Japanese BitTorrent User Avoids Virus, But Not the Police

A 31-year old Japanese man has admitted to uploading 3 TV-shows and sharing 165 more on BitTorrent after he was arrested by Tokyo Police’s Cyber Crime unit. In his confession the man told the investigators that he used BitTorrent because he believed it was free of viruses and police. He was proven wrong on the latter.

winnyTraditionally, Japanese file-sharers prefer the Winny network over BitTorrent, but the latter has been steadily growing over the last years up to several million users.

This download trend has not gone unnoticed by the local police either, who recently arrested an unemployed man for sharing 165 TV-shows on BitTorrent.

The 31-year old Shuichiro Tanaka was arrested by Tokyo Police’s Cyber Crime unit and was charged with recording and uploading 3 TV-shows in early June. According to reports, Tanaka also shared 165 more TV-shows between February and July this year.

The videos the man shared on BitTorrent were mainly Japanese variety shows such as “Waratte Iitomo” and “Genius! Shimura Zoo.” According to the police, this is the first time that someone was arrested for copyright infringement on BitTorrent in Japan.

Tanaka has confessed to the charges and stated that he used BitTorrent to avoid running into viruses and the police.

“I did it for people who missed the TV-shows. Because there is a potential for viruses on Winny and others, I used BitTorrent, which I heard police weren’t investigating,” Tanaka told the police while pleading guilty.

Unlike on BitTorrent, viruses are both prevalent and quite aggressive on the Winny network. One virus that surfaced three years ago was specifically targeted at file-sharers and threatened to report them to the police, or kill them if they continued sharing.

Although this is the first arrest of a BitTorrent user, it is certainly not the first file-sharing related case. Last year, a 33-year old Japanese man was arrested for uploading the movie ‘Wanted’ to the Winny network before its Japanese theatrical release. He was later sentenced to two years in prison.

    @ 16 why are you talking $hit? The wealthy top 1% in Hollywood have long sought to stop people from copying or sharing anything they can’t make a huge profit on. So they buy off politicians, Judges, & in turn make laws to punish people that cut into their profit margin. They had a cow over people using VCR s to copy TV shows! Hollywood had endless lawsuits over that!

    Anyway, the comments have depreciated in quality slowly, but only because good comments get lost in a sea of nonsense. Would be good if they torrentfreak guys updated the comments system to include:
    > thumbs up / thumbs down ranking
    > instead of ‘waiting to be moderated posts’ disappearing, then coming back after moderation and screwing up the post numbers, a post saying ‘this post is being moderated’ and then changing to whatever the post said after moderation
    > Do the above without involving registration (ie keep it anonymous)

    As for the news article it’s self, it’s fairly standard filler I guess (someone gets busted for filesharing… ~yawn~), but it does nicely as a reminder for me as to why NOT to use bit-torrent with out some sort of anonyomizing service, or better yet, stick to Usenet where you’re only downloading and not uploading.

    Keep at it TorrentFreak – but update the damn comments features!! There must be a WP bolt-on for that kind of thing…

    Like the reader above who mentions Japanese whaling practices even though that has absolutely nothing to do with file sharing, BitTorrent, or this blog post.

    It is not the fault of the vast majority of Japanese that the police took an absurd action in this instance.

    People in Japan is advised to never release directly, use encrypted proxies, anonymous p2p etc. Don’t get caught! We need you! ^_^

    where’d this guy get the idea that there’s no viruses on bitTorrent? My antivirus (avast) catches them all the time. Got a malware infection (avast missed it) the other day that was especially nasty.

    I think we already have some evidence that the sharing of such TV shows actually BOOSTS the damn ratings because it SPREADS the word.

    Suppose a person downloads a couple of episodes of some TV program and thinks it is really cool. Then what would they do next?

    1) Some proceed to watch the show on TV and end up seeing the commercials. He/she benefits from not having the inconveniences associated with downloads (lots of disk space, time consumption, electric bill, computer parts wear, Internet quota…)

    2) Some other people might want to download as many episodes as he/she wants, BUT could end up going to TV to watch the new ones not yet released, or even occasionally watching old ones again for fun (thus seeing ads).

