I was simply responding to this statement in limited understanding:

"Right, because what an uploader in Antigua puts on the web is subject to US copyright law. Umm, no."

It only mentioned that the uploader was sin Antigua, then it only mentioned it being uploaded to "the web" without clarification. Thus, an uploader in Antigua could technically be uploading to a web server in the U.S. In such a case, U.S. law would apply. It doesn't matter where the uploader is located, only the web server.

It gets complicated further by the fact that large companies, such as Google, will redistribute this content across their server farms in other countries. So, even if a file were uploaded to a Google server (YouTube, Blogger, etc...) in Antigua, this doesn't guarantee it won't also find its way onto a Google server in the U.S.

The employees of the companies that submitted Gmail as infringing probably were talking about the movie (or the copy of Windows 8) they downloaded last week to their friends via Email and reported it. (Clearly they are capable of such insanity) Of course, their emails are password protected and can't be seen publically, thus only giving the Gmail URL :P.
