MPAA: We’re No Pirates! You Are Thieves! Or?

The MPAA is outraged and offended by “The Pirate Bay and their apologists” who “seek to justify profiting from digital theft” by referring to Hollywood’s founders as pirates. Not true, they claim. Instead, the early inhabitants of Hollywood were independent filmmakers who were censored by a copyright monopoly. They were freedom fighters who saw no other option than to infringe patents for the sake of creativity.

hollywoodTwo weeks ago we published an opinion piece where we pointed out some unfortunately-phrased comments from MPAA boss Chris Dodd.

The former congressman pointed out that the film industry was able to thrive because of intellectual property protections.

“The ability to give birth to an idea and convert it into economic success, whether it is the content of a film or the technology of the internet, depends on copyright and patent protection,” he said, referring to the history of US film.

We thought that was ironic. Why? Because Hollywood was founded by a group of independent filmmakers who “fled” from Edison’s patents, among other things. The full story (see Copyhype) is richer, but it’s a well-known fact that those who now rule Hollywood refused to obey the patents.

To emphasize the irony we described Hollywood’s founders as “thieves” and “pirates,” using quotation marks. Aside from these terms, the events described in our article are mostly undisputed. In no way did we say that this history justifies modern-day piracy, we simply pointed out that Dodd’s comments were unfortunate.

The MPAA, however, doesn’t like to be called pirates. In a recent blog post they refer to the Copyhype post, claiming that what we and others such as Lawrence Lessig wrote is all lies. We are thieves.

“If you ask the operators of The Pirate Bay and their apologists, they’ll say Hollywood was built by a band of pirates, fleeing stringent East Coast patent protections to a free and open land to create at will. This theory conveniently parallels their own existence, as they seek to justify profiting from digital theft.”

And these thieves are wrong, the MPAA claims.

Hollywood’s founders were no pirates, but freedom fighters who rebelled against a “copyright” monopoly.

The patents at issue were held by the Motion Picture Patents Company, which, through restrictive tie-in agreements and licensing practices, severely impeded independent filmmakers from entering the market.”

Hmmm, that sounds familiar.

These independent filmmakers lost the first patent lawsuit, but eventually the court sided with them.

“The status quo was challenged, and shortly afterwards, the Supreme Court determined that MPPC’s licensing practices give it ‘a potential power for evil over’ movie producers which ‘would be gravely injurious to th[e] public interest.’ This 1917 ruling severely undermined MPPC’s unfair business practices.”

Fair enough, but the MPAA’s version of the truth doesn’t change anything about the fact that the founders of Hollywood were challenging existing patents. That they won in the end doesn’t mean that patents weren’t violated in the years before.

So Dodd’s comment that “the ability to give birth to an idea and convert it into economic success, whether it is the content of a film or the technology of the internet, depends on copyright and patent protection,” is still rather unfortunate.

Especially because Dodd specifically referenced a time where patents were infringed en masse.

Also, the MPAA’s response in their recent blog post is in itself unfortunate. The lobby group says that Hollywood’s freedom fighters beat Edison because the court agreed that the MPPC had “a potential power for evil over” movie producers which “would be gravely injurious to th[e] public interest.”

Interesting, because today the MPAA is also quite powerful. They are the moral judge who decides what films the public is allowed to see. Not just for the major studios they represent, but also films of independent studios who are NOT an MPAA member company.

Through its ratings system they can make or break films, a “potential power for evil” for sure. Just ask South Park creator Matt Stone or watch “This Film is Not Yet Rated” to get an idea of what’s going on behind the scenes.

    I recall watching a documentary on PBS a while back about early
    cinematography. Someone made a lot of money by “stealing” a certain film
    and playing it in America. The creator of this film never saw a dime
    thanks to that “thieving pirate” (or was he a freedom fighter?). Does
    anyone know whom was involved in this little fiasco? One part I remember is that the films creator died penniless.

