Judge Orders Oron To Settle $34.8m Copyright Suit, Dismisses Case

A U.S District Court has ordered the Oron cyberlocker to settle its copyright infringement dispute with adult studio Liberty Media. The file-hosting site claimed that settlement negotiations had never been finalized but yesterday the court decided otherwise. Oron will now have to pay Liberty Media at least $550,000 with additional attorney’s fees to be decided at a later date. In the meantime, Oron’s service remains down.

In June, adult studio Corbin Fisher (through owners Liberty Media) sued the operators of file-hosting service Oron for $34.8 million, claiming that they induce the sharing of copyright infringing files via their service.

Liberty Media’s lawyer Marc Randazza went in with all guns blazing, describing Oron as ‘criminals’ who do not qualify for safe harbor under the DMCA. Oron’s funds were frozen but despite a small part later being released, it became clear that the service would have difficulty continuing without access to much, much more.

In early July it became apparent that the companies had been attempting to reach a settlement, details of which were leaked online following a poor redaction of court documents.

There was a significant gap between what Liberty asked for and what Oron were prepared to give. However, while Oron insisted no final agreement had been reached, Liberty felt that at some point a deal had been struck and went on to ask the court to enforce the terms. Yesterday the court did just that.

“There is nothing in the Settlement Letter that indicates that Defendant did not intend to be presently bound by the proposed terms or that a future writing was required,” U.S. District Court Judge Gloria M. Navarro wrote in her ruling.

“The requirement for the Plaintiff’s attorney to sign and return indicates that the parties do agree that all these terms are acceptable and binding. If this was only a proposal of terms there probably would not be a requirement for Plaintiff’s counsel to sign and return.”

Judge Navarro went on to find that the settlement negotiations between Oron and Liberty did amount to an enforceable contract.

“The Settlement Letter written by Defendant was an offer, accepted by Plaintiff when its counsel signed the letter. There was a meeting of the minds as to all material terms on July 5, 2012, when Plaintiff agreed that the settlement would include dismissal with prejudice of [alleged owner and operator of Oron] Mr. Bochenko,” Judge Navarro wrote.

“There settlement includes valuable consideration on the part of both Plaintiff and Defendant. In this case, the Court can compel compliance because there are no uncertain material terms that remain. Accordingly, the Court grants Plaintiff’s Motion to Enforce Settlement.”

That settlement is detailed in court papers as follows:

1. Oron pays Liberty Media $550,000.

8. Once payment is received by both parties, both proceedings in NV and HK will be
dismissed with prejudice, and in the event that Oron breaks any part of the deal, the
claims may be reinstated via arbitration after a 30 day “notice and cure” period.

12. Liberty agree to announce publicly that after a careful review of the facts they
believe Oron is protected by the DMCA safe harbor and that a review of the actual files
shows that there never was any child porn on Oron’s site.

14. Liberty will immediately, once the terms of the agreement are agreed to issue a
letter asking that the HK bank accounts be unfrozen allowing the payment to the
Randazza Trust and then to [former Oron webhosting provider] Leaseweb as well as send a letter to Leaseweb asking them to allow Oron ten (10) days to pay as the settlement of the matter is imminent.

There are at least 19 points to the settlement agreement so as can be seen from the numbering scheme on the items above a significant number are missing from court papers. As previously revealed, Oron were prepared to hand over the identities of its allegedly copyright infringing customers to Liberty and help the studio take legal action against them.

But while the enforcement of the settlement allows Oron to continue with its business in theory, problems remain. Firstly, Oron’s parent company accounts are still frozen, “in order to satisfy any fee award, which may be sought by Plaintiff, but which must be brought within thirty (30) days of this Order.”

Furthermore, as a cyberlocker Oron is currently doing no business at all. The site disappeared from the Internet several days ago, ostensibly to move to a new host, but it is yet to reappear or post any advisory on its homepage.

       The funny thing is that these companies aren’t just going after the cyberlockers that you think are trash. Every cyberlocker that’s taken down, good or bad, makes it that much easier for them to go after the next one. Eventually there won’t be any left.

      Oron had lots of porn. The nice thing about it was being able to use proxies so you didn’t have to wait. I’m not happy they are gone, especially considering some dirtbag gay porn outfit took them down.

      The problem is they caved and agreed to settle.
      This has now set a precedent…against themselves.
      If Oron hold copyright material, and are accused of such, then by their own admission in a previous suit (this one) they will be found guilty of the same ‘crime’ and be expected to instantly capitulate and reimburse.

      It was a mistake to settle. They should have fought, and gone bust, rather than make a deal with the devil.

        Not true. By settling, they avoid setting any precedent at all. To set precedent, the case would have had to be heard in full and decided upon its merits.

        By settling, they didn’t allow the case to get to trial and be heard on the merits so the case cannot be set as precedent for other courts.

        This has neither furthered or harmed either side as far as creating law goes.

    who the hell said in court that they had got to the point of discussing damages in the first place??   Liberty’s lawyers had no right to as it prejudiced the case so it must have been Oron??

    Ergo the judge then shuts down the case (why be discussing damage amounts if not liable) and pegs damages at the lower end of the scale discussed.

    It sounds more like he wanted to get a bunch of pornographers and their bent lawyer out of the court as fast and as cheaply as possible,

    I hope Corbin pursuits those people who uploaded their material. Those people are a waste of space anyway, and was only using Oron for monetary gain. Oron was never a host directed at GIVING to any free users, let alone the Premium users who received 20GB of data usage every 3 days.

      Oron was shit for free users and premium users alike. They established some sort of monopoly in the porn segment by purchasing some of the top porn forums on the Internet and banning all other hosts. Of course the fact that they paid out to uploaders meant their monopoly was never in danger. Downloaders are at the mercy of the uploader’s whim afterall.

      It was clear from the outset that they started this business to profit heavily off copyrighted content. Its nice to actually see such a shitty host go down for a change.

         I would have a completely different opinion if it was one of the other hosters. ORON was built to maximize profit, keep cost low (no BW to free & premium users) and pay to those who uploaded Gay Porn. Yes, they were the biggest for PORN, but they were NEVER intended to work as a filehost, in which would help promote innovation and ACTUAL file sharing (20GB limitation isn’t filesharing)

      i believe Oron still has a strong case here and can continue to fight this as they were actually DMCA complaint and one could argue they were time shifting the content, not actually pirating it. i am unsure why their council did not take this approach.

       Who won?  That’s debatable but as the original settlement offer is being enforced, as of RIGHT NOW, Corbin Fisher & Co. are winners as they get settlement money (the $550,000), cooperation from Oron in the future and a list of uploaders from Oron.
      Oron aren’t winners but aren’t exactly losers as well – they avoid the 34.8 million lawsuit by paying a comparatively small sum and as soon as they fulfill the settlement details, they can start up their business.
      The real losers?  The uploaders on the list that Oron will provide to Corbin Fisher & Co., that may include account info, email addresses, Paypal info and what not.  If the uploaders are smart, the email and paypal accounts are all “dummy” accounts (tho it’s a bit harder to create a “dummy” verified paypal account), but if not… well, yeah, the uploaders are screwed.
