PayPal Bans BitTorrent Friendly VPN Provider

PayPal is widely known for their aggressive stance towards BitTorrent sites and file-sharing services, and this policy has now been extended to VPN providers. TorGuard, a company that offers VPN and proxy services, has been banned from using the payment processor because of its affiliation with “BitTorrent.” As a result, thousands of dollars belonging to the company have been frozen.

In response to new Internet surveillance initiatives there is a growing interest in privacy enhancing services such as VPNs and proxies.

TorGuard is one of the many companies catering to this demand. As the name suggests, TorGuard has several plans specifically targeted at BitTorrent users who prefer to hide their IP-addresses from the rest of the world.

Being a BitTorrent-friendly VPN appeals to a wide audience. However, the company has also learned that it has a downside. Without prior warning or detailed explanation, PayPal decided to ban TorGuard for promoting their services to BitTorrent users.

The following email was sent by PayPal.

“When we reviewed your account, we noticed that your activity violates some of the agreements you have with us. Because of this, we’ve limited your accounts and can no longer offer our services to you. You’ll still be able to log in to view your transaction history, but you won’t be able to send or receive money.”

Because the email didn’t explain what agreements had been violated, TorGuard’s owner Jason decided to call the company for an explanation. But instead of helping him to resolve the issue, PayPal informed him that the account would remain closed.

“It wasn’t until I called PayPal and spoke with a business account rep that they explained PayPal doesn’t allow promotion of ‘torrent trackers’,” Jason told TorrentFreak.

“After arguing with the representative that we fall in the category of a hosting service they assured me the decision had already been made and nothing further could be done.”

Apparently, PayPal is going down the same route as Apple, where everything related to BitTorrent is simply a no-go. Over the past years the payment processor has already thrown out many cyberlockers and BitTorrent trackers that linked to infringing content, but to our knowledge this is the first time that a VPN service has been banned.

Needless to say, PayPal’s decision has resulted in quite a few hassles for the VPN service.

“They canceled hundreds of automatic payments and froze thousands in our account,” Jason told TorrentFreak.

“We can’t even issue refunds unless the buyer disputes the charge. Most of our clients have been very patient since almost everyone has been wronged by PayPal at some time or another,” he added.

PayPal’s aversion to BitTorrent comes after the entertainment industries repeatedly called on payment processors to take responsibility for their connections to online piracy and counterfeiting. While this is probably justified when a store is selling knock-off products, banning a VPN goes rather too far.

Despite the setback, business continues as usual for TorGuard. They have launched a new portable OpenVPN client for Windows, and a Mac and Linux version is coming soon. As for the payments, the company has plenty of alternatives available.

“We still accept all forms of credit card, Google checkout and couple of other secure wallet services. It’s ironic to use PayPal when buying a VPN/proxy anyway, they have a proven track record exploiting user’s financial info.”

“Those who are serious about private payment solutions should consider one of the many alternatives like Prepaid VISA cards, OKPAY, Bitcoins, and other ewallet services,” Jason concludes.

Update: Paypal restored TorGuard’s account after three weeks.

          Ebay has so many unique and rare stuffs for sale, most of which are not available anywhere in the local market. Infact where I come from, even 5% of the stuff sold on Ebay is not available in my country. So ebay is like a goldmine to me.

          I stopped using Paypal and Ebay too. They’re just too damn abusive. Besides there are always alternatives and some have been quite good, not to mention free. Your business is only relevant until something truly better comes along and this applies especially to those whom make their profit from providing services.

        Yes people still use paypal because if you follow all their simple rules and regulations, they don’t cause any problem. I am a paypal user since 2002 and have completed thousands of online purchases with Paypal and they have never let me down. Considering almost all online merchants support Paypal nowadays, I see absolutely no reason to stop using them.

        The only people who have problems with paypal are scammers and fraudsters and those who violate their TOS, try to abuse the system and then cry foul when booted off.

          To be safe, don’t leave too much money with them, they can suddenly freeze it and you may have to wait 6 months or more to get it back.

