Malaysian Government Orders Torrent Sites Shutdown
Written by enigmax on June 27, 2008Reports are coming in that the government in Malaysia has ordered the immediate suspension of many BitTorrent trackers hosted in the country. In a shock move, the government - citing the ‘Copyright Act 1987′ - has ordered hosts to suspend servers hosting BitTorrent sites, pending an investigation. Many sites are offline.
When BitTorrent sites get into legal trouble or other pressures force a move to a new location, the speculation begins on the safest place to go.
For instance, would a site bail out of the Netherlands and move to Canada? Is Canada too dangerous now, and would a move to Sweden be more appropriate? What about moving to Ukraine-based hosting like Demonoid or further afield - China or Russia maybe? Inevitably, discussions usually involve ideas of moving sites east, to countries like Malaysia. Fairly high-tech countries like this seem an attractive proposition, particularly given their government’s track-record in failing to do much about piracy.
Given this background, BitTorrent tracker admins with their sites hosted in Malaysia were confronted by a very unpleasant surprise today. An administrator from a well known tracker contacted TorrentFreak this morning with worrying news, he told us: “Malaysia’s government suddenly forced all torrent websites to shut down today until further notice, a complete surprise to torrent admins and the offshore hosting companies in Malaysia.”
The news was given to this and other site admins, via an email from their hosting provider, which indicates the action has been ordered down from a high level. The email informs the admins that their servers have been suspended by the Ministry of Domestic Trade and Consumer Affairs, under the Copyright Act 1987. As the request came from the government, the host makes it clear they had no choice but to shut down the site. Among the affected sites are Extremebits, Rapthe, Superfundo and several others. According to sources, although torrent sites have been taken offline, other sites dealing in pirate material have also been suspended after the government decided to act on mounting copyright-related complaints.
Prominent Malaysian host Shinjiru confirmed the closures, telling TorrentFreak: “We can confirm that this is accurate. We had enforcement officers from MDTCA visiting the office to confirm the closure of BitTorrent sites hosted on our network. We will comply to all shut down instructions from the local authorities or agencies with warrants or documents.”
Update: Contrary to comments from a site admin, sources close to the situation are saying the shutdowns are limited to a small number of sites and aren’t necessarily part of a wider crackdown, despite government involvement.

Well yeah, going to a country like Malaysia is a double-edged sword. On one edge you have lax enforcement of copyright laws, and on the other you have trivially easy susceptibility to e.g. bribes and foreign pressure.
Most likely a friendly WTO or US representative went and had a friendly chat over some trade blacklisting threats and the Malaysian representative “agreed” to pull some fairly illegal moves.

I still think Eastern Europe is the place to go for hosting but you know it will simply move around as times change. Some day it might be in South America and/or Africa where our primary hosting is coming from. Or more and more people could open trackers and make it hard to bust everyone.

What’s the point of it, though? You have the same thing just by going to an uploader’s Mininova page. Seriously, why wait for someone else to put an uploader’s torrents on their site when you can get them straight from the uploader on a site they upload to?

A lot of content is American-made, but there is still plenty non-American-made content.
The news is not totally true. There is a shutdown request for a few websites NOT a government order on all torrent websites. It is from the local copyright infringement authority in Malaysia seeking for few websites suspension to facilitate their investigation. This is the standard checking procedure whenever a complaint is received. Unfortunately the request happened to be end of the week. The websites will have to remain shutdown as the authority does not work in the weekend. We have to wait until Monday for further update.
Malaysia stinks. Open sewage is still in it’s cities. That place is filthy.
On that note. Funny how the Government cracks down on this, yet, you can get an illegal underage prostitute quite easily there with the authorities turning a blind eye.

as an educated American who’s actually left their home town a few times in my life time i’d like to say a couple things.

LOL - I’m a Malaysian, and from what i know about the homeland, Piracy is ever prevalent - most of the game shops that exist only sell pirated games, and there are entire marketplaces devoted to stuff that’s been jacked from cargo crates in Thailand or other ports nearby.

Look at uploader’s pages on Mininova, TPB, Torrentbox, etc. Simple. No need for another site to just download from Mininova and put it on a site with a very weird name.

if a site is clean and DOESN’T actually contain any copyrighted materials (included other corporate logos, images and trademarks) they should be allowed to reopen.
Torrents in itself are “de-centralised” and DO NOT contain any copyrighted material. Each torrent basically tells the clients “where” to look for the files… 99.9% of them are held on client machines, not the tracker! So it boils down to the local government’s are curious about the contents of the host’s servers…
Best place to host is Sweden. Their laws states, unless they’re breaking LOCAL copyrights and trademarks there is no offence, no laws broken - hence, the RIAA (and the likes) can go suck on a fuckin’ brick!
