MPAA Using Megaupload Case as Backdoor SOPA, Court Hears

Political activist group Demand Progress has filed a brief in the Megaupload case, urging the court to disregard the MPAA’s concerns over the return of data to former Megaupload users. The group argues that Hollywood lobbyists are out to make it impossible for Megaupload users to access their property, effectively using the court case as a backdoor SOPA.

Demand Progress is joining the Megaupload case as a non-party. The group has filed a brief refuting claims made by the MPAA, and asking the Court to consider the many innocent users who are still unable to access their personal files.

The MPAA previously told the court that Megaupload users should only be allowed to get their files back as long as access to copyright-infringing files is blocked. According to Demand Progress this request is practically impossible, against the presumption of innocence, and effectively an attempt to enforce SOPA-like actions through the backdoor.


Demand Progress’ The Internet vs. Hollywood campaign

In the brief the activist group says the MPAA is trying to use the Megaupload case to achieve what Congress rejected earlier this year, when it decided to shelve the SOPA and PIPA bills.

“Legislation that sought to achieve the very results the MPAA now seeks to obtain de facto through mere seizure of Mega Servers — with or without a conviction – was rejected by Congress,” the brief reads.

“Specifically, the failed legislation tried to render inaccessible data on websites that host user-uploaded files, and to do so at the request of private parties like MPAA, without due process for targeted business owners and users.”

Despite the fact that Congress rejected SOPA and PIPA, the MPAA will now get the same secondary liability scheme enforced when the court grants the requests of the movie studios, the group argues.

Demand Progress further tells the court that the MPAA’s request not to allow access to infringing files goes directly against the fundamental principle that Americans are presumed innocent until proven guilty.

“The MPAA reasons property owners should prove their property non-infringing before the Court permits them access to it. This is akin to arguing that when a thief rents a hotel room and is caught, the contents of all of the guests’ luggage should be presumed contraband until proven otherwise. This result would be absurd and unreasonable.”

“On its face, the MPAA’s request is suspect and asks the Court to bootstrap the guilt of parties onto a collateral motion, prior to a judgment,” they add.

These are worrying developments according to Demand Progress, not just for Megaupload users, but also for the hundreds of millions of people who store files on Google, Dropbox, Facebook, Tumblr, Instagram, YouTube, Flickr and other online services.

To add weight to their plea, a new campaign titled “The Internet vs. Hollywood” is being launched today in which members of the public are invited to add their name as supporter of the brief.

      Your comment would have made more sense if you used real attributes and elements along with filling the attributes with a value.

      I suggest you use the HTML5 data attribute as then you can write whatever you want as the attribute name and it’ll be W3C valid.

    I am only now wondering the point when the DoJ/FBI and MPAA give up on this case and MegaUpload gets back into action. So today first we hear they did an unlawful raid and now the lack of data return comes under yet more attack.

      Think about the relief when people will get their files back. What did the MPAA was unlawful and they should pay for their actions and put MU back online.

      However I don’t think this will happen, think about it, Last december MU announced their project “MegaBox”. 90% for artists and 10% for them. This Innovation will kill them to their roots, because they can’t innovate, they block the innovation just like the church in the middle age.

      I wish to see MegaBox alive, I will buy my entertaining stuff there just to TROLL the MPAA/RIAA, I won’t be the only one, I bet.

      My best guess is the DOJ will do everything they can to string this case along until at least after November.  I get the feeling this MU raid was just something they slapped together to try to appease Hollywood’s rage after SOPA/PIPA failed.  Now, they were probably planning something like this ever since MegaBox was announced, but after SOPA/PIPA fell flat it was necessary to “do something” and do it fast in order to keep Hollywood from throwing a temper tantrum.

      Obama wants to have Hollywood’s money and influence on his side come election time.  If the DOJ drops the case, it’s going to make Hollywood mad.  So the DOJ will do whatever it takes, ignoring, twisting, or making up any laws they have to for the next few months.  After the election, I have no idea what will happen.  But the DOJ can’t afford to make the boss (Hollywood, not the government or the people) mad until after the election is over.

        I think the assholes at Hollywood are always mad.  Sure, the DoJ could string the case along for as long as possible, but Hollywood is going to support Obama even if this case flops tomorrow.  With all that they’ve invested already, switching politicians would only help them if they had Romney in their pocket.

    We should prepare ourselves to get data we need. There is a lot of lost manga comics which were banned by Ishihara’s Tokyo Manga Ban and often the links to scans and translations were working only on Megaupload. A vast amount of good material might be lost if we do not get them when opportunity appears, since the distributors are not going to print it again under new Japan laws because of “immorality”, but they do own the copyright and mangakas cannot put it on net themselves, making the content pratctically censored. That’s why we MUST fight against any attempts to criminalize filesharing, since it might be only way to obtain some good material to satisfy our desires. Imagine for example that Aki Sora would be lost…

    I added my name to this list and some of the other “Demand Progress” campaigns. Can’t hurt. I don’t know if these campaigns are limited to US residents or not. We all made a difference in getting SOPA and PIPA shelved (for now at least).