          I thought the same as you. That’s untill they banned my account for selling PHP scripts. They claimed it was against there TOS to sell PHP scripts which enable people to voilate copyright laws (I assumed they were talking about the script which let people search for youtube videos mixed with last.fm’s api to discover new music).

          They try to ban you for any possible reason they can if you start earning lots of money simply so they can keep the funds to themselves (they kept a few thousand from me).

          It’s not about whether YOU have experience any trouble with PayPal. I used it many years ago with no problem. But hey, at one point I was a GoDaddy customer, too! (*)

          The issue at hand is whether you want PayPal to have your business.

          Writing blurbs on online fora is one thing. Voting with your feet/wallet is way more effective – as long as you let them know why you are moving away.

          (*) No I don’t care one but about Danica Patrick being the Hot GoDaddy Girl when still in Indy. The reason I moved my domains away was their explicit support for SOPA/PIPA. While they retracted, the damage had already been done.

PayPal will still be offered among the alternate methods, however, patrons choosing to use PayPal will be shown a paragraph detailing our decision and presented with links with further information.”

          The problem is that there isn’t really an XXX yet; Visa/MasterCard and it’s infrastructure are solid in the hands of vested US business interests, operating in the ‘I wash your back, you wash mine’ culture.

    I wonder if they will ban payments to/from BitTorrent Inc? Somehow, I doubt it.

    Yet how long did they keep allowing with no problems at all FileServe to rip customers off (re-billing for terminated accounts) and pay customers to upload warez? And yes, Ricky from FileServe was 100% aware what uploaders were uploading because he talked directly with them at WJunction, anyone from that forum should be able to verify it.

    So paying for warez uploads is OK by PayPal’s stance but a VPN which advertises that you can use it for anonymous transmission on the bittorrent protocol is not OK?

    When are we going to have a real PayPal alternative? That is what Kim Dotcom should make, a new PayPal that isn’t for censorship.

    the sooner paypal becomes the least used service on the internet, the better. i could understand it getting the ache and preventing a service from using paypal in the future but to withhold monies that have already been paid is taking the piss. a court battle needs to ensue where the reasons this happens is disclosed, ie, under the orders of the entertainment industries. should go down well, given the crap that’s going to hit fan for them over the filing of false charges in the Mega case

    Paypal is notorious for suspending accounts for no reason or near no reason at all. They also are unhelpful if you need to find out why they closed your account.

    File a lawsuit. Get your money back and damages from Paypal. They can’t win in court, policy cannot trump law.

        Pretty sure blatant theivery is still against the law.  If I pay you to store my motorcycle for 6 months and you then tell me “I think this motorcycle is stolen, I am keeping it”, that is theft, if you have no intent whatsoever in making any effort to return the motorcycle to it’s rightful owners and have no basis for coming to the theft conclusion in the first place.

        Paypal cannot simply garnish your money for no reason, just like you can’t legally sign away your rights to sue someone for negligence (those waivers you sign when going on ATV tours and shit aren’t worth the paper they’re printed on in reality).  However, having enough money to sue a bank and win is a different story.

        Attempt to take paypal to court, and they will likely settle before the hearing date.

        Paypal actually has a policy where they freeze a certain percentage account in order to cover fraud on other account. Paypal doesn’t want their shady activities exposed, so they will likely settle.

    Bitcoin is impossible for nontechnical people and there exists no proven safe way to buy bitcoins. I understand it must be so due to the anonymity and privacy concerns, but as long as you can’t buy bitcoins over the counter from a trusted party, and the price is unpredictable, it is never going to work for 99,9 percent.

    Torguard also has some very nasty clauses in its terms of service. When you sign up you consent to indemnification, meaning that you must pay their attorney fees and expenses in all cases solely according to Torguard’s discretion.

      Oh but I guess your looking to buy with paypal or CC directly?Do to the nature of bitcoin, it cant be reclaimed in the event that someone files a fraudulent chargeback. Then whoever provided the bitcoin is out the bitcoin and the money. So it is rare to find place that sell using a service that can be charged-back, but they do exist.