    3) OK, let’s suppose some guy throws away the TV set and only downloads. If he has friends, he will tell them about how good the show is. What is more appealing, a recommendation from an enthusiastic friend (who maybe shares your taste) or some 5-second TV-spot trailer?

    To sum this up:
    - Not everyone is willing to take the pains (or have the means) of downloading.
    - Good shows profit from on-line sharing due to increased repercussion.
    - Bad shows don’t profit EVEN if not being shared. But in fact, if it’s REALLY bad and IS being shared, maybe it could attract attention of some wacko/bad taste person, pushing him to possibilities 1, 2 or 3, instead of not having him at all.

    PS: In the specific case of Japan, how big do you think would be the nowadays giant community of manga/anime fans that embrace the whole world if not for the SHARING of Japanese artworks via Internet or other means? (don’t forget this practice comes before the flourishing of BitTorrent for about a decade!) What about the impact of fansubbing/translation groups around the globe that end up jump-starting market for not-yet-released/obscure/unknown material for FREE? You tell me that one, Mr. Nippon copyright-bully! Tokyo authorities, go use your power for things worth enforcing! You’re spending bullets shooting your own feet!

    The problem for the ultra-giant corporations is that they are slowly realising that their time is coming to end. These extraordinary profits these companies see, and these huge pay checks the executives get are going to be a lot less than nowadays.

    As humans become more autonomous thanks to cheap easy technology, our demand for external services will be reduced.

    We no longer have need for a worldwide physical data distribution service. It’s a simple fact of life, data moves in packets across the Internet, no matter what that data is.

    As the authorities are going after BitTorrent users, what are they actually doing? They are spying on individuals without due cause. They are fishing. I hardly ever use BT anymore (well done you lot for scaring me off it), instead I use other means.

    Poor guy, He didn’t even try to make money from those shows he uploaded, but he just wanted to share them with people who might have missed them on TV.

    Althought if you think about it, he’s was also pretty dumb. He knew he would get arrested if they busted him. Therefore, he should have used a VPN, Proxy or something else to Anonymize him.

    Do some research in the matter before you do your stuff in a P2P-hostile country.

    I’m sorry, but that TV show was distributed for free to the public by advertiser funding. ANY non-profit redistribution AFTER it airs is FAIR USE!

    So called copyright ‘reforms’ being pursued today are doing the complete opposite of what they should. In light of improved distribution technologies we should be expanding fair use rights, not crushing them. ‘Threatened’ distribution companies are bringing alot of political influence to bear all over the world to protect their profits. We need a strong civic movement on these issues to stop digital corporate oppression, but average people are woefully misinformed or just ignorant.

    Digital rights are THE big civic issue of our time. CC and GPL licences are doing good work within the existing legal framework to change copyrights, but we need Real Copyright and Patent reforms badly. Be informed, and inform others, that’s all we can do right now.

    the japanese are not exactly known for their love of their police because it is widely known that they are toothless when it comes to real criminals. be it yakuza, other mafia-like-organized and armed strucktures or large corporations with enormous influence on political matters.

    I just got back from living in Ishikawa Japan for two years. It was super sweet! I torrented till I was blue because I too was under the impression that cops weren’t looking for it. No one I talked to in Japan knew about torrenting either.

    I got great DL/UL speeds there. Much better than Comcast in Atlanta..

    Too bad for this guy. I believe that Japanese courts don’t really have a standard set up yet for this practice.

    Thing is, it’s rumored that he’s posted info on his uploads on his blog, and doing anything like that would likely get you arrested regardless of BT, Winny, Share or PD.
    (Most of these arrests in Japan have been the result of such announcement in public forums)

    Making such public annoucement about the upload would likely get you arrested regardless of BT, Winny, Share or PD.

    This is really stupid.
    Without those uploaders I wouldn’t know any Japanese TV Shows or Dramas. I wouldn’t even be able to watch them.
    If I don’t know them, I can’t buy them.
    If they stop people from sharing, we won’t be able to get a taste of J-TV/drama.

    @57: of course you can be caught. Your virtual PC guest is still running on a real PC host… which has an IP. All traffic sent or received by the guest transits through the host, and is thus entirely visible.
