC, it merely comes up with Macromedia cover page that doesn’t give an option to play the freakin’ tunes! A legal owner of a CD should have the right to use it for personal entertainment in any way he or she pleases. Boycott Capitol Records and all others like them!

RIAA does not believe ripping CD’s to mp3 players are legal, yet making backup CD is legal. President Bush broke the RIAA’s “rules” by having a backup copy on his mp3 player. It just goes to show how ludricous is the RIAA’s position. IF they sue Bush, that would be histerical! Since I would hope the RIAA would be smarter than that, the RIAA will not sue Bush.

I am not Bush supporter. Didn’t vote for him and was unhappy he won. This is not about Bush. If using your own CD’s that your purchased legally on your own Ipod is illegal then it’s a silly law that should be disobeyed. After all, we paid for the music and should have a right to reasonably enjoy it as long as we’re not using it for a commercial venture.
