Nearly the same thing happened to Narvik Studentradio, a non commercial creative commons radio, that only plays creative commons music.
TONO which administers copyrights for music in Norway, claimed music royalties from the radio station and demanded us to sign a backdated contract.

They gave up eventually.

I think GEMA knows they don't really have a leg to stand on. It's just that they feel they don't have anything to lose by turning CC into a huge hassle for anyone who uses it. The hope is that by doing so, people learn that it isn't worth the trouble and so stick to paying for copyrighted works that fall under their umbrella. Underhanded tactics, but if the law allows such abuses, then that's that. The only thing for it is to either change the current law, or enact new ones which make it illegal to run what is essentially a twist on the pay up or else racket we commonly see these days. The bonus is that those accused will likely pay the demanded fees just to make it all go away, which is a lot easier than trying to prove each and every song is indeed CC.