    The first films made in Hollywood were made by Biograph, an MPPC member. They probably did not go to Hollywood to escape themselves. That was in the Copyhype article if you wanted to read it for real this time.

    The Copyhype post that the MPAA blog refers to is garbage. The only argument it offers is the suggestion that the Edison Trust’s bullying of would-be competitors is a non-issue because it was ended by the courts in 1916-1917. It then suggests we can therefore believe the studios’ own story that they just only set up shop in California because they liked the mild weather. That would be a sound argument if the studios had only fled westward after 1916, but they actually had done so in 1911-1915. So Copyhype has yet to offer any evidence to contradict the increasingly well-known fact that the motion picture industry owes its origins and the location of its headquarters partly to the evasion of intellectual property licensing requirements by rogue operatives.

    The fact that the courts later decimated the creativity-stifling rights previous enjoyed by the bullies says that they weren’t ever entitled to those rights in the first place. So I don’t see how the MPAA and their supporters are interpeting the rulings as evidence of anything in their favor.

        Ah, the straw man fallacy: rebutting an absurd misinterpretation or oversimplification of the opponent’s position… although now that you mention it, I have personally spoken with a couple of documentary filmmakers who have given up on releasing their cultural histories to the public because of refusal, by Hollywood and the music industry, to license clips for reasonable rates.

        Anyway, let’s see if I can break it down for you. Today, Hollywood calls people who don’t pay up every time they watch, transmit, or utilize even the smallest clip of a movie or TV show “pirates”, even though not every situation legally or morally calls for permission, let alone payment of whatever amount the gatekeepers think the content is worth. So these “pirates”, be they actual lawbreakers or not in their particular situation, increasingly operate amongst themselves, with wild success, in venues and using methods that are more-or-less outside of Hollywood’s system.

        It’s not a perfect parallel to what was going on 100 years ago in the history of cinema, but the similarity is obvious, i.e. the cat-and-mouse game between the modern-day movie mafia and the “pirates” who refuse to play by the industry’s rules.

        Back then, the courts eventually put a stop to the most extreme forms of rent-seeking the “legitimate” industry was doing. And then, instead of continuing to try to villify and beat the “pirates”, the industry joined them and played by new rules. The result was a century of success…well, unless one considers the fact that they failed to preserve the majority of their own product, or the fact that they still haven’t wrapped their heads around the Internet…

    What I find interesting is the MPAA responded to a TF article.  If they are so high and mighty why wouldnt they just ignore everyone who dissents.  To defend themselves against TF may indicate they are losing power and one way or another the playing field is becoming level

      Well, technically, it’s the Copyhype post that names TorrentFreak, among others, as
      propagators of the “Hollywood was founded by pirates” story. The MPAA blog just refers to these online media outlets as ”the Pirate Bay and their apologists.” See, the MPAA isn’t creative enough to even attempt a rebuttal to that story on their own; they waited for their friends at Copyhype to do it, and then the MPAA just pointed to it. …not that the Copyhype post actually says anything of substance; they seem to think they busted a myth, but as I pointed out above, their argument is rather flimsy.

The music and film moguls know they haven’t a cat in hell’s chance of doing anything about piracy (And I would suggest EVERYONE in the UK changes over to Non-UK DNS servers, so the courts have no jurisdiction whatsoever over your browsing!) but they don’t like TPB hosting a lot of material by unsigned bands, hence their action. Just like the FBI ripping into MegaUpload, because the ‘ultra-richie’s took fright over Mega’s intended new media business model that would cut out the likes of the music and film companies.

    The movie compaies and their MPAA are certainly a bunch of greedybullies, but this story will tend to encourage confusion because itdepends on treating copyright and patents as somehow comparable, Sincethese two laws are almost totally different, thinking that they gotogether a grave error.See http://www.gnu.org/philosophy/not-ipr.html for more explanation.We don’t need to cite patent cases from a century ago to refutethe claim that sharing equals theft.
