Kim Dotcom Theory on Corporate Cyberlocker Use Supported By Survey

While Hollywood paints file-hosting sites as the new piracy havens, a new study shows that these services are indispensable to many employees. A survey among 4,119 respondents from a wide range of companies shows that 66% use free file-sharing sites to share and store work documents. Among those working in professional services the percentage is as high as 87%.

After the shutdown of Megaupload, Hollywood was quick to point its finger at other “rogue” sites, such as US-based cloud storage service Mediafire. The irony is that while the movie companies claim these sites are destroying their business, a majority of corporate employees depend on them.

This widespread legitimate use also applied to Megaupload. Founder Kim Dotcom told us last year that movie industry insiders and employees at the world’s top corporations were all using the service.

“Among our 180 million users is a large number of celebrities, musicians, film makers, actors, etc. and they love Mega. We have hundreds of premium accounts from employees of the companies the RIAA and MPAA represent. In fact 87% of the fortune 500 companies have premium accounts with us,” Dotcom said.

While the numbers above say little about the legitimacy of the files being shared by these users, a new survey reveals that it is common for employees today to use file-sharing sites (e.g. cyberlockers) to share and store work-related documents.

The survey conducted by Skydox polled the use of free file-sharing sites among 4,119 workers at companies in the U.S. and U.K. Two-thirds (66%) of the employees admitted to using free file-sharing sites for work. Among these ‘sharers” 45% said their IT departments are aware of their usage of these services.

corp

A breakdown of the result in different work sectors shows that file-sharing services are most used among employees in professional services (87%), closely followed by financial services (84%). Health care (57%), the creative sectors (55%) and government employees (54%) score below average.

The above doesn’t only emphasize the huge legitimate potential of cyberlockers. The widespread use of these services in the work setting also sheds a new light on the ongoing fight of Megaupload users to get their files back.

This week the EFF argued in court that the U.S. Government disadvantaged many former Megaupload users by shutting the site down without warning. By seizing the servers, they deprived millions of users access to their files. The EFF is supported by retired Judge Abraham David Sofaer who is very critical of the Government’s actions.

“It’s really quite outrageous, frankly,” Sofaer told Threat Level in an interview this week.

“I was thinking the government hadn’t learned to be discreet in its conduct in the digital world. This is a perfect example on how they are failing to apply traditional standards in the new context.”

Ignorance might play a role here. Judging from previous criminal investigations the U.S. Government is relying heavily on how the copyright holders portray certain websites. It wouldn’t be a surprise if the investigators were simply unaware of the many legitimate users, including thousands of government workers.

i have said for a long time now that as soon as the entertainment industries have managed to shut down all the existing torrent sites and file sharing sites, they will start up the same services under their control. once they have done this, file sharing in all forms, as it will be via entertainment industries controlled sites will suddenly become not only THE way to download anything and everything, but using torrents will be the dogs bollocks of file sharing options. they are not against torrents or sites that make various files available for download, it’s the fact that dont control those sites and therefore cannot charge the same for downloading as if walking into a shop and buying the physical item. basically, it’s greed. what doesn’t help is that governments and courts are doing whatever they can to assist the industries to do this and even when the truth is exposed, they still wont admit to how they have been screwed good and proper along with the people. ignorance is supposed to be bliss but there is no excuse for self induced stupidity!!

    • Vincent Giannell

Hearing your story, the government will no doubt accuse of false accusations involving file-sharing and have you arrested for it.

      • Lulz

Arrested? Nah, they’ll just send the Army to take us away for indefinite detention.  Totally legit.

      • Yulo

not sure about arrested but mafiaa took over imesh, bearshare,  and shearaza and put fake clients on the real website. Not too sure about imesh now, I think its defunct but bearshare and official sheraza site gives mafiaa versions. You have ot look for real bearshare to find it as the page has been hijacked etc, and same for shearaza. Sourceforge host shearaza to get a clean copy. so here we have mafia taking over domains, puting their fake client on there, calling it legit. Seem fair? nope

  • Ishigidydigidy

It’s not surprising in the slightest.  Before dropbox, I used both Mediafire and Megaupload to store data for school and work.  While I wasn’t greatly impacted by the sudden shutdown of Mega, it was  definitely an inconvenience.

