OiNK Admin Released From Custody
Written by Ernesto on October 23, 2007After a turbulent day the admin of the raided OiNK.cd was released from custody. At this point it is still unclear what the legal consequences will be, but it is good to see that OiNK is back home.
The OiNK admin contacted TorrentFreak by email which confirms his release. As for the OiNK users, it is highly doubtful that the IFPI or BPI will go after them all, or even one of them. They do know how to scare people with messages like: “A criminal investigation continues into the identities and activities of the site’s users”, but there is no evidence that they actually will.
More interesting perhaps, how did they gain access to the OiNK domain, and why are they allowed to spread this propaganda? They are not a law-enforcement agency.
NFOrce, the ISP of OiNK, said today in an interview that they were not aware of any illegal activities surrounding the site. They thought OiNK was hosting a streaming video site or a weblog. Yeah, right.
The BBC did a small report on the arrest with a lot of false information, releasing nonsense statements such as: “illegally downloading music onto his website” and “paying subscriptions to enter the website.” The video of the arrest is shown below, see for yourself.

i really think that the oink community should come together on this one and voice what the site was really about, we cant let these bastards get away with this shit. oink was the shit. i loved it. i would also donate to pay for oink legal fees, and what ever else to make the site come back.
We should all get together and say what the site was all about, because it really was a bunch of “Friends” getting together and sharing music.
We are the consumers and the ones who buy music and if the music is good I would go out and buy it.
Of course there is a possibility for oink to return. Same thing happened to piratebay and they were back up on a different server and in a different country within 3 days I think.
These things happen all the time and the good sites usually are expecting it.

This makes me sick. OiNK was amazing and it always had the music I was looking for. Thank you record company maffia. Throwing shit pop music at the music lovers will surely get them to buy overprized cd’s. And actually they do! Hope Radiohead will not be the last to pass by the record companies.

If that source is somewhat accurate, I’m one of the 50% of users from the US. Please, criminally investigate me.
It seems to me, the main issue is that OiNK’s Palace was the source of PRE-RELEASE material, meaning before the record companies officially released it. Which is a valid case of concern, considering that after it leaked onto OiNK, it was then leaked on and on to other torrent sites — some public. This is not to point the finger at OiNK being the sole culprit of every leaked pre-release, but apparently 60 in this year alone. Impressive!
On the other side of the issue, having THE 100% FREE privilege to OiNK allowed an honest individual to preview albums before investing. I have no qualms paying $10 for a new, newly-released CD, or less for used. Albums which I missed the initial release sale, I’m stuck paying $20 if I want it new. Where I live, I know for a fact the average young person - avidly into music - doesn’t have the $20 to drop on any and every album s/he likes. Twenty dollars for a shiny piece of plastic, worth maybe one or two.
And where is this profit going? Mostly, right to the industry executives, who are undoubtedly the source of this fire. A few cents per CD might go to the actual members of the band.
More of my hard-earned money goes to the band, which is why I go see them in concert when I can. This is not to say I don’t buy their albums.
The point comes straight to money - just like always. Record sales down a whole third in six years?! It can’t possibly be because of a lack of talent in the mainstream of music. It can’t be because albums are overpriced if they’ve been sitting on a shelf for a while. It must be because of illegal peer-to-peer downloading. Thanks for the great insinuation of logic, Media. Next time I want shit stuffed down my throat, I’ll eat my own.
People should complain to the BBC and force them to publicly apologise for misrepresenting the facts regarding Oink.
