OiNK Admin Released From Custody
Written by Ernesto on October 23, 2007After a turbulent day the admin of the raided OiNK.cd was released from custody. At this point it is still unclear what the legal consequences will be, but it is good to see that OiNK is back home.
The OiNK admin contacted TorrentFreak by email which confirms his release. As for the OiNK users, it is highly doubtful that the IFPI or BPI will go after them all, or even one of them. They do know how to scare people with messages like: “A criminal investigation continues into the identities and activities of the site’s users”, but there is no evidence that they actually will.
More interesting perhaps, how did they gain access to the OiNK domain, and why are they allowed to spread this propaganda? They are not a law-enforcement agency.
NFOrce, the ISP of OiNK, said today in an interview that they were not aware of any illegal activities surrounding the site. They thought OiNK was hosting a streaming video site or a weblog. Yeah, right.
The BBC did a small report on the arrest with a lot of false information, releasing nonsense statements such as: “illegally downloading music onto his website” and “paying subscriptions to enter the website.” The video of the arrest is shown below, see for yourself.

Yours truly not being from the UK, perhaps the following ideas will be ill-conceived: The fact that the BBC was invited along to film and subsequently broadcast his arrest indicates to me that most of the rigmarole is an orchestrated propagandistic campaign. The only “other side” of the story presented in the video is “few feel sympathy for the record companies.” The fact that the BBC (and numerous other agencies) disseminated false information also smells fishy. The oink.cd’s ugly new index page appears to be a similar fear tactic.
But why doesn’t the news take a more liberal stance, let alone do fact checking? Was OiNK too underground for the BBC to find out the truth, or factual information just too much to demand?
At this point in history I shouldn’t be shocked to find that the media is merely another arm of the law, but nonetheless I am.

If that source is somewhat accurate, I’m one of the 50% of users from the US. Please, criminally investigate me.
It seems to me, the main issue is that OiNK’s Palace was the source of PRE-RELEASE material, meaning before the record companies officially released it. Which is a valid case of concern, considering that after it leaked onto OiNK, it was then leaked on and on to other torrent sites — some public. This is not to point the finger at OiNK being the sole culprit of every leaked pre-release, but apparently 60 in this year alone. Impressive!
On the other side of the issue, having THE 100% FREE privilege to OiNK allowed an honest individual to preview albums before investing. I have no qualms paying $10 for a new, newly-released CD, or less for used. Albums which I missed the initial release sale, I’m stuck paying $20 if I want it new. Where I live, I know for a fact the average young person - avidly into music - doesn’t have the $20 to drop on any and every album s/he likes. Twenty dollars for a shiny piece of plastic, worth maybe one or two.
And where is this profit going? Mostly, right to the industry executives, who are undoubtedly the source of this fire. A few cents per CD might go to the actual members of the band.
More of my hard-earned money goes to the band, which is why I go see them in concert when I can. This is not to say I don’t buy their albums.
The point comes straight to money - just like always. Record sales down a whole third in six years?! It can’t possibly be because of a lack of talent in the mainstream of music. It can’t be because albums are overpriced if they’ve been sitting on a shelf for a while. It must be because of illegal peer-to-peer downloading. Thanks for the great insinuation of logic, Media. Next time I want shit stuffed down my throat, I’ll eat my own.

I got a warning and I live in the USA. It didn’t say anything about police investigation like the other poster, but it’s enough to scare me into not upping/downing anything else from torrent sites.
probably the best argument i once saw somewhere was essentially:
if i make my own music and i make my own torrent file and up it to a tracker and that tracker is confiscated, then aren’t my copyrights being violated? after all, i created the torrent file which means i own the copyright to it. and then extending the argument to legally uploaded music i think there is cause for one to sue the agencies that took the site down for some kind of ‘business impact’ or denial of service/freedom.

Downloading music is wrong? Charging $20-$30 is right? Let us face the facts, the current music industry is greedy, plain and simple. Most people who “make it” in the music industry aren’t even worth the $20 that they charge for consumers to listen to them. Sites like OiNK recognize the corrupt and money hungry corporates who worship the all-mighty dollar and sites like this is the world’s way of fighting back. The truths of this world are always considered wrong, that is why we as a planet are monitored so closely, and asked to pay so much for the small things in life, that there is no wonder that sites like this come up. I mean, are the artists who produce CDs really worth their multi-billion dollar fortunes that they establish for putting out one or two cds? What makes them worth it and real hard working people who give it there all, not? Why should we have to shell out so much money for something that we listen too? The admin of OiNK and even the admins of other sites all know and feel like we feel, so they do something about it.
Want a solution? Don’t tempt people to break the law, because that is all the music industry is doing by all of this. Charge what a cd is actually worth and not what the artist, and all the people he has to pay out, think it’s worth. The IFPI and BPI have it all wrong, go after those companies that are extorting people to pay X amount of dollars for 12 songs when only 1 or 2 is all that we wish to hear. Basically, slap the music industries and artists in the face because if they cant understand why sites like OiNK exist, it truly shows that they need to win this war because without their fame, they are nothing.
