Even though it is a hypothetical at this point, I can imagine it happening eventually. We won’t know the value until an actual case happens. To me, it sounds like a good defense, but we both know how lawyers and the law can excavate a technicality seemingly “out of nowhere” which would negate the whole thing.

Perhaps there may be some “pirate” out there reading this exchange and apply it to those things he/she releases. I would love to see the results if it ever went to court.