Perhaps all these thousands employees of all these companies including employees of companies that the RIAA and MPAA and government represent etc. were to write statements stating that they use Megaupload for legit purposes etc. and now that they can’t retrieve there legit files etc. that this may well add to the defense of Megaupload.

    • Ishigidydigidy

And then they’ll be painted as pirate apologists.  They’ll either become irrelevant or be fired/forced to quit their job.

      • Tonka Dave

If Fortune 500 companies have premium accounts with MU I can’t see them being branded ‘pirate apologists’. I have several blue chip clients who transfer files to me through cloud services like MU and these aren’t individual employees using personal accounts, these are official company accounts. The MAFIAA are messing with everyone’s business sectors, not just the music and movie business.

As well as the companies poisoning their minds with greediness and showing us the U.S. Government is quick to turn their backs on the people to make a quick buck.

      • Violated0

Well keep in mind that the US Government is immune from being sued unless they approve of being sued.

        • http://profiles.google.com/zerianis10 Christopher Kidwell

Maybe not. “Sovereign immunity” has never been tested at the Supreme Court level, so the U.S. government might not be ‘immune from being sued’ as much as you think.

    • No1_2_u

Maybe the reason the US governement doesn’t want Mega to have access to its servers is because when the made illegal copies of the servers, the US discovered that its own employees have been using the site for work related purposes; & probably for other none work related activities.

How retarded would they look in court when Kim’s lawyers stand up & hand the court documents proving that x-number of US governement, US MIlitary etc, have been using the site for years?

I doubt they will stall for long. Sooner or later they’ll to hand over the files to Dotcom or they will be in trouble.

    • Violated0

It is more correct to say that while the DoJ did advocate the destruction of the MU data early on in response to Carpathia’s query but it is now true to say that no party in this sad affair now advocates data destruction.

Having them give Kim Dotcom the requested $1 million of his own money so Mega can buy the servers from Carpathia in order to reunite users with their own data is a whole different story.

      • No1_2_u

TorrentFreak should start a fund so Kim can buy his servers back.

I don’t have a lot of money, but I would GLADLY give $100 for the cause; just for the sheer pleasure of sticking it to the DOJ & the MAFIAA.

        • Violated0

Yes it would not be too hard for say a Kickstarter project to raise the $1 million needed. You would only then need Mega’s help to put it all back together and paying some company $70,000 a day to wire it to a major Internet link and to maintain the system.

As soon as Kim DotCom gets megaupload back and running again, I think as many people as possible should buy a years membership for megaupload – its not about assets, its about brand reputation – and it will be forever tarnished because of this case – even if he gets 100% of his assets back.

Fighting the US Govt, RIAA, MAFIAA and etc on this scale deserves some sort of payback – so guys, please buy a years membership when the site gets back (making sure that Kim Dotcom is the actual owner first of course.

I have never paid for a megaupload subscription, but have used the free version all the time – I just think we might give a mass thank you to kim-dot com when he comes back.

Anyonymous: Operation Thank Kim perhaps? Once he is free, we can thank him with all the subscriptions happening in the process of a couple of days (as not to overload the servers of course).

    • The guy

I will buy yearly subscriptions each chance I get, because the loss of such a wonderful and legit storage site, which was also incorporating the program where artists get the exposure they need and 90% of royalties instead of like 5 or 10% given by record companies, pains me and all other fellow file-sharers. Kin can consider it a thanks for battling corruption of this magnitude.

Big problem for Corporate Distributors of Intellectual Property under existing Copyright Law:    In every corner of Society where Intellectual Property is used (essentially everywhere), the most vigorous and most committed users of Intellectual Property are at the very pinnacle of politics, the professions, the arts, the economic and legal infrastucture.  It is these people who suffer disproportionately the extortionate premiums and degraded and inconvenient services that previileged Corporate Monopolies can extract under current Copyright Law.

Increasingly, these are the natural adversaries of the Copyright Monopolies.

There is a wild wet dream in Corporate Monopoly-land……whose imagery is all about suppressing the emerging entrepeneurial infrastructure long enough to take it over and incorporate it into the legally protected legacy monopoly system; and then evolving that, through more controlled technological innovation, to protect legacy monopoly profits and manage the disruptive political and economoc effects of free flowing Intellectual Property.

