New Anti-Piracy Watchlist Zooms In On File-Sharing Tolerant Countries

The Congressional International Anti-Piracy Caucus has just released its 2012 International Piracy Watch List. In addition to countries such as China, Russia and Ukraine, this year Italy and Switzerland make fresh appearances in the list. Both countries are accused of not doing enough to combat online infringement with the latter allegedly proving itself as a “magnet for rogue sites.”

The Congressional International Anti-Piracy Caucus (IAPC) has just released its annual report in which it criticizes countries that in their view simply aren’t doing enough to protect the intellectual property rights of American creators.

It will come as little surprise that the two nations topping the list are China and Russia, with neither country expected to get a clean bill of health from the West now or in the near future.

On file-sharing issues, China’s leading search engine Baidu was cautiously praised for coming to an agreement with rightsholders, a move that led to its removal from the USTR’s Notorious Markets list. Russia was again criticized for its lack of IP protection legislation which has led to “rampant Internet piracy affecting the global market.”

Ukraine, former home to the currently suspended Demonoid BitTorrent tracker, was also subjected to the usual criticisms with the note that instead of improving, things are actually getting worse.

“Ukraine is a hub for infringing content through peer-to-peer networks and hosted websites, and is home to one of the world’s most notorious pirate markets, EX.ua,” write the IAPC.

After local authorities took down the file-hosting service in January the site made an almost immediate return. IAPC say that the Ukrainian government bowed to public protest.

But while the watch list inclusion of the China, Russia and Ukraine trio will shock no-one, there are also two new euro entries – Italy and Switzerland.

“Piracy in Italy continues to hurt both Italian and American creators. To date, there has not been a sufficient legislative framework for addressing the problem, or clear leadership in developing one,” the report notes.

“Without substantial reforms, the piracy problem will continue unabated in Italy and the widespread perception will endure that illegal downloading is not harmful.”

In recent years Italy’s Guardia di Finanza (Financial Guard) has been involved in many file-sharing investigations (1) (2). It has also ordered a trio of prominent ISP-level blocks against leading BitTorrent sites, first against The Pirate Bay, then the now-defunct BTjunkie and most recently KickAssTorrents.

However, following the so-called Peppermint Jam case, Italy’s Data Protection Authority ruled that monitoring P2P users and collecting their IP addresses is illegal.

The IAPC’s complaints about the Swiss go even further, with the landlocked country accused of loose IP protection that makes it a magnet for, apparently, some of the world’s worst sites.

“Switzerland’s copyright law is inadequate, making it a home for rogue sites whose clear purpose is to facilitate and enable massive unauthorized making available of pirated material,” the report warns.

As noted by Ars, the first large site that springs to mind in Switzerland is RapidShare, but Daniel Raimer, General Counsel for the file-locker site, says he believes the report refers to another company.

“RapidShare understands that this action does not pertain to RapidShare,” Raimer said. “We continue to work with the content industry to mitigate copyright abuse and make our services as accountable and transparent as they can possibly be.”

The lack of clarity from IAPC appears to be relatively new. In previous years’ reports the caucus hasn’t shied away from naming sites. However, in recent months TorrentFreak has indeed noticed an upward trend of file-sharing related sites (BitTorrent, streaming and cyberlockers) appearing on Swiss-based hosting. The other possible objection from IAPC is the presence of the Razorback2 eD2K (eDonkey) indexing system which was subjected to huge raids in 2006 but later recovered.

The position on general file-sharing in Switzerland also appears to be a problem. IAPC notes that the country needs to “clarify that copying from illegal sources is illegal.” This is a reference to Swiss copyright law which contains a private copy exception but does not state that the copy has to be made from a legal source. This effectively legitimizes downloading and streaming of pirate content for personal use.

While the IAPC recognizes former watch list entries Canada and Spain as nations “in transition” due to their recent efforts to reform copyright law, neither country escapes completely. Both are encouraged to continue down a legislative path that will see greater protection for US intellectual property.

          Voting for alternative parties just to send a message, without examining and considering their positions on issues that matter to you, is a dereliction of your democratic duty.

          In the US, if you look at the alternative political parties, their deeply uncharismatic candidates, and their absurdly narrow and contradictory platforms, it’s hard to get excited about what they offer.

          The US does not have a parliamentary system where the government falls apart every month, and where someone can be voted into national office by the 1200 people who feel passionately about the candidate’s single pet issue. Candidates in the US need broad platforms and mainstream appeal or they don’t get elected.

          Given the degree to which the two main parties are entrenched, alternative parties shoot themselves in the foot by splitting the electorate. The rise of a party which advances an issue which sharply divides Democrats and Republicans (which, sadly, is almost all of them) is just handing a win to whichever of those two is opposed.

          I’m pessimistic that alternative parties will ever have much power in this political climate.

           i think what WilfredUS was also trying to bring across is to change something you first have to make a point and vote something else despite if you like the candidate or not its to show the other two parties they have to change something. It is for sure a democratic duty to do so and no dereliction of it.

          You have to take drastic measure in the current US political system because it is totally corrupted by all the lobbying.

          The good old days where you were able to see a government doing the right thing for their citizens are long gone and will for sure not come back if everyone would do it like you just mentioned and only vote for someone who is the way you want him to be will never happen.

