It is good to see these sorts of cases making to court, never mind to a senior court (there is a tendency for the copyright groups to back out whenever it looks like they might lose, and force a settlement when they might win), but at least High Court judgments are nearly always published - the Newzbin 1 case was an interesting read, and wasn&#039;t quite the crushing victory the MPA claimed.

If BT lose this case (remember, it is against BT not Newzbin2; which is probably grounds for a Judicial Review/appeal in the first place), they can appeal to the Court of Appeal, and then the UK Supreme Court (the House of Lords hasn&#039;t been involved in the judicial system for a couple of years now, and before then it was only linked in name). At some point, there might be an option for a referral to the CJEU, but the matters involved are fairly well-trod (there&#039;s a Spanish case about this sort of thing, iirc). The other option would be an appeal to the ECtHR, but now that copyright is protected by the Convention, that could be difficult.

Of course, none of this is any good to Newzbin2, as they won&#039;t be able to afford lawyers...]]></description>

		<description><![CDATA[It&#039;s about time these cases hit the more senior Courts because their decisions will shape and influence the way people AND businesses interact with each other online.

Nothing will be &#039;set in stone&#039; but if the Courts decide against us and against freedom on grounds of profit - we&#039;ll simply have a longer, harder and more fervent campaign to right those wrongs for the sake of society Worldwide.

Let&#039;s just see how they decide first though.  Then we goto the next stage in the legal appeal process (hopefully).  If I remember correctly the next stage from a High Court decision is the Court of Appeal, then to the House of Lords Judicial Committee (or if important enough, the FULL House - but that&#039;s very rare).  Then there may be an opening to the European Court of Justice.  But that process applies to both parties, or more specifically the losing party to the proceedings.

History shows us that High Court decisions usually go &quot;against us&quot;, and it&#039;s then up to us to pursue an appeal.  So I&#039;m not getting my hopes up on this one.  But it aint the end of the internet whichever way they decide.