The problem with achieving this Pinky and the Brain fantasy is that it requires that the Western Democracies be retrofitted with attributes of Fascist Governance, something
Individual citizens (including those who most vigorously depend on broad availability of Intellectual Property) are likely to vehemently oppose.

In fact, the mere raising of those all imprtant questions that need asking; but, which the Copyright Monopolies can NOT bear answering, brings closer legal and political resolutions that WILL NOT and MUST NOT turn our favorably for current Monopoly Copyright Distributors.

First, “Is Corporate Custody and Control in Perpetuity the most equitable and responsible social management of Intellectual Property?”

Second, “Is either Social Equity, or economic efficiency in the distribution of Intellectual Property, incentivized by legally protected monopoly profit?

Third, “Is Democratic process consistent with extinquishment of the Public Domain in Intellectual Property?

Fourth, “Should the Constitutional Rights and Civil Liberties of Individual citizens have PRIMACY over the pecuniary intrests of any private interest?

Fifth, “Should ANY profit seeking enterprise EVER be granted IMMUNITY from Prosecution or from Liability for damages inflicted on Innocents in persuit of that profit?”

The more these questions come to the  forefront of Democratic Debate, the closer the existing Copyright Law comes to being radically changed or abolished.

It is not hard to see why professional people make use of cyberlockers and indeed cloud storage services has much benefited from this market.

A simple example is that you have made a 50MB media file. This is too big to supply to people using email which has a 25MB limit or less. Nor would you want to send such a huge file to people who may not want it. The other problem is that normal employees do not have any access to the main company website. Neither do they want employee access due to hacking and virus issues.

So they just upload their 50MB media file to a cyberlocker then email and SMS the people who could want to download to view and at high speed as well.

Nice to the US Government to nuclear bomb the market destroying this lawful use for so very very many people. Idiots.

    • The guy

Agreed, nuking legitimate businesses like that obviously puts them in the burn book.

This whole paragraph is moot. I’m sure by now the government is well aware of the legitimate uses of Megaupload, but in their view – this is “necessary collateral damage for the greater good”. They don’t care and never have cared about the harm caused to innocent people when they go after people who they consider broke the law. :P

Perhaps you all need to start thinking about leaving the data on your own machines, and using Remote Desktop or even TeamViewer.

Trouble is this “Mega” crap could potentially happen with other cyberlockers, NEVER think your data is safe online, You are trusting a stranger to keep your data safe, and like “Mega” they could not guarantee that security or safety.

Rule of thumb: If you trust online cyberlockers with your data, Why not stand on street corners giving away free cdroms with it on? – Because that is the same thing as you do, by uploading to these cyberlockers.

Any of them at any time can go the way of Mega, and yet, you still use them, you still trust them with your data, That to me is not very wise, What happened to Mega, can and almost will certainly happen again and again and again, so as long as you keep your data online, it will NOT be as secure as you think it is.

    • Cloud My Ass

Absolutely my view. Use them for backups, use them for sharing, but for gods sake keep your own local master files!

Anyone who has entrusted the only copy of something to some random server in the cloud only has themselves to blame if they suddenly cant acess it.

    • Violated0

So you recommend people to live their life by fear and paranoia?

Cyberlockes provide a service to share your large files. Beyond the US Government dropping virtual bombs then all other possible problems are wrote in their terms of service. Local backups are always recommended.

There are also cloud storage services operated by major corporations that claim not to have an infringement problem but even they are concerned about the DoJ rubbing their turds into DMCA law.

Eventually the average internet connection speeds will be enough to support the sending of large files to multiple parties at fast speeds.

It does not matter if the RIAA,MPAA, or anyone else hates it.. It will happen giving the average home user the options of being their own file host. As time goes on and things play out it’s obvious certain things are going to keep increasing in size.
BUT! There will be a point where it would be irrelevant to push past the point of what our senses can distinguish.
That will be the obvious point of when things will become more and more easy to send across the web.

Still many things will not increase in size since there would be no point to do it. Well I guess it could be done to be an asshole lol.