          Both parties of the US political landscape are doing nothing to let anyone feel they get cared for.
          For me its still a mystery why US voters keep on voting the same old system. I can´t let it count to only say because all the other candidates aren´t right for me. Nothing will ever change at all

          I wouldn’t say the world would be better off without the USA, because when the USA isn’t shoving it’s political and financial agendas down the throats of other countries, it actually does some good. I would say however, that the MODERN United States political system is corrupt and needs a shake up. Maybe the UN can step in, do an audit on the country, and investigate and force changes on this SERIOUSLY corrupt government.

        You’re thinking of Australia. The following is a very simplified view of what actually happened. The US was originally inhabited by the wealthy landed citizens of the British Empire, the French, Spanish, and to an extent the Russians. Italians as well. They imported a labor force from their respective motherlands. Some came seeking a place to practice their religions, Dutch and Belgians for instance. Later Africans were forcibly imported in a slavery system comparable to that present in most other parts of the world, the US just had a more labor-focused system. The Irish eventually moved here en masse during their own famine problems. In the last century Eastern Europeans and East Asians began to move to the United States. The entire time it was the promise of a better life that drew many immigrants to the US. Whether they got that is a toss-up.

        Anyway, to address the rest of your largely inane rant . . . it’s best to address a target audience from a position of mutual association. Defamatory approaches don’t win anyone over, they don’t get anyone to take an objective look at what you’re arguing. They can only alienate people. Ethos arguments only work when its a topic your target wants to hear about. Otherwise you have to persuade.

          I am not American. I was thinking more of the global scale of economics. China owes the majority of their wealth to exports. These huge number of exports wont exist if they are the largest economy on the planet, they will be forced to import if they are richer than the rest of the world.

      I was just speaking with a fairly wealthy American friend who spent some time living and working in Switzerland. At his own expense, he runs various ad-free servers which contain nothing illegal or related to piracy, but which do host some “sensitive” content that isn’t entirely approved-of in the mainstream political world, in the U.S. and otherwise. He’s moving all his hosting to Switzerland precisely because the U.S. is becoming, in his words, “a surveillance state”—increasingly uncomfortable, and legally risky, for him and for the users of his systems. Of course it’s somewhat hyperbolic; the American government’s privacy-invading, due-process-denying antics are nothing compared to the truly oppressive regimes of the world. But the situation is getting worse, not better.

      He’s not optimistic that Switzerland won’t go down the same road, but for the time being, having your hosting there is a better option, so he says he’s taking his business elsewhere, “voting with my dollars.” He knows he’s not going to bankrupt any American ISPs by doing so, so it’s not like he’s really sending much of a message; it’s more just about freedom and doing what’s right.

      It’s shameful that the USA, champion of liberty in so many ways, turns its back on its principles whenever it can cast freedom as a threat to either safety or commerce.

      By design, international trade policy is 100% by and for the benefit of corporations. The rights of workers and consumers are only taken into consideration as an afterthought, and only when it’s politically popular to do so. I think without exception, workers and consumers have to protest loudly in order to pressure their policymakers to do right by them, and often these cries fall on deaf ears because the benefits of international trade are thought to outweigh the sacrifices made along the way. (Evidence seems to support that point of view, unfortunately; the more public input into the process, the fewer trade agreements that result).

      Every country has offices and legislative sub-bodies which dictate that country’s international trade policy, apply pressure to potential and current trading partners, negotiate trade agreements, and do whatever else they can to protect local industry and boost exports. The U.S. is not unique in this regard.

      The U.S., being a major producer of “intellectual property” aimed at the general public, has a lot of leverage when it comes to dictating international trade policy around that particular industry. For example, Italy surely wants the U.S. to reduce import tariffs on Italy’s motorcycles, pasta, wine and olive oil (the tariffs were meant to protect American producers of those things).           The Berne Convention, The Universal Copyright Convention(both the Geneva Act and the newer Paris Act), TRIPS(Well, Russia is only an observer of this), and The WIPO Copyright Treaty. All of those are copyright treaties they signed. Now pick which one(s) require them to respect and enforce a fellow signatures copyrights. Here is a hint: ALL OF THEM!

          I don’t disagree, although you gotta admit, it’s a lot easier to be worldly when you’re highly dependent on international trade, and when you can throw a pebble and have it land in another country where people speak a completely different language.

          Try growing up in a relatively self-sufficient country (aside from oil consumption), where you can drive for days in any direction, cross plains, forests, mountains, deserts and rivers, and still be in the same country. Live your entire life within 25 miles of where 5 generations of your family lived and died. Never have any reason to go to the next state over, let alone one of the two countries you don’t have to spend 2 month’s wages and fly for hours to get to. You would be ignorant of world affairs, too.

          But even if other countries did a better job of impressing upon Americans how wonderful everyone else is, and Americans were less vocal with their patriotism, it wouldn’t matter; it’s not like America would then be obligated to stop trying to protect its industries and exports.

    This is a simple example of how they use divide and conquer tactics.

    How about we use the same tactic on them. Lets make an list of the worst anti-sharing companies. And then lets boycott the one on the top all the way into bankruptcy. Then lets see what will the others do to avoid being on the list.

    Boycotting them all at once is less effective because:
    1. they are much less motivated to try and change when they are all in it together.
    2. we are much less capable of boycotting them all at once.
    (notice how those also apply to that anti-piracy watchlist)

    To make it a fully effective boycott we should not only stop buying anything from the target company. We should also make it so that others don’t support that company. Avoid buying from associated (advertising etc…) companies. Avoid voting for associated (donations etc…) politicians. Dislike people who support that company. Make supporting that company a social, political and financial taboo.

    Then lets see if they will still be anti-sharing.
