As for your question i'm sure that if the targets of one of these lawsuits provided a receipt for the purchase of the porn in question (predating the date of their download) the case would be immediately dropped although possibly not if they helped to seed it thereby helping countless others to steal it.

my question is this: are the justified in the downloading the material as well because they own it? and isn't it legitimate to download copies of stuff that you already have? if this is the case, wouldn't this mean that companies suing people would have to prove that the individuals being sued don't already own a copy of the materials they were caught downloading?

I understand, but my point is merely if you don't try to stay above reproach yourself, you could easily end up far worse for your efforts. Maybe that's worth it? Our past is full of examples which were, but if you're going to risk your freedom at least make sure it's helpful: I question the wisdom of giving the entire "piracy" community a terrorist connotation in the eyes of the wider community which we need on our side (consumers, congress, etc) if we're to make any real progress. Surely there are better ways to make them, not us, look like the extremists?