Just watch as they lose their imaginary grip on the web. It will stir some serious shit.. It’s pretty funny though because they never had any true power over the web and they never will.

You know what I call someone that thinks they have something that does not exist.

FUCKING NUTS,LIGHTS ARE ON BUT NOBODY’S HOME,LOONY,INSANE,NOT PLAYING WITH A FULL DECK,LOST THEIR MARBLES, or if you wanna get technical about it Schizophrenia.

  • Decimus

I find it rather disgusting that the MPAA and the RIAA have charts, figures, and graphs that they drew up by simply pulling numbers out of their asses.  In order to confront their blatant lies, surveys and studies are performed which typically show that all the figures are completely wrong.

If that’s not bad enough in itself, the result of all their ridiculous accusations push individuals and their companies to either find a new way to store and share data or to regress to methods that were used before.

All these issues are common sense.  Anyone with half a brain could explain why the MPAA is wrong across the board.  But, because they have money and influence, they’re allowed to play these stupid games while making it all up as they go along.

    • The guy

They attempt to make rules that we are expected to follow, yet they break whenever it’s convenient to them. And yeah, anybody with half a brain could explain that, in fact, they are so idiotic a monkey can be a scholar.

Most people in the US government struggle on less than 10% a brain so this is probably the root cause of the problem. Most are more akin to a sock puppet with some lobbyist hand up their ass.

  • havor

For me its pretty simple, what the US government has don is plain illegal.

Let say there is a distribution center that bin used as a transport hub.

Now ATF comes and closes the place down, saying that the distribution center was illegally storing fire arms.
ATF shuts down the distribution center, but it not only confiscates the fire arms, but also all legal goods.

I think hell would break out if that would happen.

To make things worse, there have never bin a legal president before that says cyber lockers are illegal to begin with.
So many people used them in good fate, even do others abused them to upload copyrights materials.

In the end the US went AGAIN nuclear when a moderated strike would have bin the much better option.

And it stinks again like US government is doing RIAA’s and MPAA’s bidding, in exchange for party donations.

Megaupload was a direct threat to Hollywood, they had to do something to take him down. I suspect a lot of businesses have lost trust in any file-sharing sites, but if Kim comes back with a site and with statements about backups and hidden servers all over the world , i am sure he will get more customers than he ever had, especially if he guarantees every member that there data will always be safe. Imagine the US trying to go into Russia to seize servers and at the same time going into 20 or so other countries that have mega backups. I think he will start a new wave of design for businesses to protect themselves from false seizure by the US. I wonder if someone could create a bunker just for this reason, a bunker that has entrances only one or two people have the power to access.

LOL i can see the future, American president authorities drone attack on private home in New Zealand because they are sharing music and movies online.

Cyberlockers and bittorrent are how independent bands, filmmakers, and software developers distribute their products.
Contrary to popular belief, Big Media’s attack on cyberlocker and bittorrent has less to do with filesharing of copyrighted material than choking off the up-and-coming competition, who give away their wares at much lower prices or for free.
Big Media’s greatest fear is that people will come to realize that smaller unknown artists are just as good as heavily-promoted ultrafamous artists.  Big Media knows that its position as middleman to get good music is on the verge of obsolescence unless they kill the technology the upstarts depend on.

This is the long game, here, not the copyright stuff.

Now, Congress has been going along with Big Media, and turning a blind eye to the fact that a robust and diverse technology foundation is critical for America’s economic and innovation growth.  But they’re destroying their own economy to serve a bunch of losers who backed the wrong technological horse.

This Congress is destroying America’s future economic base, to help the old guard make a few extra bucks before they collapse into oblivion.

To be honest, I don’t disagree about those numbers. But those external filehosts are not further specified. I would garner that most of them are hosts which are generally not used in the same way as traditional cyberlockers.

All this is beside to point. One’s good works do not erase one’s bad works. Al Capone operated soup kitchens to feed the poor during the Great Depression without which thousands of people in the Chicago area would have starved to death. It didn’t make up for the fact that he was also a murdering gangster.

The fact that some people use file lockers for legal purposes does not make up for the fact that the bulk of their business involves piracy and criminal activity. Criminals must be punished and put out of business, even if they operate soup kitchens for the poor.