      There does exist physical bitcoins, that can be used to pay using bitcoin when buying stuff in person-to-person situations(not online), and also include tamper-seals so can also be used online.

      I don’t know what you are smoking because I am buying and  using Bitcoin all the time. Since this is still experimental I am dealing with only a little bit of money at a time. So far no glitch. Also the value of Bitcoin fluctuate but not that fast and recently it has been going up in value.

          Well, It is of course foolish to try to speculate on bit-coin right now because this is still experimental and because the banks want to kill it, beside the fact I consider speculation as a parasitic activity since it produce nothing and promote nothing.

          However it is great for paying stuff online. Just buy the bit-coin you need for your purchase. Any residual if any can be used for future purchase. This is what I do and I am happy with that. Also Bitcoin maintain your anonymity. Even if you use your credit card to buy some Bitcoins nobody can know what you pay for with it.

          If some assholes want to sue you because of your website they can never find you as long as you don’t expose any IP adresses. This is what I do.

          Finally if you have a bank acpte with JP Morgan Chase, or BOA to name a few and if you think that your deposit is safe think again. Most majors banks are insolvent these days and sooner or later  it’s all going to crash.

    If I sell something online, excluding credit/debit, what is there apart from Paypal? I can’t very well tell a customer to go create an account with Dwolla or Square which they have never used and likely never will. Paypal is it. Virtually everyone has an account with them and they are everywhere. Also, Torguard is stupid for leaving thousands in their account. I would personally never ever leave more than ~$100 in any paypal account. They are not a bank and they are not reliable.

    Yes, the majority of people just need to stop using paypal to pay for things!!! Your credit/debit card company will give you far greater security then the thieves at PayPal… Your bank even has real live people that pick up the phone when you call.

    There are alternatives to paypal, and i am not talking about Bitcoin. But in all honesty i think the market is ready for a real internet based non profit to take over all internet payments. As said above MEGAPAY would be excellent and i would use them, remember that the only reason paypal is used so much is because they are the easiest payment method on ebay. Yes they provide protection for your payments but that is just a simple transfer of the protection you have with any debit or credit card, if it was not the law regarding card payments i doubt ebay would make it so easy to get a refund.

       Y’know, The idea of a paypal alternative is a great concept…Not so sure about MEGAPAY or MEGABANK though…

      While I sympathize with Dotkom’s situation, he still has a history outside of Megaupload and I don’t know that I’d trust him with my money.

      Those who don’t learn from history are doomed to repeat it…the concept of Dotkom setting up an internet bank reminds me a lot of the Eve Online fiasco of a few years back, except that in this case Dotkom would use the embezzled funds to buy a gigantic ROFLCOPTER to cruise the internet in.

          by ‘bankers’, I assume you mean the people at the heads of the banks I do business with?

          One of the major banks I do business with is the Canadian bank (As I too am canadian) TD Canada Trust.

          Turns out from a very rudimentary search, that the President and CEO is Tim Hockey (maybe that’s a pseudonym, that’s an awfully convenient surname!)

          I don’t know anything about the guy, so I continued my searches, looking for “”Tim Hockey” controversy”, “”Tim Hockey” illegal”, “”Tim Hockey” criminal”, and finally “”Tim Hockey” embezzle”

          Couldn’t find anything pertinent.

          Next, I did a basic search for “Kim Dotkom”, using the same search terms, with controversy, illegal, criminal and embezzle.

          Now that’s a different story. Hell, you can just wikipedia the name and get all the details.

          Kim Schmitz (aka Kim Dotkom, Kim Dotcom, Kimble, Kim Tim Jim Vestor) has been charged with credit card fraud, computer fraud, insider trading and embezzlement.

          Now, either Tim Hockey is better at not getting caught, or he hasn’t done anything noteworthy enough to get his name as public for his foibles as Kim Dotkom has.

          Either way, when I see a person’s history peppered with words like “fraud, insider trading and embezzlement,” I sure know who I’d rather give my money to.

