I have researched this ALOT and taken legal advice. Let me clear it up 4 everyone. Copyright infringement IS a civil offence, NOT criminal. Conspiracy to defraud copyright (i.e being a torrent site admin, posting torrent links to CR protected material or pre-release titles) is crimial. DL use a high court order (criminal) to get the ISP to release details. They then use the data they ALREADY have from SPYING (Logistep are hired to do this, & get cut of any money extorted) on u to threten CIVIL court action unless u bend over in a franch maids outfit and hand them the lube. They also demand in writing that u will do nothing of the same sort again. I’ll let u work out the glaring loophole for yourselves.

The current legislation defines it as a ‘Civil Offence’, therefore ISP’s are under no obligation to divulge so called ‘Pirates’ IP addresses. Though uploading copyrighted material IS a criminal offence.

I’m all for filesharing but it is still illegal. You take your chances and if you get caught, it’s unfair to blame the government who actually have nothing to do with it. No government anywhere is going to remove copyright laws any time soon. 42 is correct…go to court and win on a technicality – “my wireless network was hacked” etc.

Downloading (for non-commerical, personal use) in the UK was legal until the EU Declaration 2001/29/EC.

Additionally, under EU law, service providers are not required to reveal personal details to third parties as a result of civil cases (e.g., copyright infringements).

This fucking government should make up its mind whether to follow EU law or not.

We all know (and I do it too) that downloading a game that’s copyrighted is breaking the law. When I do it I think “well I’ll probably get away with it” so I take the risk of getting caught.

To get these IP addresses they had to show probable cause, which they can do by tracing back from the trackers. If they’ve made a mistake and the trackers were for non-infringing material that’ll be cleared up too.

This is different to the PirateBay taking a stand, they’re not actually breaking any laws in Sweden, you lot (and me) by infringing are.

As pointed out in post 27 by Bigk EU laws says IP addresses should be regarded as private data. There is also the fact that Logisteps “evidence” is in no way verified correct and the methods used are highly suspect! This is being put in a friendly letter telling Lyons & Co to go fuck themselves.

And of course its all about making money, and nothing to do with protecting copywrite.

BTW, people need to really get on making a tor-like network exclusively for file-sharing, except where everyone acts as a server node with a tit-for-tat as far as proxy bandwidth. You would end up with exactly 50% of your throughput BUT at least you would be anonymous. These lawsuits wouldn’t matter at all then.
