No, playing the “First Amendment Card” is exactly to counteract your corrupt actions.

Lessig (and others) have played the first amendment cards before, and they have gotten massively shot down in the courts with those arguments. The courts have long since held that free speech, while powerful, is not an excuse for unlawful behavior. Further, they have even ruled in the past that some free speech may be infringed in order to enforce the rule of law. AKA, you cannot hide a bunch of prohibited speech behind protected speech. If this wasn’t the case, then people could produce truly obscene videos (say dog fucking or worse, Icecold porn), and claim them as free speech by having someone read a valid literary style commentary over the action.

Thus, the free speech arguments generally fail, because it’s easy to see what that free speech is trying to cover up.
