The precipitant difference is that non-commercial filesharers who share for no cash, no profit and no gain do so without ANY breach of privacy (such as deliberately accessing someone’s personal files without their permission, lifting said files, then using them for personal gain).

THAT is indeed naughty, and is NOT representative of the majority of filesharers Worldwide.