Their customer support is just super awesome and always filling to help out a noob. I’m paying for one VPN server but they have given me 3 extra servers, because the one is having slight speed problems during peak times. I will be your customer as long as you stay in business!

If you deal with paypal, after all of the stories (remember wikileaks had their account siezed by paypal) you deserve to have your assets and money siezed by those crooks.     If Paypal were consistant, their logic would result in them no longer processing payments for cars bought on ebay as the car once purchased could be used in a robbery.

    A VPN site doesnot promote torrent trackers and there are plenty of reasons why someone would want vpn for torrent use other than piracy.

    1. To bypass ISP bandwidth thottle of the protocol.
    2.Even if downloading or distributing ‘legal’ content via BTand trackerless torrents, there is every possibility that your IP will be passed to other  BT users looking for new peers. It does not mean you  are sharing what they are looking for no matter what an anti piracy troll lawyer might claim. VPN is an ideal way to save yourself from trolls.

        Actually, as most normally educated people know very well, banks are generally not free to do whatever they want, they have rather strict regulations in most countries laws regarding may different aspects of their operations. In addition to that there has been increased political talk about regulating their businesses even harder since they stopped handling Wikileaks payments, so that they can’t refuse handling transactions any longer just like that, discriminating customers.

          Yes, so some people would like you to believe, and companies which call themselves banks normally offer more functions than a payment gateway, but PayPay is indeed technically a bank, even though it isn’t regulated exactly as such in the US. In the worlds biggest and strongest economy however, the EU, it is. So rest assured that PayPal is not free to do whatever they wish, whether it’s on US soil or European.

      You forgot these usages:

      1) Prevent the gov from spying on what you read and what you write online as it is now common knowledge that the NSA is spying illegally on what we are doing on internet.

      2) Increase the internet safety when doing sensitive stuff on the net such as banking.

      3) Prevent you ISP to throttle your connection based on content. For exemple Comcast would like to sabotage video stream to promote their declining cable service.

      4) Keep internet neutral and uncensored.

    If you check out the websites of the American Nazi party as well as the KKK, you will find a link to donate money to those organizations using PayPal.  Makes you wonder what criteria they’re using to judge who and what companies to allow to use their company’s services.

    Unfortunately there doesn’t seem to be anything comparable to what PayPal does; they are a monopoly and no real competition means their executives feel quite free to use the massive power they possess as they please to deal death-blows to anyone they don’t agree with.

    One more reason to boycott PayPal. Do it people. It’s worth it, this company needs to be hit where it hurts. I take extra care also to email or contact any company I come across who do not offer any alternative to paypal, making it extra clear that I boycott paypal for good reasons and that unless they stop using them they will never get my business.

    This claim from PayPal that they don’t allow the promotion of ‘torrent trackers’ is bogus. I am a member of ClearBits, a torrent tracer for Creative Commons licensed content. They have paid membership plans and accept payments via PayPal as can be seen in this screenshot http://www.screencloud.net/v/qI9c

        I would of course disagree the ClearBits sucks, it provides a valuable torrent hosting, seeding and tracking service for creators that wish to release their work under Creative Commons licenses and I for one download a lot of content from their site. Of course there are many other trackers and index’s that are also available to such creators, but many of them have questionable legal standing which could in fact cause restricted access to perfectly legal works.

        As I have just said, ClearBits is not a torrent linking site. The provide hosting for creators to seed the works on as well as index them. They also provide a mechanism for creators to receive donations for the works from fans.

        Of course PayPal would have a hard time arguing the legality of ClearBits, but that’s not my point. My point is they stated they don’t allow the promotion of torrent trackers, which would be a false statement, in which they would have different rules and apply different standards to different BitTorrent relates websites and service. In other words it is a hypocritical statement from them.

        Any administrator managing a BitTorrent or other P2P relating website or service should use the example of ClearBits to challenge PayPal’s proclaimed policy.

          I think problem is paypal just froze their accounts without giving them any chance to argue. Not that arguing is going to do much since paypal is not a bank nor is it regulated. The bastards can take or freeze any of their customer funds whenever they feel like it.
