If that was the case, then indeed he “was in the wrong”.

However, the download capabilities shouldn’t be an issue singe many countries allow Format Shifting and a tool in itself cannot infringe copyright, a user can.

Well I guess they are going to release their own emulator and game store ? If not they are idiots, people will always be able to get around stuff and run emulators. Emulators on smart phones are truly a thing of joy. Retro games were almost like designed for smart phones now it seems like, they work perfect on modern smartphones.

It’s about the games not the emulator, I’ve got all the cool games like tonnes of them downloaded on my smartphone. Of course you would carry them with one cartridge per game in your giant ruck sack everywhere you go right ? Seems like the kid probably included Nintendo’s system files (BIOS) or some kind of mechanism to autodownload the BIOS files from the Web. That won’t fly unfortunately in the IP-insane US.

If he wanted to get away with this, his only option would be to reverse the BIOS and code and OpenGBA BIOS to include with the emulator. Compatibility issues would abound, but it would be fully legal.

Also take the ROM download feature out, just make people get their own ROMs. Though iOS is really locked down, can’t just mount it as a USB stick or anything so I don’t know how you’re meant to get the ROMs onto the device otherwise.

He means that you can dump the system files from the console you own, and then use your own copies. No need to acquire them from the Web. I’ve actually done this on the PS2.

Similarly you can copy your own ISO images from CD/DVD games you own.

This is personal use and cannot be discovered, so it isn’t really anything you can get in trouble for. Emulator files themselves are really the IP of their programmer until you load up a BIOS dump from the original system.

Well, folks. This IS Nintendo of Amurica doing this. So how they handle copyright in movies and music. Video games are no different. If this is such a problem for Nintendo, maybe they ought to consider opening up a factory or something. Then make those handhelds again.

Or they can sit down and shut the hell up since this isn’t helping their image any considering how badly their ass is getting kicked in the competition now.
