Kiwi MP Called Out As Pirate After Passing Anti-Piracy Law

In a beautiful twist of irony, New Zealand parliament member Melissa Lee has been caught in a copyright quagmire. It turns out that just hours before she spoke out in support of the controversial new copyright law being rushed through parliament, she tweeted how pleased she was with a compilation of K-Pop songs a friend copied for her.

This week the New Zealand Government rushed through its controversial 3 strikes-style law as part of Christchurch earthquake emergency legislation. This means that after being ‘suspected’ of sharing copyrighted material online three times, people may be fined and lose their Internet access for six months.

The legislation was brought up again quite unexpectedly this week, despite massive opposition and public outrage that delayed it last year. But this time around there was little room for protest, as it was just a matter of hours before the Bill passed.

As is often the case when politicians decide on copyright-related matters, their very own actions with regard to copyright are being carefully scrutinized. This can lead to awkward situations, something Member of Parliament Melissa Lee found out herself this week.

Just hours before giving a speech in support of the three-strikes law which is supposed to protect the copyright holders, she sent out the following tweet:

So, while Lee was condemning today’s youth and their lack of respect for copyright, she more than likely infringed on the rights of several K-Pop musicians. After all, making a music compilation and handing it over to a friend is not allowed under New Zealand’s copyright law.

Surprised by the call-out, Lee defended herself by saying that the songs were downloaded legally and paid for. But unfortunately for her that doesn’t mean much. As the National Business Review points out, when a friend makes a copy of songs that were legally bought, the recipient of the ‘gift’ is still guilty of copyright infringement.

So it appears that Lee got her first strike already, and since the burden of proof is on the alleged infringer under the new legislation, it’s up to her to prove that she’s innocent. That’s only fair, right?

Although it’s easy to call Lee’s mistake out as hypocrisy, it might be even worse than that. What if she truly believes that copying a legally bought song for a friend is okay? That would mean that even legislators who vote on copyright legislation don’t fully grasp what they’re doing.

In her speech Lee said that it’s perfectly legal to share a DVD or music album with a friend. But does she know that it’s not that straightforward? The laws she helped to pass state that people can’t share a legally bought MP3 with someone, unless they share the entire device it is bought on.

      shouldn’t that be one strike for each offence, and a compilation would be from many artists, so each song could be a separate offence, thus if there were more than 3 artists having there intellectual property “Stolen” then she should already be on 3 strikes and lose her internet for 6 months.

          The law is only in regards to what specific action can be taken against you. It’s still illegal to violate copyright and there are already legal repercussions even before this law comes into action. She should be called on this to illustrate the point. Her immediate reaction on twitter when called on this was to try and imply her friend was the composer of the music. Seems like she changed her story when she realised what a hugely obvious lie that was.
          Funny that her second explanation *still* doesn’t exonerate her, she really must have no idea about the law she passed, doesn’t exactly fill you with confidence, especially when others in her party were talking about how the Internet is like Skynet, and another about how they had to explain file sharing to her with literal boxes, like she was in kindergarten or something.

But, see, the law that just got passed is one of those laws that only poor people without any social influence are expected to follow. Since she’s a rich and influential politician, she doesn’t have to follow it. She gets to break it with impunity and not care.

      I suspect this law would need ISPs to challenge it in court under passed too quickly for it to be correctly understood. It seems they have evidence.

      Passing it under emergency Christchurch powers also seems very doubtful when it is not like fines help reconstruction costs.

          I tunes music is licenced to you and you only. And if you brought say 1or a 1000 songs @$1.99ea and you lose them, tuff luck you’ll have to repurchase. Itunes don’t keep a record of your music purchases though they easily could. But why should they when you can buy them again. Cha-Ching!
          It has only just been legal in the last few years for you to be legally able to put your music on an mp3 player. Most countries still have not change this law.
          Videos purchased over Itunes are worse as they have a ‘limited licence’ meaning you can play them a few times then thats it, auto wipe… Do pay again thank you.

        Just read a dvd disc and it will state that you cannot COPY it HIRE it PERFORM it in PUBLIC (notice they don’t play movies on display tvs at the shops anymore) BROADCAST it or LEND it.
        How the hell you can prevent people from lending and prove they lent or borrowed it I don’t have the foggiest. Must we keep our receipts?
        One of my discs I brought at the warehouse states it can’t be sold outside australia! How did this gross infringement happen am I now too a copyright violator.

I agree that there are people who are working in concert to get these types of laws through, but just because a group of people, who share similar ideals, are working in a similar direction, does not mean there is an evil behind the scenes “conspiracy”.     Never let a crisis go to waste I guess. Wtf does copyright infringement legislation have to do with an emergency situation due to an earthquake? I fail to see the logic.     well technically playing a song on your stereo at a party is against the law as you are not supposed to play it for groups etc, (for private use only) so that shows how dumb the law is and how are they going to track who is downloading what as the ISP’s have said its not their job to scan your data packets to see what you are downloading, they are contracted to supply the data stream for their customers only (the first time they tried to pass this we had an email from Orcon saying they wont do it)
    so who is going to do it and at the end of the day by packet sniffing your data stream are they invading your privacy which is against the law also
