Actually, the one who went on about open source being unconstitutional was Darl McBride, back in 2004 when SCO were trying to sue everyone from IBM, Novell, Red Hat, Toyota and Daimler Chrysler.

As i recall it more or less made the case why software patenting in general was a Bad Idea(TM).
