If any of these cases ever go to court, I hope the defendant’s lawyer makes the point that by not even attempting to get the torrents taken down, they’re giving their approval for people to download it.

This is the pinnacle of terrible logic. So unless you are standing guard at your door the whole day, you are giving people the approval to rob you?

They have the rights to it. It is theirs. They shouldn’t have to track down every place where they’re work is being handed out like candy. They should have had their work up for download to begin with.

You see for the law to work we need a consensus. People pay for their good at the store not so much because they have to but because they want to. Nothing prevent anyone to go into a store and jack anything they want and pull a gun if anyone bother them. Nothing.

They don’t do it though because anyone know that if they do this the store will disappear.

The problem is that we can not afford to have corporations of parasites rulling our societies therefore we want them to disappear.

Shouldn’t knowing about specific torrent sites and torrent links and NOT sending takedown notices compromise, dilute, weaken them? I’m thinking about the trademark dilution analogy. In order to maintain and protect rights in a trademark, you have to defend it against know infringers (i.e., send notices, etc.).

In any case, any lawsuit can pretty much be won as long as you own original content. I usually rent instead of downloading (when it comes to movies) but rent prices aren’t so cheap (not in US, no netflix or so) and I’ve lost count of how many times I had to exchange the movie because the media was damaged due to poor handling from previous customers…

I’m not after “free” content, I want to make sure that any money I spend goes to the right people: the artist.

If there comes a new legal bittorrent service that is of a high quality, similar to the many amazing private trackers there are out there, where music is sold fairly, where the artists get a fair portition of their money and we pay a fair fee to them and get a high quailty, DRM free file,
I’d more than want to jump on board.

The media industry need to stop being bullies: their purpose should be there to help new and young emerging talents get discovered, but they seem more interested in spending millions remarketing their already high-profile, well known media money makers, and taking more than their fair share out of their smaller artists.