    Best of Luck to Kim Dotcom and all associated wronged parties in pwning the DOJ, FBI, MPAA  etc. and those NZ authorities who aided and abetted these entities in wronging the aforementioned wronged parties. Hopefully all the Mega Upload customers will get all their data back and Kim Dotcom et al. will get Mega Bucks for the Mega Fuck they’ve been put through.

    MPAA and the idiots they roped into helping them have made such a complete balls up of the Mega case, they are now crapping backwards over the consequences. they are going to continue to use any means and any person they can pay enough ‘encouragement to to still get an overall, favourable result and that is to keep as much data as possible from Mega users regardless of whether that data is/may be infringing or not. if any ordinary person were to behave in such an obviously disgraceful manner, they would be condemned out of hand. these bastards, however, think it is all in a days work! i hope they are shot down in flames and left bleeding profusely from every orifice!

    Uhm.. Except most of the users files on Megaupload really aren’t theirs..right? Just because you upload a movie doesnt meant that the movie is yours (unless you made the movie.) Ive always found the whole mantra of “the internet vs hollywood” to be just plain dumb.  People on the internet watch movies and tv shows all the time yet when hollywood asks for something in return, people act like the dramatic tirades about how hollywood has wronged you bla bla bla are sure to follow.  For what it’s worth, I think $20 for a new movie is a little pricey too. If it were up to me, it might be like $15 or something.  But it’s really not that bad. I mean, there are what.. perhaps a few good movies that come out every month?

          It’s not the movie you upload, its information describing the physical patterns of your property, as in the copy. You seem to be confusing the movie with the copy.

          yes, those are THEIR files, they might contain UNLICENSED copies of material that is COPYRIGHTED but that is no reason to deny access to them without i.e. court warrant, just because someone thinks that they might broke the law

          so far all in this case is based on law enforcement ‘thinking’ but not doing their jobs by the book

          i.e. blocking funds because they think all company income comes from illegal sources, search without valid warrant, fbi STEALING files from Dotcom (hey, how cone that they can copy that illegally obtained ‘evidence’ without any rules? and i would have* to pay for avi version of my bluray disc to watch it on my old laptop?)

      What ever happened to fair use?  If I want to backup my music collection that I legally purchased and ripped in the cloud for retrieval at a later date, I’m now a criminal?  That’s ridiculous.  So yes those files really are mine, I bought them, they are mine.  If you are telling me that what I purchase is not mine, I will stop purchasing.  Who would spend money to not own something?  Would you?

      Demand Progress have NOT made false statements against the MPAA with regards to what they have submitted in the brief in the Megaupload case. The MPAA will have to prove that the statements made are false and they will not be able to prove it.

    Lets use a simple analogy here,say  you own a car rental agency. Someone rents a car from you, then uses it to commit a crime are you culpable? You made money from the car rental.  Now does the government seize the rental companies cars? Do you arrest the owner of the rental car service? Then there is car leasing services, the list goes on. So my question is whats the difference? Megaupload was maybe used for infringment. Use The data to go after the renters not the owner.

    There’s one thing, if nothing else, that bothers me here.  The MPAA won’t let us have our data back until it’s proven to be compliant with copyright laws.  I, as an individual, have committed no crime, and I have no pending case against me;  I’ve never even gotten so much as a parking ticket.  The MPAA is assuming that I’ve used the cyberlocker Megaupload to practice piracy.  I’m presumed guilty of crimes they themselves have accused me of, completely sidestepping due process, and denying me access to my legitimate files. 

    The US government cannot legally do this, but then again, they’re not the ones doing it, the MPAA is.  Why are they allowed to assume that I’m guilty of piracy and therefore do not have the right to access my files?  It doesn’t make any sense.

     …I thought this would be another interesting movement that could seriously help the freedom of the internet, saving it from the bullshit shackling to a single country that countries like China and the US seem to hold delsions over.

    …Then I need a US zip code to sign up. These guys are going to be just as bad as the Hollywood bastards if they actually get any power, I’ll wager. Just another popularist political group looking to gain some cheap support.

      I went to the site to add my signature of support but it looks strange to me. It takes forever while it sets a bunch of cookies and generally comes across like a fishing site.

      Also, the list of signatures is a complete mess so I’m doubting that this will make a good impression. Anybody else notice this?

       the same could be said about the non artist or the person who had the original idea …just because it’s copy-written does means it’s original …and stealing can only be a physical item by definition … Lets go back to privacy on this issue If you don’t want your idea or art out there keep it to yourself or it will be criticized broken down torn apart by the next guy … hell look at the ball ..it comes in a variety of sizes colors uses … nothing is original or unique it’s all stolen from someone elses works creations ideas ….  history repeats itself

      The MPAA is making the argument that they are stealing the MegaUpload users files as a matter of free speech – I did not know that.
